Members Present: Chairman Don Stuart, Lynn Anduss, Charles Rhoades, Ken Pastor, Assistant Planning Director, Bob Engelke, Planning Director, Gene Allen, and City Manager, Tom Coffey. Item #1 #62-67 Consider rezoning petition involving .825 acres from R-L, Low Density Residential Zoning to B-G, General Business Zoning. Gene Allen: Gave location and described. Attorney Wilmarth: Presented case for "C" zone or "B-G" Zone. Ken Pastor: "What is proposed?" Attorney Wilmarth: More than one use, "I don't know." Don Stuart: "Would R-H suffice?" Attorney Wilmarth: "No." Ken Pastor: Is a gas station proposed? Attorney Wilmarth: I don't know. Lynn Anduss: Would B-L work? Attorney Wilmarth: Possibly but "C" would work better. Lynn Anduss: Moved recommendation of B-L. Chuck Rhoades: Seconded the motion. Ken Pastor: Question of B-L sprall to West along Elizabeth. Attorney Wilmarth: B-L is okay, requested to ammend petition. Vote: All Ayes except Ken Pastor opposed. Item #2 #1-68 Consider Rezoning Petition involving 47.5 acres +- from R-L, Low Density residential to M-M, Medium Density Mobile Home District and involving 33 acres +- from R-L, Low Density Residential to R-M, Medium Density Residential Zoning. Gene Allen: Presented, located, described, and gave history. Mr. More: 1. Have revised plan to remove objections. 2. Need of students for economical housing. 3. Spoke of buffers and profit. 4. We intend to cooperate with the City. 5. Foothills Apartments proved need, we will finish work in the spring. 6. Letter from Mr. Krest (Director of Housing.) a. Need for low cost housing. b. Plan to phase out trailer courts. 7. Asked students on facility and location. a. (Had petition but kept it) b. Can't hurt values as there are no houses nearby. 10. Sight lines from Sheeley Drive impossible to see mobile homes. 11. Presented plan, showed proposed park area, utilities underground, foliage around each unit. 12. Referred to Hoffman Court on Mulberry. Introduced Jim Eagan, student at Colorado State University. Jim Eagan: Conducted study 1. Phase out of C.S.U. lots - (89) 2. Other courts in City can't meet new standards. 3. Mobile Homes are here to stay. 4. Proximity to campus. 5. World War II and Viet Nam vets needs. T. M. Southerland: Property owner to north presented opposition petition. Opposed because: 1. No need shown. 2. Rezoning would prejudice future development of area. 3. Would depreciate values. 4. Not in accord with Plan for Progress. T. M. Southerland: Also stated: 1. Held a meeting and all were opposed. He described Foothills Apartments as a mistake which should not be expanded. • 2. School Board anticipates Low Density development. 3. Property tax issue. 4. Character of area. 5. Expect the worst, and we got it so far. 6. Plenty of R-H around the campus. 7. A development of this type would affect a large area not just 250 feet. Herman I Sight line question. Mr. Smith: No notice, no position, and apartments would be in sight. Mr. Miller: Don't like proposed. Phil Carrol: Continuous rezoning is unfair repeated efforts. Suggested an administrative rule requiring 6 or 12 months for a zoning change request. Jake Kauer: C.S.U.'s responsibility to provide housing. Questioned position of C.S.U. Planner Dan Cruse: Question of enrollment projections. Answer: 20,000 in spite of 15,000 limit. Mr. Steel: Plan for Progress and timing on rezoning. Gene Allen: Comments on frequency of rezoning request. 1. The same request must have a letter giving reasons. 2. This specific request is not the same as last time. 3. This problem is being worked on and recommendations will be made. Don Stuart; How would this be done? • Gene Allen: As a change to the Zoning Ordinance. Don More: We have shown need. Don Stuart: Moved to disapprove petition. Lynn Anduss: Seconded PLANNING AND ZONS - MINUTES Page 3 Oruary 6, 1968 Don Stuart and Lynn Anduss: Voted for the motion. Ken Pastor: Abstained. Charles Rhoades and Tom Coffey: Did not vote and were counted in favor of the motion. Motion passed. Item #3 #3-68 Consider annexation petition involving 2.084 acres with R-L, Low Density Residential Zoning. To be known as the Pierce Second Annexation. Gene Allen: Presented and located. Recommended approval. Lynn Anduss: So moved. Seconded: All Ayes. Item #4 #4-68 Consider Preliminary Plat of the Tenth Green Subdivision involving 12.9 acres with R-L, Low Density Residential Zoning - 53 lots. Gene Allen: Presented. Gave background on east line and discussed 50' street problem. Suggested an easement would solve the problem. Recommended approval. Accepted. Item #5 #5-68 Consider Annexation Petition involving 4.244 acres with B-L, Limited Business Zoning and C, Commercial Zoning. Gene Allen: Presented. Discussed Mason Street and spur track problem. Recommended approval with right- of-way reservation for Mason. Tom Coffey: So moved. Charles Rhoades: Seconded. All Ayes. Item #6 #6-68 Consider South Meadow Lark Heights Subdivision Plat, Second Filing involving 55.145 acres with R-L, Low Density Residential Zoning - 134 lots, 1 church site, and 1 school site. Gene Allen: Presented. Raised question of drainage 50' streets and street names. Charles Rhoades: Moved subject to recommendations. Seconded: All Ayes. Item #7 #7-68 Consider Elliott - Miller Subdivision Seventh Filing involving 2.1 acres with R-L, Low Density Residential Zoning - 10 lots. Gene Allen: Presented and recommended approval. Lynn Anduss: So moved. Seconded: All Ayes. Item #8 #8-68 Consider Revised Master Plan of Parkwood Sub- division involving 33.4 acres with R-P, Planned • Residential Zoning, 145 living units, and 1 church site, involving 28.57 acres with R--L, Low Density Residential Zoning - 97 lots. Item #9 #9-68 Consider Plat of Thunderbird Estates Fifth Subdivision involving 44 lots with R-L, Low Density Residential Zoning. Gene Allen: Presented and pointed out 50' right-of- way problem. Jim Stuart: Explained vacation of Mathews Street. Tom Coffey: Moved approval and noted Stuart Street vacation. Seconded: All Ayes. Item #10 #10-68 Consider Proposed Subdivision of land of Ottie B. Fuqua involving 8 lots with R-L, Low Density Residential Zoning. Gene Allen: Presented. He mentioned development problems of Arbogast land to the west. Mr. Fuqua: Stated he had tried to work with Arbogast but couldn't. Gene Allen: Requested to talk to Arbogast to see if it could be worked out. Accepted as per Gene Allen's recommendation. • Item #11 #11-68 Consider Preliminary Plat of Beckstead Trust Subdivision involving 41.21 acres with R-L, Low Density Residential zoning - 120 lots and one park site. Gene Allen: Presented. Mr. Wenke: (Attorney for Beckstead Trust) Sewer for Colorado wtate University and county road requirements created need to plan subdivision. Jim Stuart: Discussed sewer and time element. Gene Allen: Requested it be given to planning department to coordinate. Approved Gene Allen's request. Item #12 #12-68 Consider Annexation Petition of Paul Ehrlich involving 0.211 acres with R-L, Low Density Residential Zoning.- 1 Gene Allen: Presented and discussed three alternatives. 1. Accept as is. 2. Require total tract. 3. Force annexation. Gene Allen: Requested time to discuss the matter with Mr. Ehrlich. So Moved: Tabled until meeting of February 20, 1968.
