FOOT COLLINS PLANNING AND ZONING BOARD
June 9, 1959
The special meeting of the Planning and Zoning Board was called to order by
the
Chairman, Edward W. 'Withrow, at 7:40 P.K. Members present were James C. %eese,
Dr.
Hobert K. Lee, Robert Ocheltree, Boy A. Portner and Edward W. Withrow. Mayor
Jack A. Harvey entered the meeting later. Members absent: G. H. Palmas.

The petition to rezone Block 92 to eDp commercial, tabled from last seek,
was read and discussed at length. These. in attendance at the meeting wares
R. S. Hauer and G. R. Baker of 330 West Oak; James H. Andrews, James D.
Hartman and Carl A. ismilton, owners of property in Block 92, It was moved by
Dr. Lee and seconded br Nr. Keene that it be recommended to the -City Council
that.Block 92 be removed from the 00" residential zoneandplaced in the "De
commercial some. Upon the affirmative rote of all members present the Ohairsan
declared the notion passed.

was moved by Nr. Ocholtres that.this matter be hows&t back to the floor for
dissuosioa. The motion was seconded by Air. Yeesso Upon the affirmative vote of
all members precast the Chairman declared the =ties passed. Air. lexnsoth Gross,
representing Bdiwa A. Nillor owner.of the property, raised the question of ear.
offisio members having the right to vote. .The Chairman stated that Arthur Narchs
City Attorney., bad ruled that ex..officio members do have the right to vote. Air.
Gross then stated he would reserve his objections to the above raling.This
natter was discussed thoroughly by the Board. Dr. Lee saved that this natter be
tabled, The motion was seconded by iir. Pbrtuer. Upon the affirmative vote of
all sombers present the Chairmaa declared the action passed.
Hearing The OWLUmm called for the Hearing on Millsap Subdivision.

This matter was disonssed at length by the Board. It was moved by Mr, Partner
and seconded by Mr. Harvey that thAe1. final plat of Ni]lsap Subdivision, a portion
Of the NNJ of the Wd of Section 242 Township # North, Range 69 hest of the 6th
P.M., City of Fort Cellins, County of Larimer, State of Colorado, be approved
subject to the.owsors and/or subdividers of the property entering into a written
agreement with the City of Fort Collins that the public improvements, utilities
and facilities accessary for the development of the area being subdivided will
be installed is accordance with the standard specifications of the City, and the
plat be submitted to the City Council with the resadatioa t it be approved
subject to the foregoing condition. The Chairman declared thetion passed
upon Ube affirmative vote of all members present.

adjourned
be adjourned. The Chairman declared the notion passed upon the affirmative
vote of all members present.
