ZONING BOARD OF APPEALS
September 11, 1986
Regular Meeting - 8:30 A.M.
Minutes
The regular meeting of the Zoning Board of Appeals was held
March 14, 1985 at 8:30 A.M. in the Council Chambers of the
Collins City Hall. Roll call was answered by Boardmembers
Lieser, and Barnett.

The minutes of the August 14, 1986 regular meeting were unanimously
approved.
The Board voted to hear Appeal #1761 last because the petitioner was not
yet at the meeting.
Appeal #1762 Section 118-91, 118-95 (A), by Linda Sanden, 2737 S. Shields
- Approved with Conditions.
"---The variance would allow a nonconforming veterinary clinic in the RLP
zone to have a 32 square foot per face groundsign. The variance would
also reduce the required setback from 15 feet to 0 feet for a
groundsign without free air space and which is located within 50 feet
of a driveway.
---Petitioner's statement of hardship: The code has no provisions for
signs for this type of use since this use is not a permitted use in the
RLP zone. Therefore, without a variance there can be no sign for a
veterinary clinic. The property was recently annexed into the City and
the present sign is actually in the right-of-way. The new sign will be
setback approximately 45 feet from the street, so the intent of the
code is met and there will be no traffic visibility hazard.
---Staff recommendation: Approval with the condition that if and when
Shields Street is widened in front of this property that the sign
either be brought into conformance, or a new variance be required."
No notices were returned. One letter was received.
Zoning Administrator Barnes reviewed the appeal stating that the Mountain
Veterinary Clinic was recently annexed into the city and was classified as
a nonconforming use. The current sign is in the right-of-way, and the

owner was proposing to build a new sign four feet behind the fence, on the
property line.
Jim Sanden, owner, spoke in favor of the appeal, stating that he planned to
build a 4' x 8' wooden sign with plastic lettering. He would locate it out
of the right-of-way, but he could not elevate it more than one foot because
existing trees would block its visibility from the street.
Boardmember Barnett stated that he had no problem with the current
proposal, but if Shields Street was widened there could be some site
distance problems. Mr. Barnett thought that the variance should be granted
with the condition that it be reviewed in the event that Sheilds Street was
widened.
No one spoke in opposition to the variance.
Boardmember Leis asked if the size of the sign would be an issue when the
variance was reconsidered at a later date. Mr. Barnes replied that it
would not be an issue.
Boardmember Barnett made a motion to approve the variance with the
conditions that the sign be constructed as outlined for the Board, and that
the variance be reviewed in the event that Shields Street is widened.
Boardmember Leis seconded the motion. Yeas: Leis, Thede, Lieser, Barnett.
Nays: None.
The appellant was not present for Appeal #1761, but the Board decided to
begin discussion on the variance so that those attending the meeting would
have a chance to speak.
Appeal #1761 Section 118-43 (B), 118-43 (C), by Tony Stoddard, 320 N.
Loomis - Tabled.
"---The variance would reduce the required lot area from 6000 square feet
to 4900 square feet and the lot width from 60 feet to 35 feet for a new
duplex in the RM zone.
---Petitioner's statement of hardship: This lot is in the old part of
town and the previous structure burned down. The petitioner wishes to
build a new duplex on the lot which will meet all required setbacks.
Nothing can be built without a variance.
---Staff recommendation: None. This lot has some history that may be
helpful to the Board. On August 13, 1981, the Board considered a
similar variance for this property and the lots on either side. The
petitioner wanted to put duplexes on all three lots and the Board felt
that three duplexes in a row on small lots was too much for the
neighborhood. They consequently granted variances for only single
family dwellings. This decision was appealed to City Council and was
upheld. Consequently, single family dwellings were built on the

adjacent lots. Nothing was built on this lot and the variance expired
and the original petitioner sought another variance for a single family
dwelling on December 8, 1983. This variance was granted. On September
12, 1984 the original petitioner came back to the Board to ask for a
variance once again to allow a duplex on the lot. This time the
variance was approved. Nothing was ever built on the lot, so now a
different petitioner is asking for a duplex variance.
Two notices were returned. No letters were received.
Robert J. Klann, of 322 N. Sherwood, stated that he was not against having
a new single family home in the neighborhood, but he was concerned with
traffic and parking in the neighborhood. He stated that homes in his
neighborhood were often rented to students, and they tended to have a lot
of vehicles and to park them in the alley, blocking access to his drive.
Mr. Klann stated that he would be opposed to duplex or a very large home
(4-5 bedroom) being built on the site.
Dora Gallegos, 748 Rocky Mountain Way, stated that parking was a problem in
the neighborhood, and although she was not opposed to the variance, she was
concerned about the traffic generated by a duplex.
The Board decided to table the appeal until the October meeting so that the
appellant would have the opportunity to speak.
Other Business
The Board decided to table the election of officers until the October
meeting.

Zoning Board of Appeals
To the Board:
We anticipate losing our old sign to the
widening of South Shields Street and it is currently
in dire need of repair. Given those circustances
we think it is best to now relocate and replace
the old sign to a site approximately 30 feet west
of its current location, onto our property and about
2 to 4 feet west of the sidewalk.
The sign that we propose will be constructed of
wood with the lettering cut out and backed with a
white plastic (white letters against a plain wood
background).
