Members Present: Don Stuart, Chuck Rhoades, Chuck Bowling, Marcile Wood, Tom Coffey, City Manager, Lynn Anduss, Don Reynolds, Planning Director, Bob Engelke, Assistant Planning Director, and Art March, Jr. City Attorney. Nominations for Lynn Anduss: Nominated Chuck Rhoades. Vice Chairman: Tom Coffey: Moved nominations be closed - seconded. All Ayes. Item #1 Approve minutes for meetings of June 4, 1968 and June 12, 1968. Item #2 #30-68 Consider Rezoning Petition involving approximately 2.2 acres from R-L, Low Density Residential to R-M, Medium Density Residential. Don Reynolds: Presented, described and gave history. • Garth Rodgers: Attorney for petitioners. A. Presented past objections and treatment under present proposal. 1. Traffic. 2. Apartments in R-L area. B. Presented plan. 1. Traffic to Elizabeth. 2. Ample parking. 3. 2 1/2 stories - 24 apartments in each unit (48). 4. No access other than to Elizabeth. 5. Changes in area (Zoning). 6. National forecast for apartment needs. 7. Buffer of R-L. Don Stuart: Questions? Mrs. Wood: Zoning to the north? Answer; R-L north and west, B-P northeast. Lynn Anduss: Number of units? Answer: 24 each - 48 total. Opposition: Burt Masterson: (Montview) 1. Not acceptable before and not acceptable now. 2. Property owners to north (2 or 3) not representative. 3. Traffic on Elizabeth and area is bad for children. 4. 110 feet - not good lot. 5. Property owners, etc. are opposed. • Don Stuart: Others opposed? Keith Miller: 1013 Hiilcrest. Congestion on Elizabeth, curb cut question. Jack Hall: (Montview) Surprised at new request. Church was to be on this site. PLANNING & ZONING - NWES Page 2 • September 3, 1968 W. S. Hinckel: Questioned assurance for balance of property • as R-L. Garth Rodgers: 1. Traffic only to Elizabeth. 2. Don't want a curb cut in R-L. 3. We will make any agreement necessary. 4. Again no access from R-L. S. No damage to values. Don Stuart: Comments? Mrs. Wood: Questioned one way aspect of the plan. Don Stuart: Questions? Chuck Rhoades: Difficult tract abutting shopping center and Elizabeth Street. R-L area provides protection. Moved approval. Tom Coffey: Seconded the motion. All Ayes. Item #3 #35-68 Consider resolution of the Zoning Board of Appeals recommending Council consider amending the Zoning Ordinance to permit retail shops to be placed in apartment houses erected in R-H, High Density Residential Districts. Bob Engelke: Presented the history with Art March, Jr. giving details (discussion). Tom Coffey: Suggested we consider each case as an individual item. Don Reynolds: Few cases - not warranted at this time. • Perhaps a new zone will be necessary. Mrs. Wood: Moved there be no change at this time. Lynn Anduss: Seconded the motion. All Ayes. Item #4 #36-68A and #36-68B (Considered together) Consider Rezoning Petition (County Referral) involving 20 acres from F-A, Farming District, to "M" Multiple Family District. Consider Rezoning Petition involving 1.4 acres from R-L, Low Density Residential to R-P, Planned Residential. Don Reynolds: Presented and explained county zoning involved. James Beatty: Attorney for petitioners 1. Described area and zoning request. 2. Approximately 21 acres total and asked that both petitions be considered together. 3. Multiple units, 11 per acre - 12% of area in units - 4,000 square feet per unit - 3 parking spaces per unit, 22% as parking, 54% open area. Don Stuart: Questions? Lynn Anduss: Annexation to City? Answer: Not yet. Mrs. Wood: R-P type plans? Answer: Yes Don Stuart: Maximum allowable? Answer: No limit, read ordinance. • Chuck Bowling: How much is low land? Answer: Between the ditch banks. Chuck Bowling: Plans for access? James Beatty: 24 foot streets and collector street (constitution) Chuck Bowling: Front 200 feet? Should be reserved for single family area. 4. Over all zoning problems in area. 5. Plan for Progress. 6. Need for multiple family not necessary for Fort Collins. Don Stuart: Others - comments? Harold Dean: Estates Area. 1. Opposed to dense housing. 2. Chain reaction zoning. 3. Concern for total area. Steve Paranka: 1. More than adequate area for apartments. 2. Plan for Progress. 3. Discussed zoning. Sanford Thayer: Opposed - lack of transition from "E" to "M" zone. Mrs. Norman Evans: 232 units on high land - 4 people per unit, opposed density. Mrs. Herbert Riehl: SW Fort Collins Home Owners Association. Petition in opposition (230+ signatures) James Beatty: Presented plan. 1. With F-A a hog farm would be possible. 2. "M" is the only zone possible in County. 3. Not High Density as shown on the Plan for Progress, but a "Semi -low Density". Dr. Thayer: Open space all inside - no buffer for area. James Beatty: Not High Density (Motion on item #4) Mrs. Wood: Must consider zone unfavorably. Lynn Anduss: Seconded the motion. All Ayes. Motion on Item #5 Lynn Anduss: Moved denial. Mrs. Wood: Seconded the motion. All Ayes. Item #5 #37-68 Consider petition to vacate Cheyenne Drive west of Stover Street. Don Reynolds: Presented and described. Gary Haxton: Question of stub street from Bush Court. Don Reynolds: Explained. Tom Coffey: Moved the item be tabled. Charles Rhoades: Seconded the motion. All Ayes. Item #6 #38-68 Consider Rezoning Petition (County Referral) involving approximately 1 acre from "R", Residential to "T" Tourist District. Don Reynolds: Presented and described. Dave Wood: Attorney for petitioner. 1. County zoning. 2. Area 3. Tract not good for present zoning. 4. Site not presently satisfactory as is now. 5. Related "T" Tourist to B-L zone. Dave Wood: One under "T" Tourist. Don Stuart: Opposed? Susan Furness: Petitions of those opposed - 238 signatures 1. No need shown. 2. No control. 3. No protection. 4. Non -conforming use. Ralph Hanson: Prospect. 1. In area since 1957. 2. No need shown. 3. Spot zoning. 4. "Gas station size". 5. Character of area. Tom Sutherland: No gas station please. Dave Wood: No comment. Lynn Anduss: Moved disapproval of item. Chuck Rhoades: Seconded the motion. All Ayes. Item #7 #39-68 Consider amendment to Zoning Ordinance which would permit the application of the Unit Development concept to all Residential Zones. Don Reynolds: Presented. Mrs. Wood: What type of problems (legal)? Don Reynolds: Control. Art March, Jr.: No more legal problems than with R-P to B-P. Not the same as contract zoning. Lynn Anduss: Move recommendation of concept. Mrs. Wood: Seconded the motion. All Ayes. Item #8 Don Stuart: Excused - Chuck Rhoades assumed the chair. #40-68 Consider petition to vacate Remington Street between Spring Park Drive and Dartmouth Avenue. Don Reynolds: Presented and located. Art March, Jr.: Stated that Gene Fischer, Attorney for the petitioners was not present. Don Reynolds: Apartments planned for Dartmouth Trail. Mrs. Wood: Apartment dwellers access. Tom Coffey: No objections from apartment builder. Charles Rhoades: Opposed? None Lynn Anduss: Recommendation from the planner. Don Reynolds: Higher density development - suggest waiting at this time. Mrs. Wood: Recommended denial at this time. Lynn Anduss: Seconded the motion. • All Ayes. Bob Engelke: Presented and Art March, Jr. amplified. Chuck Bowling: We will now have funds for park lands. Art March, Jr.: Yes, and more flexible. Bob Engelke: Six percent and $40 per acre approximately equal. Chuck Bowling: Moved recommendation. Lynn Anduss: Seconded the motion. All Ayes. Item #10 #42-68 Consider Foothills Apartments Subdivision Plat involving one lot with R-P, Planned Residential Zoning - 104 units. . Bob Engelke: Presented, located and gave background. Recommended approval subject to Colorado State University dedication, easements, drainage plans, and utility plans and agreement. So Moved and Seconded. All Ayes.
