BUILDING REVIEW BOARD

The minutes of the December 28, 1989 meeting were unanimously
approved.
Class C-01 applicant Ron Hill, Signature Builders, was approved to
test for the license/certificate. Board member Cotterman pointed
out the applicant had requested a Class C-02 license/certificate
on his application. Debbie explained the applicant requested a
Class C-01 after the packets had been sent to board members. Board
member Bontz made a motion to approve the license/certificate. The
motion was seconded by Board member Cornell. Motion carried
unanimously.
John W. Burke, The Genesee Company, was approved for a Class D
license/certificate.
Warren Jones with Poudre Fire Authority came before the board and
said he would like to establish procedures for Fire Board of Appeal
hearings. He wanted input relative to having an attorney present,
a staff report presented at hearing time, and/or should the Board
prepare the guidelines or would they rather have legal staff
prepare them.
John Duval with the city attorney's office spoke and asked if the
Board was uncertain about what kind of decisions they can make.
He passed out copies of Sec. 2.303. Board of Appeals and Sec. 9-
3. Appeals. He explained the board is a quasi-judicial body that
doesn't have to follow court procedures. He asked for suggestions
from the Board in adopting guidelines for the Building Review Board
and the Fire Board of Appeals.
Chairman Ron Baker thought it was a good idea to have guidelines
and thought they should be kept simple. They would help keep some
form of order and the chairman would have a check list to follow.

Paul Eckman represents the Building Review Board. Board member
Harry Cornell asked that the attorneys work with each other so that
the guidelines are the same for both Boards. Mr. Duval said he
would like to include cross examination rights, and evidence
procedures and keep it more procedural instead of substance. All
board members agreed a member of the city attorney's office should
be present at any appeal.
Board member Cotterman asked if Poudre Plastics complied with the
board's ruling. Warren Jones said they had.
Board member Bontz wanted Poudre Fire Authority to know there was
no need to apologize for the way the appeal was handled. He felt
their presentation was good and concise. He also thought Chairman
Ron Baker conducted an excellent hearing.
Felix Lee suggested a breakfast at 8:00 a.m. on February 22nd to
look at the procedures and guidelines proposed by the attorney's
office and said he would rewrite the BRB Bylaws for review and
discussion at that time also.
The meeting was adjourned.
