November 20, 1984
Special Meeting - 8:30 a.m.
A special meeting of the Zoning Board of Appeals was held on Tuesday,
November 20, 1984 at 8:30 a.m. in the Council Chambers of the City of Fort
Collins City Hall. Roll call was answered by Boardmembers: Thede; Murphy;
Szopinski. Boardmembers Walker, Johnson, Dodder and Lieser were not
present.

Appeal #1575.
Appeal #1576.
Appeal #1577. Section 118-43(B), 118-43(C) by Bob Black, 1001 Sycamore,
407 Park St., 413 Park St. - Approved
"---The variance would reduce the required lot area from 6000 square feet
to 5750 square feet and reduce the required lot width from 60 feet to
50 feet for a new duplex in the RM zone.
---Hardship pleaded: The lot is an older lot, platted with less lot area
and width than todays code requires. Without a variance, nothing can
be built. The petitioners intent is to develop the units as much
needed low income housing.
---Staff recommendation; Approval. The lot area reduction is not too
great and low-income units are needed in the City._ This duplex would
be part of a 3 duplex project on this vacant land.. (see appeals #1576
and #1577)."
There were no notices or letters returned.
Appeals #1575, 1576, and 1577 were considered at the same time for ease of
discussion purposes.
Zoning Administrator Peter Barnes explained the problem with the November
meeting regarding appeals 91575, 1576, 1577. Engineering assigned the
address 1000 Sycamore to one of the vacant lots. It should have been 1001
Sycamore. On appeal #1577, the notices were typed incorrectly, and stated
that the address of the job was 713 Ponderosa which is actually the peti-
tioners home address. Appeal #1577's job address is 413 Park St. Because
of these errors, new notices were sent out the morning of November 13.
with the corrected information on them.

Petitioner Bob Black informed the Board of his intentions. He said there
are already eight duplexes on the street. He said that basically, the
reason that he is building a two story unit is that he will be able to give
each unit a nice size yard rather than a lot of asphalt.
Royce Clark, owner of the property at 1008 Sycamore, spoke against the
variance. His first question was regarding the way the lot area had been
figured. Zoning Administrator Peter Barnes showed Mr. Clark the plot plans
and varified the figure of 5750 square feet per lot. Mr. Clark was also
concerned about a parking problem occurring. Zoning Administrator Peter
Barnes pointed out the parking spaces that would be available and meet
code. Mr. Clarke felt that his confusion might be cleared up if he could
look at plans for the three duplexes. He told the Board that the notices
that he had received used the addresses of 407 Park St. and 413 Park
St. He had driven by these addresses this morning and at present there
are single family dwelling on the lots given the addresses 407 Park St. and
413 Park St.. He asked if they were going to demolish the present houses.
Zoning Administrator Peter Barnes stated that there must be some confusion
because Engineering had assigned the vacant lots the addresses of 407 Park
St. and 413 Park St.. Mr. Clark reiterated the fact that as of this
morning there are homes addressed 407 Park St. and 413 Park St.
Zoning Administrator Peter Barnes felt it was strange that the people at
these addresses hadn't called to question the variances.
Mr. Clark looked at the plans for the duplexes and said that he no longer
had any objections to the variances after seeing the project. He felt Mr.
Black has a good project and he does not want to delay it.
City Attorney Ken Frzaier felt that there is not a fatal flaw in the
notices. He feels that the City has met the requirements for notifying
property owners adjacent to subject properties.
Boardmember Thede made a motion to approve Appeal #1575 with the stipula-
tion that the correct addresses be inserted. The motion was seconded by
Boardmember Szopinski. Yeas: Szopinski, Murphy, Thede.

The corrected addresses are as follows:
Appeal #1576 - 407 Park St. should read 425 Park St.
Appeal #1577 - 413 Park St. should read 421 Park St.
