The regular meeting of the Zoning Board of Appeals was held on Thurs— day, April 14, 1988 at 8:30 A.M. in the Council Chambers of the City of Fort Collins City Hall. Roll call was answered by Boardmembers Lancaster, Barnett, Lawton and Coleman. Boardmembers Absent: Thede, Nelson and Walker. Staff Present: Barnes and Goode. Minutes of the Regular Meeting of March 10, 1988 — Approved as Published. The minutes of the March 10, 1988 regular meeting were unanimously approved. Appeal #1861. Section 29-203(2) by Signs Byers and Carmen Stuckenschmidt, 239 N. Sherwood — Approved. ---The variance would reduce the required lot width from 60 feet to 50 feet for an existing two—family dwelling in the RH zone (the house is currently on a 105 foot wide lot, along with the house at 237 N. Sher— wood. A proposed lot split would leave this house on a 50 foot wide lot). ---Petitioner's statement of hardship: The owner desires to sell this house and keep the other. It is very difficult to sell a house without a lot, therefore it is necessary to split the lot. Virtually every other lot in the neighborhood is 50 feet or less in width, some as nar— row as 35 feet. This variance would allow the owner to have at least the same size lot as everyone else in the area. All other lot and set— back requirements are met. ---Staff comments: This lot was part of the original plat of the City of Collins, and was platted in 1873. At the time of its platting, all the lots within a five block vicinity of this lot were platted with 105 feet of lot width and 190 feet of lot depth. Evidently, almost all the other lots in this area were divided into smaller lots prior to 1965, the year the City first adopted a minimum lot width requirement. This lot has not been divided as the others have and is one of the few remaining lots still in its original configuration. The petitioner now wants to do what everyone else did before the enactment of the code." No notices were returned; no letters were received. r y ZBA Minutes April 14, 1988 Page 2 Zoning Administrator, Peter Barnes, spoke briefly regarding the variance. He distributed among the Boardmembers copies of the original plat done of this area in 1873. The plat shows that all lots were platted with 105 feet of frontage; exactly the same configuration as still exists on the property in question. Prior to the meeting, Boardmembers also received additional plans that show the proposed property line and a quarter -section map show- ing the surrounding area. Currently most lots in this area are in configu- rations of 50' in width or less. Only one lot, that is located three doors to the south of this one, is still in its original 105' configuration, the rest are single family, duplex, and mostly one-story buildings. As far as the City knows, these lots were split -off prior to 1965, (1965 was when the City Code first required lot width of 60' for residential areas). It is the intention of the petitioners to split this existing lot into two separate parcels and to sell-off the corner house, but it becomes a little difficult to sell a house without land underneath it. It is proposed that the corner parcel, (239 N. Sherwood) will have 50' of lot width and 237 N. Sherwood is to retain 55' of lot width. All other requirements for lot area and setbacks to the existing building are met. Carmen Stuckenschmidt appeared in favor of the variance. The reason this property has not been split before now is because this property has been in original owners family since 1896. The single-family residence at 237 N. Sherwood was built in 1920, followed by the construction of the two-family dwelling at 239 N. Sherwood in 1945. Boardmember Lawton asked the petitioner why the lots were to be split 50/55 rather than 60/45, the petitioner replied that this was to allow for the garage, that belongs to 237 N. Sherwood, to be located 5' from the property line. Boardmember Barnett commented that this is a fairly simple variance, and that the hardship is obvious. A motion was made by Boardmember Barnett to approve the variance for the hardship stated. The motion was seconded by Boardmember Coleman. Yeas: Lancaster, Lawton, Barnett, Coleman. Nays: None. Sher- wood. A proposed lot split would leave this house on a 55 foot wide lot. The new lot line would be between the two houses, all other lot lines would not change"). . Boardmember Lancaster made a motion to approve the variance for the hard— ship stated. Boardmember Coleman seconded the motion. Yeas: Lancaster, Barnett, Lawton and Coleman. Nays: None.
