HomeMy WebLinkAboutBuilding Review Board - Minutes - 11/09/1994BUILDING REVIEW BOARD SPECIAL MEETING 3:30PM - NOVEMBER 9, 1994 CITY COUNCIL CHAMBERS Members present: Cornell Kruel-Froseth Goldrich Meleski Sutton Members absent: Cotterman Hansch Staff Present: Felix Lee Ann Chantler Board chairman Sutton called the meeting to order per request of Mr. Coulson to continue the Appeal to BRB dated October 28, 1994. Mr. Coulson made an opening statement. Mr. Coulson stated he had a conversation with DRS, Nancy Jackson, and concluded that 10% of Larimer County's population has some sort of handicap. He felt there was no rhyme or reason for the local amendment to require a ratio of accessible units. He stated after meeting with the Commission on Disability, he felt their minds were closed to any compromise. Mr. Coulson added that if he could build this project then more units would be available to the disabled community. He stated he did not understand the motion that was made the previous BRB meeting, and thought Felix had the authority to "bend" the code. After meeting with Felix, he then understood that was not an option. He requested a yea or nay vote from the Board so he could move along with this project. Board chairman asked to hear a statement from each board member. Board member Meleski stated until noon today he could not interpret the amendment as it was written. He questioned the way a ratio was established. Building Review Board October 28, 1994 Page 2 Felix responded by stating the ratio would be established by the entire project, total units available, the number that must be accessible, ratio of bedrooms/features in the total project and then determine how many are to be accessible. Mr. Coulson stated he was going to change the plans so that one 6- plex would now be two 3-plexes. Board member Meleski stated he had studied this issue at length and stated his math indicated 12 accessible units, 16 non -accessible units, of those 16 non -accessible units they produced 32 bedrooms, and of the 12 accessible units they produced 14 bedrooms. He stated he felt the handicap people represented at the special COD meeting were "cutting off their nose to spite their face." He added there were a many loopholes in this amendment and this project was good for the community. Board member Goldrich moved to approve this appeal as amended and discussed, is. making two buildings tri-plexes. Board member Meleski seconded the motion. Board chairman Sutton stated he agreed that this was a good project for the community but still believed this Board does have the authority to approve this project. Board member Kruel-Froseth stated she had attended the special meeting with the Commission on Disability also and felt the contractor did not show evidence of compromising with the accessibility issue. She also stated she felt this Board did not have the authority to amend the ordiance and she would vote against this appeal. Board member Cornell stated he too felt not much compromise was offered by the appelant. Bill Coulson stated he could not change the project enough to make it work and could not build this project under the present code He said of the 36 units at Raintree only one is occupied by a disabled individual. A call for the vote: Nayes: Kruel-Froseth, Sutton, Cornell. Yeas: Goldrich, Meleski. The motion falls. The meeting was adjourned.
