The minutes of the September 29th meeting were approved as written.
Raju Jairam, Acting Chairman, asked if Mr. Peil had anything to say
regarding the complaint filed by the Wymans.
Richard Peil told the Board he met with the Wymans in July of 1985 and
they wanted some work done at their rental property at 626-1/2 S. Grant.
They were eager to get the work done and Mr. Peil said he did the work
for them. He admitted responsibility for not obtaining a permit.
Felix Lee gave background information. The Building Inspection office
didn't get involved in this case until the summer of 1988 when the office
was called in by the Wymans and Public Service. At this time it was
investigated and it was found that the enclosure adjacent to the water
heater and furnace was not in conformance with the codes primarily
because of clearance from combustibles and access in front of the fur-
nace. The owners were notified they had a problem and needed to correct
it. They were upset due to the fact they had hired a licensed contrac-
tor and thought the work should have been done correctly and legal, with
a permit taken out for the work.
The Wymans contacted Felix Lee and he informed them we had no way of ver-
ifying the work was done by Mr. Peil and they were responsible for making
the corrections. This prompted them to submit said complaint.
Attorney Paul Eckman recommended formal action be taken to accept the
three documents that were mailed to Mr. Peil and all of the boardmembers
into the record. They were: a notarized letter from the Wymans dated
October 10, 1988; a letter from Dan Young dated August 25, 1988 to the
Wymans; and also Mr. Peil's invoice and a statement from Public Service
Co. of Colorado. Boardmember Johnson made a motion to enter the three
pieces of evidence into the record. The motion was seconded by

Boardmember Hartmann. Motion carried.
Boardmember Johnson asked if Mr. Peil admitted to doing the work without
a permit. Mr. Peil said he did the work and there was no discussion with
the homeowner about obtaining a permit. Boardmember Hartmann asked how
much direction Mr. Peil was given by the homeowner. The Wymans told him
what they wanted in the furnace area. Mr. Hartmann asked if the Wymans
gave specifics on what they wanted. Mr. Peil said to some extent they
did, and he never thought to check and see if it met code. Paul Eckman
asked if the Wymans asked Mr. Peil not to obtain a building permit. Mr.
Peil said there was no discussion about a building permit and he tried to
get the job done as quickly as possible so they could get the apartment
rented. He felt it was his fault no permit was taken.
Boardmember Jairam asked what the precedence has been when contractors
did work without a permit. Mr. Lee said in the past, contractors have
been put on a probationary status rather than a suspension.
Boardmember Johnson asked if the Board should suggest a disposition for
the situation beyond status of the license or would the Building Inspec-
tion office rather handle it administratively. Mr. Lee felt it was an
administrative issue our office will undertake to pursue getting the cor-
rections completed.
Acting Chairman Jairam gave the finding of fact as determined by the
Board - Richard Peil is in violation of the building code of the City of
Fort Collins. The work was performed without a permit and the work per-
formed was contrary to acceptable code practices. On that basis, he
asked for a motion.
Boardmember Johnson said as a contractor, he felt doing work without a
permit is not uncommon. The code violations are unfortunate, but the
fact that work is done without a permit is more wide spread than anyone
wants to admit. Mr. Johnson said a six month probation period on the
license would be his recommendation, since no other complaints had been
received on Mr. Peil.
Boardmember Hartmann asked Mr. Peil if he was willing to go back and
repair the work and have it brought up to code. Mr. Peil said he would
have another contractor make the repairs and it would be to code.
Boardmember Cornell proposed a six month probation period be exercised on
Mr. Peil-s license with the understanding the work will be brought up to
code in the interim. Building Inspection staff will monitor the situa-
tion. The motion was seconded by Boardmember Johnson. Motion carried
unanimously.
Attorney Paul Eckman clarified the fact that Mr. Peil can continue his
profession but if other violations occur within the probationary period,
the Board will take further measures.

Debbie told the Board that the November meeting will be on Tuesday, the
29th, which falls after Thanksgiving.
The meeting was adjourned.
