Minutes of Regular Meeting of
March 14, 1975, approved
Chairman Fischer inquired if there were any corrections to the minutes. Hearing
none, he declared the minutes approved as published.
Legislative Committee Report
Board member Caulfield stated he had nothing new to report on federal legislation.
Last week, he reported on the National Conference on Water in Washington D.C.
He will be a panel member on federal, state, and local relations. Mr. Caulfield
will report back on this.
Water Tap at 111 West Monroe Drive
for E. Scott Condreay
Mr. Liquin stated the concern is, according to City Ordinances, if the structure
is in the City Limits, they must connect to all City utilities. The request
is to hook onto City sewer, and he is requesting permission to hook onto District
water. All utilities are available at this address except water. The City has
no water main in that area, but the Fort Collins -Loveland Water District has a
6 inch water main on South Mason Street. The other people in that area are
hooked onto District water.
The Water Board discussed the various alternatives. The utility drawing for the
Business Planned Unit Development, South Mason Subdivision, dated September 19, 1973,
calls for a water main and sewer main to serve this property. In that there is
a utility drawing on file with the City to provide sewer and water to this site,
the Water Board determined that this is an administrative matter, did not require
action from them, and they will advise the Council on this.
Petition on the Mary Matson Line
Chairman Fischer stated he has a petition signed by all the users of the Mary
Matson Line. They asked that this be brought before the Board and be acted
upon favorably. They requested the City to take over the operation and mainte-
nance of that line. Mr. Liquin stated they are asking us to take over an 1k inch
galvinized line and put it into our system. He recommended that the petition
be turned down. After some discussion, Board member Carson made a motion,
seconded by Mr. Cain, to turn down the petition. The Chair put the motion which
was unanimously adopted.
Rental Rates for the
1975 Growing Season
Chairman Fischer inquired if Mr. Liquin had any recommendation as to what the
assessment price charged should be for the 1975 season. He also inquired if
the assessments charged should go up in direct proportion of the assessments
paid. It was decided that the assessments of last year would reflect the
increase in assessments of the ditch company.
Mr. Liquin recommended that Horsetooth Water remain at $7.00 per acre foot,
since the assessments paid were not changed. In that the assessment for
North Poudre Irrigation Company went up $4.00, it was recommended the assess-
ment be raised to $42.50 a share. The $23.10 charged on the agreements will
be adjusted in accordance with the agreement. Pleasant Valley and Lake Canal
Company assessments:went up $20.00 this year, and it was recommended the
assessment be raised from $60.00 to $80.,00 per share. There was no change for
Arthur Irrigation Company and the assessment will remain at $4.00 per share.
Parks and Recreation would like to reserve all of Larimer County Canal No. 2,
New Mercer Irrigation Company, and Warren Lake Reservoir Company. They will
pay the assessments on these. Water Supply and Storage Company has agreed to
lease back all the shares. (See Appendix "A" attached)
Board member Caulfield made a motion, seconded by Mr. Cain, to recommend the
prices that were discussed. The Chair put the motion which was unanimously
adopted.
Consider Meter Study
Chairman Fischer stated the City Council had expressed considerable interest in
the question of whether or not water meters should be installed. At that time,
the Water Board discussed in general terms the fact that considering all alternatives
including meters, our recommendation was the acquisition of Joe Wright Reservoir
and the Michigan Ditch system and the enlargement of the Reservoir and not to
spend money for meters. This was accepted by the Council. The study is something
the Council had requested be given consideration for general purposes. Mr. Brunton
had felt this study should go through the Water Board before it goes to the Council.

Chairman Fischer further stated that this particular study was not a study done
particularly at the request of or by persons selected through action of the
Water Board. It is not a Water Board study. The study was given to the Water
Board for its comments and action prior to the Councils consideration. Also,
the study was done in partial fulfillment of the requirements for the Degree of
Master of Science at CSU. Mr. Liquin stated the title of the report is the
"Preliminary Comparison of the Economics of Two Water Supply Alternatives",
and this is strictly an economic analysis.
After considerable discussion, the Water Board agreed on the following comments:
1. The study confirms our previous conclusions that Joe Wright Reservoir should
be built, and metering is not a proper alternative for it.
2. There are many assumptions in the report which being unverified are questionable,
but the study does indicate that at some point in time, indepth studies should
be undertaken to determine, (1) Whether water meters should or should not
ultimately be installed, and (2) If so, when and under what terms and conditions.
3. There is a question of water meters as related to considerations of conservation
and equitable rates, and that these matters are properly considered whether
or not meters should be used.
Board member Carson made a motion, seconded by Mr. Caulfield, to approve the
above comments be made to the Council. The Chair put the motion which was
unanimously adopted.
Chairman Fischer advised the Water Board that he would forward their comments
to the Council.
Other Business
1. City Attorney March stated we have been asked to submit the subdistrict
petition by June 11. This contract has been adopted by the board. He was
concerned about the wording on Page 2 and Page 4. Mr. March felt that with
those provisions in the contract, we cannot relieve ourselves of the obligation
for the period of bonded indebtedness, even though he does not think that
was the intent of this contract.
Chairman Fischer stated it was his understanding of the intent of the contract
that if we assigned our rights prior to the time bonded indebtedness was
incurred, then we would be relieved from any obligation in regard to obtaining
assessments. He further stated that until we are satisfied with the contract,
we should advise the City not to sign it. He suggested they call John Sayre
and straighten it out. There was no Board action required at this time.
2. Board member Caulfield inquired as to where we stood on the Environmental
Impact Study. Mr. Liquin stated the summary report has been turned over
to the Forest Service. They have, on the basis of the investigation, the
hearing, the comments, and the letters, told Mr. Harold Ellingson to prepare
a draft statement. If the statement says that there is no impact, that will
be the shortest route. The statement will be delivered to the Forest Service
on Wednesday. It is anticipated that by May 15, the Forest Service will have

no objection and will allow us to proceed with the design. This means we
could start construction in 1976 instead of 1977 or 1978. After the Forest
Service has made corrections to the draft statement, they will then hold
hearings. Now we are requesting comments in writing.
Chairman Fischer stated, the Cache La Poudre Water Users Association wrote
a letter to the County Commissioners urging they support the project.
Mr. Liquin stated the County Commissioners did wholeheartedly support the
project, and that is in writing to the Forest Service.
3. Mr. Liquin reported on the -pressure-problems at the Soldier Canyon Water
Plant. We sent the valves back to the factory. One of the valves has
arrived, and it meets all requirements and tests. The second valve should
arrive by next Wednesday. We are in no danger of not being able to supply
water before we have hot weather.
4. City Manager Brunton reported that they have been having meetings for the
last 3 or 4 months on the possibility of putting another outlet into Horsetooth
Reservoir around Dixon Canyon Dam. They have been working initially with
Eastman Kodak, Windsor, and Fort Collins -Loveland Water District, although
there are about 9 agencies that are interested. They assigned 1 share to
7 agencies and 2 shares to Fort Collins and Eastman Kodak at a cost of $1,000
per share. The Northern Colorado Water Conservancy District will act initially
as the business manager. The Bureau of Reclamation indicated they will make
the studies for around $6,000. We hope to have all the agencies sign agreements
to do the first phase of the study. Then we will explore the possibility of
joint treatment facilities. The discussions are still exploratory.
5. Board member Caulfield inquired about the minimum stream flow. Chairman
Fischer advised the Water Board that there was a hearing scheduled May 1
in Grand Junction and we had further meetings with the Game and Fish Department.
We explained the dangers and our concern, and they seemed to understand.
We explained that all the people need water from this river, and if their
intent is to buy water, we could help them find water suppliers that would
accomplish their purpose and the purpose of everybody else. But they did
not agree that they would not interfere with the exchanges that are so essential
to our operation. They said they would have to study the whole South Platte
River. This put it in limbo for possibly 1 or 2 years.
City Manager Brunton stated that we will be sending a letter to City Attorney
March and Ward Fischer to officially represent the City and act as legal
council on this matter.
6. The next regular meeting of the Water Board will be May 9, 1975.

In 1974 the City received a quota declaration of 8, 180.8 acre foot units (SO%)
first quota + additional quota of 2,058:2 acre feet. Set aside for City use were
3,500 acre feet for the Soldier Canyon Plant, 1,000 acre feet transferred to
Chambers Lake for storage, 500 acre feet reserved for payment to North Poudre,
and 500 acre feet reserved for use at Collindale Golf Course. Total reserved for
City use 5,500 acre feet.
For 1975 Public Works Director, Chuck Liquin, has requested that the City
transfer 1,000 acre feet to Chambers Lake for storage, reserve 3,500 acre feet for
use at the Soldier Canyon Plant, and reserve 500 acre feet as back up to North
Poudre. Parks and Recreation Director, H. R. Phillips, has requested that 500
acre feet be reserved for use at the Golf Course. Total reserved for City use
5,500 acre feet.
There are 209 acre foot units held by agreement.
