Present: Board members Fred Feit, Harvey Johnson and Dugan Wilkinson. Also CouneR.members Kruchten. and Lopez, City Manager Cof Assistant City Attorney March, Jr., Director of Public Works Liquin, Director of Finance Charlie Cain, Superintendent of WAter and Sewer E Hilgenberg, Planning Director Don Reynolds, Secretary John Bartel and Ward Fischer. Also present were Consulting Engineers Morton Bittinger and William Hansen. , The meeting was opened by Ward Fischer indicating that he the City Attorney were discussing an agreement between the City of Fc Collins and North Poudre Irrigation Company in consideration of a per .` petual lease of 10,000 acre feet of water. Relative to the annual charges for this water, it was indicated that on the agreement, they( be an availability or holding charge of $2.00 per acre feet for the also, that No th Poudre Irrigation Co. would not be wed for age or delivered and a charge of $32.60 per acre foot will -made on water requested by the City. In the agreement there will clause that the City may terminate this lease upon a three year w notice, and that North Poudre Irrigation Co. may terminate this ag ment st any time for non-payment. Consulting Engineer Bittinger was asked how North Poud: at the charge of $32.60 per acre foot for the requested water. explained that one share equals approximately 5 acre feet and tY of $32.60, as agreed to, would assure the City of this amount o for an indefinite period. At these rate-s , this water would cc 0 r minimum of $20,000, plus cost of the water requested. It was suggested that an additional charge of 10¢ to 15X 3per water used be applied to Fort Collins residents to off -set this rental fee. The City Attorney made the following comments as suggestions to the proposed agreement: 1. That North Poudre would deliver requested water any place in their system. 2. North Poudre would have no right to transfer this water. 3. The agreement would be nul and void unless notified of their intent. 4. Open end provision. 5. No default without a reasonable lenght of time. 6. That the agreement be placed on an option for at least one year. Mr. Harvey Johnson indicated that Water Supply and Storage get approximately 15,000 acre feet of water yearly. Further discussion was made that should the area continue to expand and grow at the con- tinued pace, Fort Collins may build an additional filter plant in the Wellington area. Ward Fischer stated that North Poudre was quite enthusi- astic concerning this agreement and would be anxious to get their signs- ture on some agreement with the City.
