PLANNING AND ZONING BOARD

#48-67 Consider rezoning petition involving 53.696 acres
from R-L, Low Density Residential and R-M, Medium Density
Residential to R-H, High Density Residential and 48.607
from R-L, Low Density Residential to M-M, Medium Density
Residential to B-G, General Business.
Gene Allen gave presentation
Gene Fischer described history of area, stated the tract
was the "Old Gilsdorf Farm" and originally was to be
zoned "C" Residential. He said he, and his partners
made the annexation, "Fourth College" possible. They
agreed to zone east of the ditch"C", and expected to
rezone the balance as needed. The Commercial zoning
requested would be necessary to serve the large area.
He commented on the proximity of the "Sheeley-Sub" and
stated he thought this was no problem, the hill and ditch
would provide a topographic barrier. He discussed the
need of the University for housing. They presently
planned to add about 104 units as per existing develo-
ments. He felt the zoning would have little effect
upon area property values. He made a strong request
for R-H, and stated if the R-H, was granted, then the
B-G, would be necessary.
Don Stuart "What are your plans for the next year or two?"
Gene Fischer "Our plans are to add 100 units and to put
75 or 80 Mobile Homes on hill, no plans for western end.
The 50 acres to the north of CSU are too expensive for
residential development, it will be commercial.
Lynn Anduss Plans for B-G?
Gene Fischer Not yet, could be a gas station or stores,
etc. The reason the street is not completed is "Flat-
iron" recommended they wait until next spring due to
water problems.
Donald More Interested in good planning, plans must
change your plan for growth, must be able to change.
We passed out a booklet on "Development Planning".
Shields and 80' collector require area to go R-H. The
project of Drake Company is not moving as we are. The
Mobile Homes would be buffered by location on hill and
R-H, development. He stated Planning and Zoning had
approved Foothills parking which backed up 80' collector.
Admitted present development is a little rough.
Don Stuart "How does your plan resemble the plan in the
booklet?"
Donald More "It does to the business and R-H."
H. D. McGraw "Our trailers would be for rental use."

Don Stuart "Opposition?"
Bill Galyardt presented a petition with 146 signatures
opposed to the zoning.
1. It would constitute spot zoning.
2. There is no need for futher commercial type zoning
in this area.
3. There is already a General Business and High Density
area at the intersection of Drake and Shields.
4. It would depreciate the value of the homes no loc-
ated in this area.
5. It would create additional traffic hazards to a
primary residential area.
Don Cruse refered to Drake zoning and statement of Council.
Phil Carroll Bad example of Rapid City, we seem to be
heading in the same direction. Referred to gas stations
especially opposed to B-G.
Don Anderson If this zoning goes, then we will ask for
rezoning; not a commercial area. State Board not ad-
vised until yesterday.
T. M. Southerland asked people to stand who were opposed
to zoning - - most stood. Objected to frequent rezoning,
recommended following "Plan For Progress."
Don Stuart Can we go ahead?
Gene Fischer Profit is not a dirty word, and referred
to agreement with City for R-H.
Gene Allen - Comments:
1. No agreement for "C" zoning
2. Referred to booklet
A. "Site planning involves consideration of the
site in relation to the physical pattern and
economic growth trends of the larger area of which
it is a part."
B. "Rental housing for more attractive appearance,
is now built of lower densities and with more
emphasis on open space; 15-25 families per acre
coverages of 15 to 25 percent are standard.
C. B-G, should be located at the edge, preferably
as arterial traffic junctions, approximately
one mile from existing neighborhood shopping
centers.
D. "Access" (in reference to dedication of streets
north of development)
3. General characteristics of land predicate use.
4. The Planning and Zoning Board did not approve parking
on plan for Foothills Apartments.
5. Referred to "Plan for Progress"
6. 1965 zoning took into consideration for needs of R-H,
area.
7. History is not as important as future.
8. Stated plans can be accomplished as presently zoned
as far as housing units are concerned. Recommended
against rezoning.

Ken Pastor "What do you think is appropriate for area?"
Gene Allen "Generally as is; lower land is less sutiable
for single families, higher land is suitable for low den-
sity development.
Mrs. Steele "Is there a limit to the number of times we
must fight the rezonings?"
Arthur March Jr. "We can't limit the rezonings at this
time."
Ten Minute Recess
Tom Coffey moved that not sufficient need shown for any
rezoning.
Charles Rhoads 2nd - Vote - all ayes, Ken Pastor abstain-
ing.
Item # 2 #49-67 Consider rezoning petition involving 2.053 acres
from R-H, High Density Residential to B-P, Planned Bus-
iness.
#53-67 Consider Lemay Medical Park Unit Development
plan with B-P, Planned Business Zoning on 2.053 acres.
Considered together
Gene Allen gave presentation.
Gerry Haxton testified as to parking, stated plat would
determine size of office.
#49-67 Tom Coffey recommended approval, Tom Bennett 2nd.
All ayes.
#53-67 Tom Coffey recommended approval, Tom Bennett 2nd
All ayes. Lynn Anduss abstaining.
Item # 3 #52-67 Consider West Elizabeth Foothills Unit Develop-
ment Plan with B-P, Planned Business Zoning on 2.055
acres.
Russel Moore gave presentation for preliminary approval.
Alvin Miller proposed approval subject t o working with
Planning Office.

completed plans at a later date.)
Item # 4 #37-67 Consider Unit Development Plan Fahrenbruch,
Leisure Village, Third Filing with R-P, Planned Resident-
ial Zoning - 150 living units, 12.67 acres.
Gene Allen gave presentation.
Jack Fahrenburch gave background of present development
plan.
Lynn Anduss "What happened to the Pitch $ Put?"
Jack Fahrenbruch need doesn't seem to be developing.
Tom Coffey Pin down the care facility and club house
etc., we have a debt to the area.
Don Stuart concerned over loss of original concept.
Tom Coffey moved to table - 2nd - all ayes.

Item No. 5 #54-67 Consider plat of the Prospect Estates Third Sub-
division with R-L, Zoning. Thirty-one lots.
Robert Engelke gave presentation. Problems of preliminary
plat had been resolved. According to Phil Robinson,
streets as shown on preliminary plat have been dedicated
to County.
Lynn Anduss moved for approval - 2nd - all ayes.
Item No. 6 #55-67 Consider preliminary plat of Fairview "West"
Sixth Filing with R-L, Low Density Residential Zoning
44 lots.
Robert Engelke gave presentation, pointed out problem of
50' right-of-way on cul-de-saes and possible problems
of reverse corner lot.
Approved subject to resolving problem of reverse corner
lot. All ayes.
