A regular meeting of the Building Review Board was held on Thursday September 26, 2002, in
the Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort
Collins, Colorado.

The meeting was called to order by Chairperson Fielder, and roll call was taken.
2. APPROVAL OF MINUTES
Boardmember Jones made a motion to approve the minutes from the August 29, 2002, meeting.
Boardmember Massey seconded the motion. The motion passed.

3. Contractor Appeal — Leonard B. Dickey, License Previously Held B-113,
Case Number 22-02.
Fielder explained the procedures for contractor appeals. Lee provided an introduction to the
appeal. Lee stated Mr. Dickey represented ABR Construction. Lee noted Mr. Dickey has been a
licensed contractor with the City of Fort Collins for a long time. Mr. Dickey elected not to
renew his license in October 2001. Lee asked that W. Dickey give clarification regarding
whether his son was to be included in this appeal. Lee stated there was a previous time when
staff renewed Mr. Dickey's license based on Mr. Dickey's experience and credentials, without
Mr. Dickey having to take an exam. Lee noted Mr. Dickey took an exam several years ago
(when he initially obtained the license), although Mrs files have since been purged. Lee
remarked that the exam taken more than likely covered the 1982 Uniform Building Code.
Leonard Dickey addressed the Board. Dickey stated he obtained a B license approximately
seventeen years ago. Dickey explained he went to work for another company and he did not
want to pay for insurance for his company, so he decided to let his license lapse. Dickey gave a
summary of his previous experience. Dickey stated the reason he wanted his license back now
was for him and his son to be able to do small jobs such as remodels and small additions.
Dickey stated his son does most of the work, and he does the supervising. Dickey stated he
would like to have his old license number back.
Lee clarified that the request is an appeal from taking the contractor exam. Lee asked Dickey if
he was wishing to obtain both the license and the supervisor's certificate. Lee asked Dickey if
his son, John, was going to be taking the exam to become a certificate holder. Dickey stated his
son would like to be a certificate holder, and asked if an exam were required. Lee replied yes.
Dickey asked staff what kind of exam his son would have to take to become a certificate holder.
Dickey stated his son is a college graduate, although he has dyslexia, and may struggle under a
timed test. There was a discussion held regarding when Mr. Dickey took the contractor licensing
exam, and it was noted that Dickey does have the project experience.
Dickey had no closing statements. Lee made his closing statements and stated staff instituted a
different system, so individuals requesting an exam waiver would have to come before the
Building Review Board. Lee noted that it is important that individuals are familiar with the
current code.
Fielder asked Dickey if he has ever taken a refresher course on the code, and how he personally
keeps up with the code changes. Dickey replied that he was a superintendent and a project
manager and would do self -study to keep up with the code changes. Massey asked Dickey what
his last project was in the City of Fort Collins in which he was a project manager or used his
license to pull a building permit. Dickey responded he thought it was the Cinema Saver on
Drake Road in 1994, although he has done a project in Denver since the Cinema Saver project.
Fielder asked Dickey how long ago was the Denver project. Dickey replied he thought it was
about three years ago. Packard asked if Dickey currently held any other licenses in other
jurisdictions. Dickey stated he did not, and noted he retired in December of last year. Massey
asked staff what class of license the Appellant was trying to obtain. Lee replied the Appellant
was asking for a B license. Massey asked Dickey if he has built anything under the 1997 UBC.

• Dickey replied yes, but not in Fort Collins. McCoy asked if the
Appellant had a project that he has been awarded. Appellant Dickey replied no. McCoy made a
motion that the Appellant be required to retest, and stated he would like the Appellant to
maintain the same license number of B-113 once he passes the exam. Massey seconded the
motion. The motion passed.

Jones asked staff if it was possible for Mr. Dickey to test on the local code rather than the whole
code. Lee replied that the test is not separated out from local to non -local.
There was a discussion held regarding why it is important for individuals to take the contractor
exam. Fielder asked Mr. Dickey to expand on his project management duties. Dickey replied
that he was a project manager for Facility Builders and Erectors and also for Lobar. Dickey was
in charge of the superintendents. Dickey would visit jobsites to make sure the job was being
built according to code to get inspections and maintain a timely schedule. Fielder felt Dickey
had more interface with the Building Code than your average superintendent. Massey felt the
opposite from Fielder, and wanted to maintain a fair process. Jones felt the test was not a good
refresher, and that the test was difficult. There was a discussion held regarding the review value
of the contractor licensing exam. McCoy agreed with Jones, although he felt the experience of
preparing for the test was a good review.

Other Business
Lee gave an update on the IRC and stated Chapters 1-2 are completed, and Chapter 3 is almost
finished.
