HomeMy WebLinkAboutPersonnel Board - Minutes - 12/15/2004PERSONNEL BOARD MINUTES December 15, 2004 8:30 AM 215 North Mason Training Room Council Liaison: Ray Martinez, Mayor Staff Liaison: Rick DeLaCastro, Human Resources Director Board Chair: Valerie Remington Board Members Present: James Alderden; James Lyall; Valerie Remington, Chair; Peter Shostak; Sid Simonson City Staff Present: Rick DeLaCastro, Human Resources Director Janet Miller, Assistant Human Resources Director Greg Tempel, Assistant City Attorney Joan Busch, Admin Support Supervisor (Recorder) Others Present: Kurt Feldt; Ted Svitaysky; Sunita Sharma, Assistant City Attorney for the City of Greeley. Call to Order Chair Valerie Remington called the meeting to order at 8:35 a.m. The Chair confirmed that a quorum was present. Employee Appeal Hearing Valerie Remington asked if either party wished the hearing to be closed. Greg Tempel, Assistant City Attorney said that the City would like a closed hearing. He stated that under Section D of the Board's Personnel Board Hearing Procedures the hearing can be held in executive session by two-thirds vote of the quorum present. Also the Board can follow the same procedures applicable to City Council as found in City Code Section 2. Ted Svitavksy, counsel for the employee stated they were not requesting a closed hearing. Peter Shostak moved that the Board go into Executive Session as authorized by City Code Section 2-31 (a) (1) and (2), for the purpose of considering a personnel matter regarding the dismissal of and appeal hearing requested by a City employee, and for the purpose of meeting with the Board's legal advisor to receive legal advice regarding the manner in which particular policies, practices, or regulations of the City may be affected by existing law. James Lyall seconded. After brief discussion, a roll call vote was taken as follows: James Alderden, no; James Lyall, yes; Valerie Remington, no; Peter Shostak, yes; Sid Simonson, yes. As two-thirds vote is required, motion failed 2-3. Hearing began with testimony from the City's witnesses. Hearing continued until 9:20 p.m. Personnel Board Minutes December 15, 2004 Page 2 of 2 III.
