Estate Trish Dennis, Wally Cameron Guests CSU Student John Barnett Lon Jacobs Agenda review Rearrange order of land deals to move the Jacobs item to first on the agenda Land Conservation Update & Proposed Land Deals Jacob Conservation Easement — Trish Dennis This conservation easement will allow a five acre or less building envelope for the existing house and pole bam This property is adjacent to the Cathy Fromme Prairie • Stokes We d like to close on this by the end of the year Mark likes this project as a precedent for other 35 acre lots It was in our long range plan We feel like we owe a debt of gratitude to the Jacobs for kicking things off in the right way • Staychock You mentioned fencing around the 5 acre envelope Is there any reason we really need the fencmg9 • Dennis To contain the building envelope and any future animals • Staychock My first thoughts are maybe it s not necessary • Ohlson We want to make sure fences don't interfere with wildlife or aesthetic values Natural Resources Advisory Board November 19, 2003 Page 2 of 5 • Barnett We don't see a need to fence now, we ve no objection to not fencing The only considerations are making the boundaries easier to find, and we want to preserve the right for a future land owner • Ohlson On page 3 it's talking about lighting Typically lighting is brighter than we want I don't have a problem with pest control, but we need to remember the importance of fallen or dead trees We should improve the wording in future agreements, and work on a phrase that encourages some fallen or standing dead trees to remain • Ohlson This refers to prairie dogs and other pests The City of Fort Collins shouldn t be calling prairie dogs pests • Donovan I'm in favor of a home business activity clause but the allowable trips per day seems to exceed the City definition • Stokes The County has a good definition of home occupation which is slightly narrower than the City's We can be stricter than the County, but we cant be less stnct Maybe this doesn t belong in the easement • Ohlson Is there a legal reason why integrated pest management cant be in the easement9 Stokes I prefer to leave it in the management plan Easements are not good management tools You can find your self in the position of having easements that wont let you do things you d like to do The primary purpose of the conservation easement is to sterilize the development rights • Dennis The stewardship plan is evaluated every five years That language can be amended • Ohlson So timber harvesting probably shouldn't be in the easement • Stokes It should be referenced in the easement, but then go to the management plan to see how you manage the timber • Ohlson We should vote on this and send a vote of support that we appreciate and encourage this I d suggest a nice plaque or certificate for appreciation • Ohlson They City easements are much better than the County easements Nate Donovan made the following motion Move that the Natural Resources Advisory Board recommend to Council approval of the conservation easement, and the right of first refusal The motion was seconded by Kelly Ohlson and passed unammously Webber and Bee Conservation Easement and IGA with Larimer County — Trish Dennis This project would be in cooperation with Lanmer County The County has been working on these easements for a long time, about two years CSU is involved and will end up owning the underlying fee interest and the City and County will jointly have rights to the conservation easement Ohlson My suggestion is City staff work with County staff better so that we're not reacting to their language, which is half as good as the City's I would encourage City Natural Resources Advisory Board • November 19, 2003 Page 3 of 5 staff to work with the County They re not on the same level, the fencing and trail issues are different We have a right to negotiate with them over it • Stokes I agree with what you ve said Part of the reason we re behind the curve getting you this is the County had a partner bail on them They came and said, we re 95% of the way there would you contribute • Ohlson Most people wont object We re not suggesting radical changes If we could just raise the bar on some of these things • Stokes Itjust walked in the door a week ago • Donovan On page 2 it says that Lanmer County shall not be liable for P parties That's a curious sentence I d be careful of accepting sentences like that With CSU involved it could get messy • Ohlson One of my favorites is where it talks about constructing a trail in the above described stream restoration arca9 Nate Donovan made the following motion Move that the Natural Resources Advisory Board recommend Council approve the IGA concerning the Webber and Bee conservation easements The motion was seconded by Ryan Staychock • Staychock I also have concern about the sentence that Nate referenced about Lanmer County not being liable for acts of 3rd parties • Stokes That may be something we can work on • Ohlson If we could attached a memo mentioning some items staff could work on, just a few bullets, I'd vote for hit We need to send a message to the County that we had some concerns IPM and impacts of fences on wildlife • Fischer That might be a good solution I in a little uncomfortable with the wording in this easement The motion passed with 5 votes in favor and one member (Clint Skutchan) abstaining Stockover Land Exchange Trash Dennis This land is where the Stanley Steamer building is located This is a proposed land exchange with the City of Fort Collins The City would retain easement for access to Kingfisher Point Natural Area Fischer I'm curious about the flood plain regulations The County doesn t acknowledge the product corridor, but they do acknowledge the 100 year flood plain This would preclude future development but the question is what the current owner could do Sears It's taken us years to get the adjoining property owners to clean up that area Ohlson This seems to be a logical, reasonable and appropriate action to take It seems to make sense for the program and builds good will But, its my job to make sure the City and citizens get a fair deal Natural Resources Advisory Board • November 19, 2003 Page 4 of 5 • Dennis We feel this is a great benefit to the City Kelly Ohlson made the following motion Move that the Natural Resources Advisory Board recommend to Council the approval of the Stockover land exchange The motion was seconded by Arvind Panjabi • Ohlson I would like to thank Mr Stockover I would also encourage him to work on using native plantings and to apply for a City grant The motion passed unanimously Pulliam Lease Wally Cameron The seller has agreed to sell the Charitable Trust tracts over three years, with a lease and option to purchase the remaining tracks The property is being purchased based on its appraised value The subleases need Council approval At closing we hope to lease to an existing tenant and continue the farming/ranching/grazing lease for a two year period pending the final management plan that the natural areas program will be working on Fischer It looks pretty clear cut but I want to make sure I understand The only things the rancher can do is raise hay and graze cattle9 Cameron That s correct • Ohlson One minor thing, in the memo from Wally and Mark it references passive recreational purposes The word we're using now is "appropriate", not passive We ve almost universally replaced "passive with "appropriate" Nate Donovan made the following motion Move that the Natural Resources Advisory Board recommend Council approval of the sublease agreements to the existing tenant of the residence and the cattle company The motion was seconded by Ryan Staychock and passed unanimously John Stokes thanked Trish Dennis and Wally Cameron for working on these projects Every deal is complicated and its hard to bring any transaction to fruition It's great to have them on board, and we appreciate all of their hard work NR.AB 2004 Work Plan • Ohllon We should momtor this quarterly It would take 10-15 minutes • Skutchan Maybe we should change RTA to ` MPO • Nate Donovan suggested a few typographical edits Kelly Ohlson made the following motion Move that we approve the Natural Resources Advisory Board 2004 Work Plan with the above mentioned changes
