HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 10/11/1984ZONING BOARD OF APPEALS October 11, 1984 Regular Meeting - 8:30 a.m. The regular meeting of the Zoning Board of Appeals was held on Thursday, October 11, 1984 at 8:30 a.m. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by Boardmembers: Thede; Murphy; Lieser; Szopinski and Dodder. Boardmembers Johnson and Walker were not present. Staff Members Present: Barnes, Zeigler, Frazier Minutes of the Regular Meeting of September 13, 1984 were approved The minutes of the regular meeting which was held on September 13, 1984 were unanimously approved. Appeal #1562 was withdrawn. Appeal #1568. Section 118-81(D)(1)(d), 118-81(D)(2)(a), 118-81(D)(2)(b)[6] by Howard Jones for Steele Lumber Co., 2501 Midpoint Dr. - Approved with conditions There were no notices or letters returned. "--- The variance would allow part of a parking lot to not be hard -sur- faced, would reduce the required parking lot setback from 5 feet to 0 feet on the north, south, and west lot lines. The variance would also reduce the amount of required 6% interior landscaping to 0% for the rear portion of a new Army Reserve Center located in the IG zone. The petitioner desires that the Board grant this variance for two years. --- Hardship pleaded: The rear parking lot will be used to park large pieces of equipment such as caterpillar tractors and other large earth movers which will be used quite seldom. If they were sitting on asphalt, they would sink into the asphalt. The parking lot landscape setback can't be provided because landscaping next to the fence would not comply with Army security regulations, same with the interior landscaping. The petitioner will be doing a very good job of land- scaping the front portion of the lot to off -set this. Staff recommendation: Approval." Zoning Administrator Peter Barnes explained that although the landscaping would be eliminated in certain places on the lot, that Mr. Jones would compensate in other areas of the lot with landscaping. Petitioner Howard Jones told the Board that he is a partner in Steele Lumber Co.. Mr. Jones told of the number of steps involved in getting approval of this project with the government. He is hoping that a two year variance would cover the time frame needed in getting the approval from all the differenct government agencies. Boardmember Eve Lieser abstained from voting in this appeal because she was one of the adjacent property owners. Ms. Lieser explained to the Board that she owns the property at 2518 Midpoint Dr.. She asked Mr. Jones if the front setbacks were being met. Zoning Administrator Peter Barnes told her that they were. Ms. Lieser said that she had no objections but did want those questions answered. Boardmember Szopinski made a motion to approved the variance for the stated use only. The motion was seconded by Boardmember Dodder. Yeas: Thede; Murphy; Szopinski; Dodder. Nays: None. Appeal #1569. Section 118-61(D), 118-81(D)(2)(a), 118-81(E)(1) by Joe Vansant, Contractor, 1810 S. College - Approved with condi- tions There were no notices or letters returned. "--- The variance would reduce the required building setback from 20 feet to 15 feet from a zoning district line and reduce the required parking area setback from 5 feet to zero feet along the south lot line, and eliminate the requirement to provide one loading zone for a new office building in the HB zone. --- Hardship pleaded: The petitioner feels that the streetscape will be enhanced if the building is not set 5 additional feet closer to the street, that a loading zone is not needed for an office use of this size, and the design of the building and the width of the lot make it difficult to include the parking setback. These same variances were conditionally granted in December, 1983, but have since expired. --- Staff recommendation: Approval with the condition that the variance to eliminate the loading zone is valid only as long as the property is used for offices." Petitioner Joe Vansant explained to the Board that the delay in construc- tion was due to financing and that nothing had changed since the last variance was granted in December of 1983. -2- J 0 Boardmember Thede made a motion to approve the variance with the condition that the variance to eliminate the loading zone is valid only as long as the property is used for offices, and with the condition that landscaping be installed on the east property. Motion was seconded by Boardmember Murphy. Yeas: Thede; Murphy,; Lieser; Szopinski; Dodder. Nays: None.
