O'CLOCK, IN THE COUNCIL CHAMBERS AT CITY HALL.
Present: President Ward Fischer, Mayor Harvey Johnson, Acting City Manager
Stanley Case, Director of Public Works Adam Fischer, Water Suprin-
tendent Ed Hilgenberg, Vice President Frank Ghent, and Board Member
Fred Feit,y Secretary John Bartel.
In the meeting of August 2, 1965, it was recommended that the City
purchase the water stock offered by Glen and Dorothy Manning. In the meeting
of the City Council on August 12, 1965, the Council decided that this water
stock was not needed. The Board has informed the City Attorney to advise
Mr. and Mrs. Manning of this action.
The Josh Ames water stock offered by LeRoy Smith is at present of
no value to the City; therefore, this purchase was also refused.
Item No. One of the Public Works Director's memo of August 20, 1965
was read at length:
• 1. Section 54 of the City Water Ordinance, (Ordinance No. 189 1965)
be revised as follows:
"Section 54 Flat rates-- ror�ate
If water rates are�cnange-fir water users institute or terminate
service other than on established billing dates, the water bill shall not be
prorated. Provided, however, that the initial water service shall be prorated
to the nearest ten (10) day period. The flat rate charge for a quarter shall
be the minimum charge for any use during the quarter."
The revision involves the addition of the second sentence. Pro-
rating the initial water service appears to be a far more equitable arrangement.
After discussion, motion was made by Fred Feit, seconded by Harvey
Johnson that the following sentenence.be made a part of Section 54 of Ordinance
No. 18, 1965: " Provided, however, that the initial water service shall be
prorated to the nearest ten (10) day period."
Item No. Two of the Public Works Director's memo of August 5, 1965,
was read at length:
2. Mr. Demerie requests that he not be required to furnish water
• rights to the City except at such time as City water service is requested and
received. And that, the amount of water rights he is required to furnish be
calculated on the basis of the actual area being served.
Furnishing of water rights is covered in Section 67, Ordinance No.
1% 1965, of the City Water Ordinance which reads in part, "Effective

January 1, 19662 all premises requesting original water service from the City -
of Fort Collins, including but not limited to properties included in all pro-
posed annexations, shall furnish to the City of Fort Collins, without cost
to the City, water rights acceptable to the City in the amount of 2 acre-feet
per acre to be served or, if water rights are not available, the equivalent
of $100.00 in payment for each acre-foot so required provided...."
After considerable discussion, motion was made by Frank,Gh®nt,
seconded by Fred Feit that the water required with annexation be supplied or
paid for at the time of filing the final plat. This insertion to be made
in Article 67, Ordinance 18, 1965.
These items should be referred to the City Attorney to draw up
the amendments to be made a part of the original ordinance.
With nothing further the Board adjourned.
