Regular Meeting - 8:30 A.M.
Minutes
The regular meeting of the Zoning Board of Appeals was held on Thursday,
January 8, 1987 at 8:30 A.M. in the Council Chambers of the City of Fort
Collins City Hall. Roll call was answered by Boardmembers Lieser, Barnett,
Thede, Lawton, Walker, and Coleman.

The minutes of the December 11, 1986 regular meeting were unanimously
approved.
Appeal #1780 Section 118-97 (D) & (E), by Rudy Maes, 508 S. College
Avenue - Approved with Conditions.
--The variance would allow a barber shop to have a revolving sign.
Specifically, the variance would allow an existing, traditional red,
white and blue barber pole sign to revolve. The barber shop is located
in the BG zone.
---Petitioner's statement of hardship: The revolving barber pole is part
of Americana and shouldn't be prohibited. When the city required the
owner to shut the pole off, some of the customers thought the store was
not open or had closed down.
---Staff recommendation: Approval subject to the following conditions:
1. The pole be attached to the building.
2. The pole can only revolve during business hours.
3. No writing is allowed on the pole.
4. The pole can be used only in connection with the barber shop.
5. The pole can be no larger than the existing pole.

6. The variance is for the specific pole presented to the Board."
No notices were returned. No letters were received.
Zoning Administrator Barnes presented slides and brief discussion of all
three appeals to have revolving barber poles. The Board then reviewed them
separately, beginning with Mr. Maes's appeal for variance at 508 S.
College.
Petitioner Rudy Maes, owner of the barber shop at 508 S. College, stated
that when he turned his barber pole off last year, many regular customers
thought that the shop closed down. He said that presently the pole is lit,
and he leaves the light on after business hours to advertise his business.
He felt that it would be a hardship to conform to the condition that the
pole be turned off after business hours because his pole has only one
switch. The light operates any time the pole revolves. He would have to
have an electrician rewire the pole to conform.
Boardmember Lawton said that he would not be in favor of allowing the pole
to revolve 24 hours a day. The rest of the Board agreed that it would be
best to be consistent in the requirements for all the barber poles in Fort
Collins. Further, Mr. Maes could have the pole rewired to conform to the
Board's requirements.
Boardmember Barnett made a motion to approve the variance for the hardship
stated with the following conditions: 1) the pole be attached to the
building; 2) the pole can only revolve during business hours; 3) no
writing is allowed on the pole; 4) the pole can be used only in connection
with the barber shop; 5) the pole can be no larger than the existing pole;
6) the variance is for the specific pole presented to the Board.
Boardmember Thede seconded the motion. Yeas: Lieser, Barnett, Thede,
Lawton, Walker. Nays: None.
Appeal # 1781 Section 118-97 (D) & (E), by William Young, 179 N. College
Avenue — Approved with Conditions.

Petitioner William Young, owner of the barber shop at 179 N. College, spoke
to the Board. He said that he had no problem with the conditions imposed
by the Board.
Boardmember Barnett made a motion to approve the variance for the hardship
stated with the following conditions: 1) the pole be attached to the
building; 2) the pole can only revolve during business hours; 3) No
writing is allowed on the pole; 4) The pole can be used only in connection
with the barber shop; 5) The pole can be no larger than the existing pole;
6) the variance is for the specific pole presented to the Board.
Boardmember Lieser seconded the motion. Yeas: Lieser, Barnett, Thede,
Lawton, Walker. Nays: None.
Appeal #1782 Section 118-97 (D) & (E), by Max Moyer, 122 N. College
Avenue - Approved with Conditions.

favor of the appeal, stating that he had no problems with the conditions
recommended by the Board.
Boardmember Barnett made a motion to approve the variance for the hardship
stated with the following conditions: 1) the pole be attached to the
building; 2) the pole can only revolve during business hours; 3) no
writing is allowed on the pole; 4) the pole can be used only in connection
with the barber shop; 5) the pole can be no larger than the existing pole:
6) the variance is for other specific pole presented to the Board.
Boardmember Lieser seconded the motion. Yeas: Lieser, Barnett, Thede,
Lawton, Walker. Nays: None.
Appeal #1783: Tabled.
Appeal #1784: Tabled.
Appeal #1785: Withdrawn.
The meeting was adjourned.
