Council Liaison: Karen Weitkunat IlStaff Liaison: Felix Lee (221-6760 hai erson: Charles Fielder hone: 484-0117 , 207-0505QD A regular meeting of the Building Review Board was held on Thursday June 27, 2002, in the Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort Collins, Colorado. ROLLCALL The meeting was called to order by Chairperson Fielder, and roll call was taken. 2. APPROVAL OF MINUTES Boardmember Little made a motion to approve the minutes from the May 30, 2002, meeting. Boardmember Hauck seconded the motion. The motion passed. Vote: Yeas: McCoy, Little, Fielder, Massey, and Hauck. Nays: None. 0 BRB 06/27/02 Page 2 3. Contractor Appeal - Randall K. Leu, d/b/a Rand Construction, Appeal 415-02 Fielder explained the procedures for contractor appeals. Coldiron provided an introduction to the appeal. Coldiron stated the Appellant is requesting an exam waiver for a Class D-1 license. The Appellant requested the waiver based on his experience as a residential contractor, as the president and owner of Rand Construction, as a construction manager, as an on -site supervisor, and as a lead carpenter. The Appellant is also a registered professional engineer and holds a BS and MS degree in civil engineering. The Appellant has taken numerous continuing education courses regarding building and engineering issues. Coldiron noted the Appellant held a City of Fort Collins Class D-1 license from 1982 to 1987, although no records exist for said license. The Appellant currently holds a residential license with the City of Loveland. Coldiron stated the Appellant has enough project verification forms to obtain a Class D-1 license. Randall Leu addressed the Board, and passed out to the Board his statement of hardship. Leu explained that he understood the importance of the contractor licensing. Leu stated he was requesting the exam waiver because he needed more work opportunities. Leu said he worked primarily in Loveland, and is facing a hardship due to single family residential lots being nearly impossible to obtain for small builders. Leu stated he plans on focusing less on new construction and more on basement finishes. Leu stated he already has some interest from homeowners in Fort Collins. Leu noted he would like to resolve the licensing issue before he began to bid other jobs in Fort Collins. Leu remarked he would like to have class preparation before taking the contractor licensing exam. Leu is registered for a class in September at Front Range Community College. Leu requested that the Board grant his appeal. Coldiron asked Appellant Leu if he has had training over the 1997 Uniform Building Code. Leu stated he has not, although he has done some self -study. Coldiron asked if Appellant Leu has formally tested over the 1997 Uniform Building Code. Appellant Leu stated he took a test for his Loveland license, but does not remember if it was over the 1997 Uniform Building Code. Leu made his closing statements. Coldiron made her closing statements. Little made a motion that the Board grant a temporary exam waiver for six months until Appellant Leu had completed the code training course at Front Range Community College and had the opportunity to schedule the exam. McCoy seconded the motion. Hauck noted his concerns with Little's motion. Hauck felt the request should be granted due to the Appellant's additional education and training. Little stated he was trying to be consistent and realized that Appellant Leu has extensive experience and qualifications. Massey felt Little's motion was reasonable. There was a discussion held regarding how to handle the temporary exam waiver. Little amended his motion to grant a temporary six month license, and give Appellant Leu six months to complete his D-1 license exam, at which time, upon successful completion, his license would turn into a regular full license. McCoy seconded the motion. The motion passed. Vote: Yeas: McCoy, Little, Fielder, Massey and Hauck. Nays: None. BRB 06/27/02 Page 3 0 4. Contractor Appeal -- Brian Fowler, d/b/a Rocky Mountain Construction, Appeal 916-02 Coldiron provided an introduction to the appeal. Coldiron stated the Appellant was applying for an exam waiver for a Class E license. The Appellant has fifteen years of experience in both commercial and residential construction. In the past three years, Appellant Fowler has done multiple -tenant finish jobs in Weld County ranging from $18,000 to $80,000. Coldiron noted that the Appellant has enough information to meet the Class E experience requirements. Fowler addressed the Board, and stated he has been doing tenant finish work for the past three to four years. In the past, Fowler held a Miscellaneous and Minor Structures license in Fort Collins; however because he could not do basement finishes under that license, Fowler did not renew the license. Fowler stated he had a couple of tenant finish jobs lined up in Fort Collins. Coldiron asked Fowler if he has had any formal training or testing of the 1997 Uniform Building Code. The Appellant stated he did not. Hauck told Fowler that he needed to state his hardship as to why he could not take the exam, and that Fowler needed to have evidence of formal training or education to allow the Board to grant an exam waiver. Hauck stated the Board could not grant an exam waiver solely based on experience. Fielder stated the hardship was that the Appellant had some pressing job opportunities in Fort Collins. Hauck asked Fowler if he held any other current licenses. Fowler replied he holds a current license in Federal Heights and that most of his work occurs in Weld County. There was a discussion held regarding test preparation. • Fowler noted his interest in taking the upcoming class on the building code. Little made a motion to approve Appellant Fowler's request based on his qualifications and hardship. Little moved to approve a temporary waiver for Appellant Fowler to take the Class E exam for a period of six months. Hauck seconded the motion. Hauck stated the Board might be setting precedence, and noted that experience was hard to judge. Little stated he felt there was a hardship. Massey was concerned with Appellant Fowler's lack of formal education and training. There was a discussion held regarding the contents of the Class E licensing exam. Massey said he would support a tighter timeframe, and thought the Board could approve a project -specific temporary license. McCoy concurred with Massey. There was a discussion held regarding the Appellant's awaiting jobs. Little stated he would support a tighter timeframe of ten weeks. Little amended his motion to approve a temporary exam waiver, and allow the Appellant to operate any job for a period of ten weeks. Hauck seconded the motion. The motion passed. Vote: Yeas: Little, Fielder, and Hauck. Nays: McCoy and Massey. 5. Other Business Coldiron informed the Board that this was Boardmember Hauck's last meeting due to employment opportunities in California. Coldiron told the Board that Cameron Ryland also resigned. Coldiron has spoken with the City Clerk's office, and the Clerk's office may have an • alternate to serve the Board temporarily.
