A regular meeting of the Zoning Board of Appeals was held on Thursday, June 9, 2005, in the
Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort Collins,
Colorado.

1. ROLL CALL
The meeting was called to order and roll call was taken.
2. APPROVAL OF MINUTES:
Dickson made a motion to approve the minutes from the May 12, 2005 meeting. Miscio seconded
the motion. The motion passed.
3. APPEAL NO. 2514—Tabled.

Petitioner: Tara Berglund

Background:
Petitioner is requesting that an addition representing an enclosed stairwell be located along the east
side property line 2'2" from that property line. The stairs exists presently leading to the basement
and are exterior to the home. The LUC requires a minimum 5' sideyard setback along this property
line. The stairway enclosure will convert this stairway from an exterior accessed stairway that at one
time served as an entry into a basement apartment. The new stairway will be an interior accessed
stairway for this single family home.

The stairs already exist though they will need to be rebuilt. There also exists an interior stairway to
the basement however its location does not permit reasonable access due to its small size. The
present location of the exterior stairs is the best possible route for the new enclosed stairway.

Staff Presentation:
Barnes presented slides relevant to the appeal. This property had at one time been a duplex. Barnes
noted that any time there is building within 3' of the property line that Building Inspection will have
requirements that need to be met.
Applicant Participation:
Tara Berglund, 517 Garfield St, addressed the Board. Berglund shared their design plans for having
interior access to the basement and rationale for enclosing the stairway.
Board Discussion:
Miscio verified with Berglund that the old exterior stairway would be demolished. The new structure

would be approximately 8 x 8' and infringe on the setback on a Tx 8' area.
McBride and Donahue shared concerns with the design and angles of the winding stairs and
whether the proposed plans would even comply with the building code for stairs.
The Board discussed the impact of the setback encroachment concerning the neighbor's space,
light, ventilation and air.
Hall noted that the hardship was self imposed, but the reasons for changing the stairway were valid.
Hall would like to see other options with less than 3' setback encroachment, a better stairway
design, and a letter from the neighbor.
Barnes recommended to Berglund that she should take her plans to the Building Department to
determine if the stairway design complies with the building code.
Dickson made a motion to table Appeal 2514 so that the applicant could verify the code aspects and
buildability of stairs with the possibility of less projection and to get some support in writing from the
neighbor most impacted by the stairs. Miscio seconded the motion.

Barnes stated that the new plans for the main floor and basement would need to be resubmitted to
him by June 30 for the July 14 meeting.
