Petitioner: Lucia Liley, for the owners Jerry and Diane Blake

- The variance would allow the building at 111 W. Prospect to be rebuilt to it's original
condition without the building and site having to comply with some of the design standards
and regulations of the Code. The existing foundation will be reused and the building shell
will be reconstructed to its original size. The parking will remain unchanged. This building
was damaged by the flood and an explosion.
Petitioner's statement of hardship: See petitioner's letter
-- Staff comments: It is very unusual for staff to provide a recommendation to the Board
regarding a specific variance request. However, this is an unusual request, with unique
hardships that the Board may often disallow. Staff believes that a recommendation is
warranted in this instance, and that some consideration to the unusual hardships is
appropriate. A comprehensive list of the specific sections that are being requested to be
varied and a staff recommendation for each section will be provided to the Board before the
meeting.

LEGAL NOTICE
The purpose of this letter is to inform you of a request for a modification of the Zoning Code of
the City of Fort Collins.
The procedure for a person requesting a modification of the Zoning Code is to make application
and appear before the Zoning Board of Appeals. This Board has been established to hear
cases, where by reason of exceptional situations or conditions, the strict application of the
regulation would result in peculiar and practical difficulties or exceptional undue hardship upon
the owner of such property, provided that the granting of a variance would not result in a
substantial detriment to the public good.
A variance of Code Section(s) Sections 3.2.2 (D) (3) (d), 3.2.2(E), 3.2.2(J), 3.2.2(M)(1) has been
requested by Owner: Colorado State University Research Foundation Petitioner: CSURF &
CSU for the following described property, 1705 Bay Farm Rd..
The variance would allow a temporary parking lot to be surfaced with compacted gravel instead
of asphalt or concrete; would reduce the amount of required interior parking lot landscaping
islands from 10% to 0%; eliminate the requirements to provide 5' wide landscape buffer
setbacks along the north, south, east & west sides of the lot. The variances are requested in
order to allow the construction of a temporary parking lot (about 130 spaces) to be used by
temporary contract workers of CSU. The workers will be responsible for doing flood damage
repair & cleanup. The lot will be needed for about 6 to 10 months.
This item will appear on the Zoning Board of Appeals agenda as Appeal No. 2210.
As an adjacent property owner, your input would be appropriate in the consideration of the
variance request.
The hearing on this appeal will be held at 8:30 a.m. on Thursday, December 11, 1997, in the
Council Chambers at 300 Laporte Avenue. Those interested may appear at this meeting, or if
unable to attend may submit comments in writing. Meeting sites are generally accessible to

Re: Prospector Shops, 11 West Prospect Road
Rebuilding of Prospector Shops
Dear Zoning Board of Appeals Members:
1 am writing with regard to the rebuilding of the Prospector Shops that are located at I I I West
Prospect Road. Johnson Investments, Inc., and Colorado Outdoor Retail Group, Inc., own
the property that is adjacent to the property owned by Jerald W. Blake. I am not opposed to
Jerald W. Blake receiving variances from the Zoning Board of Appeals in order to be able to
rebuild on the existing structure and continue to have retail/business uses on the site.
I am also writing to inform the Board that we are the owner of the strip of landscaped median
that aligns the east border of the property owned by Jerald W. Blake. For the Board's
information, I have no plans for removing or altering this strip of landscaping at this time.
This area was a part of our required landscaping at the time we remodeling our Building.

Dear Zoning Board of Appeals Members;
I am writing to express my support regarding the rebuilding of the Prospector
Shops that are located at 111 East Prospect Street. I own property that is on the
corner of the same parcel as the property owned by Jerald W. Blake. I am not
opposed to Jerald W. Blake receiving variances from the Zoning Board of
Appeals In order to be able to rebuild on the existing structure and continue to
have retail/business uses on the site.
