CITY OF FORT COLLINS, COLORADO
April 2, 1968
Call to Order: Chairman Don Stuart called the meeting to order on April 2,
1968 at 7:30 p.m.
Members Present: Ken Pastor, Charles Rhoades, Don Stuart, Marcile Wood,
Tom Bennett, Tom Coffey, City Manager, Art March, Jr. City
Attorney, Bob Engelke, Assistant City Planner, and Gene
Allen, City Planner.
Item #1 Minutes for meeting of March S, 1968 were read and approved.
Item #2 #22-68 Consider Community Development Plan (Preliminary
Master Plan) for Lexington Green Subdivision involving
212 lots with R-L, Low Density Residential Zoning.
#23-68 Consider plat of Lexington Green Subdivision Second
Filing involving 26 lots with R-L, Low Density Residential
Zoning.
Bob Engelke: Presented the areas and asked for comments or
questions. Located tentative park development to the east.
Don Stuart: No motion is necessary on this plan. (Accepted).
Bob Engelke: This is a second filing. He located church
site and described the area.
• Mr. Jones: We didn't know if it would take formal action
on a Preliminary Plan.
Don Stuart: A Preliminary is accepted with no motion.
Art March: Questioned the width of the utility easements,
which should appear on the plat.
Ken Pastor: Moved recommendation to City Council for approval,
with corrections showing easements.
Charles Rhoades: Seconded the motion.
All Ayes.
Item #3 #21-68 Consider Fuqua - Arbogast Subdivision consisting of
15 lots with R-L, Low Density Residential Zoning.
Bob Engelke: Presented subdivision. Consideration of a
Final Plat and there seems to be no particular problems.
Charles Rhoades: Questioned the dedication of Lake Street.
Bob Engelke: Mr. Miller dedicated the street on the Elliott -
Miller Subdivision Fifth Filing, but it is not dedicated to
the west.
Charles Rhoades: Moved acceptance of the plat subject to
correct identification of Lake Street.
Marcile Wood: Seconded the motion.
All Ayes.
Item #4 #20-68 Consider Elliott - Miller Subdivision Eighth Filing
involving 10 lots with R-L, Low Density Residential Zoning
and 2 lots with R-M, Medium Density Residential Zoning.
Bob Engelke: Gave presentation on consideration of the Final
Plat, consisting of 10 lots with R-L, (Single Family Dwellings)
and 2 lots with R-M (one, two or multiple family dwellings).

half streets. Stated that Mr. Miller will proceed with
• curb, gutter and sidewalk. Rather than accept a 12 foot
dedication the City should ask for additional dedication
of 28 feet to the City. This would require the property
owners to the south to dedicate their half.
Tom Bennett: Why ask for the reserve?
Bob Engelke: To insure the other half of the street.
Would like approximately 2 foot reserve dedicated to the
City to be held in escrow, as Mr. Miller does own additional
feet.
Tom Coffey: Who owns the land south of that?
Bob Engelke: There are several people.
Don Stuart: Have they indicated they will cooperate?
Bob Engelke: Yes, most of them have.
Marcile Wood: By dedicating they would be assured of having
a street.
Ken Pastor: Is Mr. Miller agreeable?
Bob Engelke: Yes, he is.
Gene Allen: Not all people are ready to dedicate at the
same time, but should be eventually.
Don Stuart: No rezoning is required on this.
Charles Rhoades: Moved subdivision be accepted with
dedication as recommended.
Tom Coffey: Seconded the motion.
All Ayes.
• Item #5 #19-68 Consider Rezoning Petition involving 0.12 acres from
R-H, High Density Residential to B-L, Limited Business.
Bob Engelke: Presented the item and explained that a request
Tor variance before the Zoning Board of Appeals is what
brought this rezoning about. Was illegal in the way it was
being proposed under the Zoning Ordinance. Rezoning of B-L,
would apply specifically to the shops. Described the area
as a peninsula of R-H, in a B-G area. Felt is would be
a desirable change.
Don Stuart: Could you describe this area in specific
dimensions?
Bob Engelke: The one area is 76 feet by 32 feet and the
other one is 25 feet by 116 feet. These two areas fall
within the proposed shop areas.
Don Stuart: How much of the total floor area does this cover?
Bob Engelke: It covers 1/4 at the most, and is located within
the arcade on the east wall back about 8 feet. We propose
to put a 10—foot height limitation on this.
Gene Allen: Height limitation would be noted and a change
in the ordinance may be required but we do not feel so at
this time.
Don Stuart: We would have to recommend to City Council as
per the legal description.
Gene Allen: Yes.
Art March: I think legally this can be done. A parking
problem is not involved here.
Bill Vigor: Designed for apartments and could not be easily
used for offices or anything else, for that matter. There
are at least 170 parking spaces as well as parking behind the
lot.
Marcile Wood: How many apartments are there?

Bill Vigor: There are 105 apartments. We will provide
• whatever the City requires as far as parking, but do not
feel there will be any problem.
Tom Bennett: What does the suggestion of air space mean
to you?
Gene Allen: Apartments are not permitted in a B-L zone.
Mrs. Parking is definitely a problem. I have to
park in the alley and so do any people who come to see me.
I have to park in the alley now, so why do we need shops
here? They can go downtown to shop.
Dr. Walker: My patients often have to park a block away,
but I have no objections to the apartment building.
Marcile Wood: High rise was built before the zoning regula-
tions were put into effect.
Bob Engelke: We aren't affecting possible parking problems
by any means.
Don Stuart: Are there any other comments?
Tom Coffey: If we were to go into three dimentional zoning
on this, could we change to another district?
Art March: R-B would do basically what this is talking about.
Tom Coffey: What would be the objection to going to a R-B
zoning?
Art March: Would be more logical as far as I am concerned.
R-B would allow apartments and business uses both with no
problems.
Gene Allen: Personel service shops is the only difference
in R-B and R-H.
• Bob Engelke: Stated that Mr. Vigor would go along with any
proposal the board could come up with which would meet his
desires.
Tom Coffey: If we had R-B you could limit businesses more.
Tom Bennett: Does anyone feel that R-B should be looked
into?
Gene Allen: I prefer B-L since it is adjacent to a B-G
zone at the present time. We have enough different categories
in our Zoning Ordinance to take care of Fort Collins at present.
Ken Pastor: I suggest that the Planning Office investigate
further and study the R-B zoning.
Gene Allen: The proposed zoning is in compliance with the
Zoning Ordinance.
Ken Pastor: Moved to recommend approval with a height
limitation of 12 feet.
Marcile Wood: Seconded the motion.
All Ayes.
Item #6 #15-68 Consider proposed industrial development for North
College Industrial Corporation involving 3 lots with I-L,
Light Industrial Zoning.
Bob Engelke: Gave the presentation of the Preliminary Plat.
Explained a minor problem in providing a 30 foot set back
which was corrected by curving the property line.
Ken Pastor: Is there a problem with Fire Code?
• Bob Engelke: Fire Code problem has been resolved, our main
concern is to get the property line 30 feet from the building.
Don Stuart: No motion is necessary on this item.

Item #7 #14-68 Consider Rezoning Petition involving 3.1 acres from
• R-L, Low Density Residential to R-M, Medium Density Residen-
tial and 2 acres from R-L, Low Density Residential to R-P,
Planned Residential.
Bob Engelke: Presented the area to be rezoned and asked for
questions?
Charles Rhoades: Asked to be excused during discussion of
this petition.
Don Stuart: Called for proponents to present their case..
Bill Wyatt: Originally the petition was heard by the Planning
and Zoning Board and recommended the area be rezoned to R-P.
City Council then referred it back to the Board for an
amendment to be filed where as four acres were deleted which
is now the R-L area which will be left as is. This petition
is for 3.1 acres rezoned to R-M, 2 acres to R-P and the
balance left as R-L.
Orm Sherwood: Spoke on trends and the need of apartments
in Fort Collins. Presented the number of homes expected
to be established in the United States in the future, and
number of house holds established for multiple family
housing. Presented excerpts from the Denver Post on zonings
recommended for apartments, and showing the trend toward
multiple family housing. Spoke from the Economic Base Study
on the number of apartments, need for more apartments, and
average of units built. Presented a map showing present
zoning in the area, and what is now proposed. The rezoning
• request would result in 5 acres of R-M, 2 acres of R-P, and
4 acres of R-L. The number of units in R-M would be 100,
24 units in R-P, and 16 units in R-L. The R-M zone would be
used as garden type apartments and R-P as townhouses. In the
use of the R-M area 56% will be open area, 23% for building
utilization, and 21% for parking. I feel the breakdown is
good and we are creating buffers between each area. We have
changed our concept in terms of density, height, and building
design.
Bill Wyatt: This particular zoning is not to try to single
out a specific area, but merely an extension of the present
R-M zoning against our area which is involved. Area is well
buffered by the park to the south. This park is created by
tax dollars for maximum use by our citizens. This park
located to high density development will give maximum return
from our tax dollars.
Edwin Miller's letter to the Planning and Zoning Board was
then read in which he stated he had no objections.
Morris Bristol: Was asked by Mr. Miller not to put a trailer
court in this area several years ago, however, Mr. Briston
was in favor of the petition in question at this time.
Paul Hollsinger: In favor as it will improve the neighborhood.
Doyle Kincaid: Concerned with the growth of Fort Collins,
completely in favor.
Melton Johnston: Stated he saw no objection to the previous
• presentation and definitely seens no objection to rezoning
as it is now proposed. Density has also been reduced.
Don Stuart: Called for a ten minute recess.
Don Stuart: Called meeting back to order and asked to hear
from the opponents.

John Kochenberger: According to the Zoning Ordinance it
states "no request is granted a rehearing unless new evidence
is submitted." I feel that the rules of the board have not
been complied with.
Jim Duney: 1909 Busch Court -Opposed to zoning, and stated
he looked for a home in the area where zoning would not be
entered into. He would not have bought here had he known
area would be rezoned.
Dr. Egan: 1913 Busch Court - Was aware of zoning and inquired
about it in the area, which was R-L and was to remain as such.
Commented on several statements made by Orm Sherwood and
Bill Wyatt. There are many children playing in Spring Park
and the increase in automobiles created by the zoning would
prove to be hazardous. Very much opposed to zoning.
Ralph Kotich: Opposed to zoning, as he desires more open
space.
Dean Duncan: 220 Stuart - A school teacher who is opposed to
zoning for the following reasons:
1. There is a need for open space for recreational purposes.
2. Community property which should not in any way belong to
a realtor.
3. No exit in the planning to the south.
4. Could be a fire hazard if the firetruck had to travel
down Stuart Street.
5. Traffic would be a definite problem.
6. Realtors are out for money rather than a concern for
what they can do for the citizens of Fort Collins.
Mr. Doriety: 224 Stuart - Opposed to zoning.
Gene Allen: Was asked to point out various areas around
Spring Creek. He stated what they were zoned previous to
the adoption of the Zoning Ordinance in 1965. In 1965 we
did not have an official Plan for Progress as we now know
it.
John Kochenberger: Gave evidence of various petitions
previously presented for rezoning in this area which were
denied.
Jerry Warren: 308 Dartmouth - Opposed to zoning due to the
site. Felt it was not a good site.
Harold Guy: Apartments should be built with concentration
on the campus and student housing.
John Wright: 1900 Busch Court - Also opposed.
Mrs. Dean Duncan: High apartments should be located else-
where besides the center of the City.
Bob Walters: 424 Stuart - Opposed.
John Kochenberger: Those opposed were asked to stand - show
of approximately 42 people. Nine times the City has denied
this area rezoning, and it remained as Low Density. Asked
the board to the deny the present rezoning petition.
Bill Wyatt: Stated there was exact compliance with the zoning
regulations, and they did not fail to do so as Mr. Kochenberger
had stated. The many times the petitions were turned down, it
was not for this specific area, but to areas around it.
Actually, eleven changes have taken place in this area since
the adoption of the Zoning Ordinance in 1965.
Don Stuart: Called on Mr. Allen for comments.
Gene Allen: Stated that 4,000 to 5,000 people could be expected
to be served by a neighborhood park. College Avenue and the

railroad serve as travel barriers. Based on the Guide for
• Growth we have been able to develop and obtain good park
sites. Substantial amendments to the petition and has been
treated as a new hearing. It actually was never withdrawn.
Densities are less than under the recommendation of the
Planning and Zoning Board. I feel the access in and out of
the property is good. I do not feel the park is used to its
full capacity at this time. The area is well served by
schools and in walking distance of the property in question.
A city either grows or declines; they do not stay in a specific
state indefinitely.
John Kochenberger: Questioned Gene on previous zoning which
was changed in 1965 by the Zoning Ordinance.
Dr. Egan: Asked Gene to review the zoning changes from 1965
To present.
Gene Allen: One annexation from FA (County request to R-M).
Total park area is 16 acres.
Tom Coffey: I don't see how the land in question could ever
develop into park land. Edora Park will take pressure off
Spring Creek Park. With the price being asked for this land,
it would be difficult for the City to obtain it for park land.
Don Stuart: Called for a motion.
Ken Pastor: Moved that the proposal be recommended as presented.
Marcile Wood: Seconded the motion.
Ken Pastor: Called for vote on motion.
All Ayes Vote five to zero, Charles Rhoades abstained from
• voting.
Item #8 #13-68 Consider ways and means of processing rezoning request.
Bob Engelke: Read Section 21.1 plus the proposed addition.
We are attempting to amend the Ordinance, not the By -Laws.
We merely want to give the By -Laws greater strength.
Art March: Could the Planning and Zoning Board make a
recommendation to City Council for requests taken to Council?
Tom Coffey: Any amendments the proponents might desire to
make should be done before the nine days.
Mr. Michel: Need for the rules.
Don Stuart: Item was tabled for further consideration.
