A special meeting of the Zoning Board of Appeals was held on Thursday, May 24, 1984 at 8:30 A.M. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by the following Boardmembers: Dodder, Johnson, Lieser, Murphy, and Szopinski. Boardmembers Absent: Thede and Walker Staff Members Present: Barnes, Caster, Frazier Appeal No. 1540. Section 118-41(B) by Gil Paben for Frank Johnson, 1130 West Oak - Granted There were no notices returned and two letters received which were read into the record as follows: "May 23, 1984 Mr. Peter Barnes Zoning Administrator City of Fort Collins 300 Laporte Avenue Fort Collins, CO 80524 RE: CAROLINE JOHNSON Dear Mr. Barnes: This is to verify my recommendation that all be done to support Mrs. Johnson's needs for physical therapy. She has suffered from multiple orthopedic difficulties and to date has complied with all requests that she undergo physical therapy. The proposed swimming pool will be a useful and necessary adjunct in 'her treatment program. Swimming is the most beneficial and least orthopedically damaging form of exercise available to Mrs. Johnson. Your consideration in this regard will be appreciated. Sincerely, William Lopez, Jr., M.D." "5/18/84 No exceptions taken proposal. Jack & Frances Miller 1205 W. Oak St." -2- May 24, 1984 We have no problem whatever with this "--- The variance would reduce the required lot area from 9,234 square feet to 7,000 square feet for a single family dwelling in the RL zone. The code requires that the lot area be at least three times the floor area of the building. This building, with a proposed addition, will con- tain 3,078 square feet. --- Hardship pleaded: Due to medical reasons it has been prescribed that the owner get good physical exercise, preferably swimming. In order for her to use the pool year round, it needs to be enclosed. This indoor pool addition will then make the house too big for the lot. The lot is a corner lot in an older part of town where the property line is twenty feet from the curb, so the lot actually looks bigger than it is. --- Staff recommendation: Approval if there are no objections from the neighbors. Zoning Administrator Peter Barnes stated the proposed addition will be located between the garage and the house and will connect the two struc- tures. He stated this will increase the floor area of the building to 3,078 square feet. Mr. Frank Johnson, 1130 West Oak, stated he is the owner of the property. Mr. Johnson explained that his wife is crippled with degenerative arthritis and is starting to lose her eyesight. He explained that the doctor's opinion is to keep her active and exercise regularly, preferably swimming. He noted that the structure enclosing the pool will match the exterior architecture of their home. Mr. Gil Paben, representative from Aspen Construction, presented the plans to the Board. In response to a question by the Board, Mr. Paben stated the pool, the mechanical room, a 3/4 bath area, and the walkway around the pool will consist of 600 square feet. In response to a question by the Board, Zoning Administrator Peter Barnes stated the code does not address medical reasons as a hardship. Mr. Frank Johnson stated the neighbors are very much in favor of the variance. u -3- May 24, 1984 Mr. Jim Vincent, 1202 West Oak, stated he is a neighbor of the Johnsons. He stated he has no objection and added that the pool area would be a nice addition to the neighborhood. Boardmember Dodder made a motion, seconded by Boardmember Szopinski, to grant the variance for the hardship stated. Yeas: Dodder, Johnson, Lieser, Murphy, and Szopinski. Nays: None. The variance was granted 5-0. Adjournment The meeting was adjourned at approximately 8:40 a.m. rman Secretary
