The meeting was called to order at 6:35 p.m. by Chairperson Colton.
Roll Call: Meyer, Carpenter, Craig, Davidson, Gavaldon and Colton.
Staff Present: Blanchard, Eckman, Fuchs, Bracke, Wray, Jackson and Macklin.
Agenda Review: Director of Current Planning Blanchard reviewed the Consent and
Discussion Agendas:
1. Minutes of the December 18, 1997, January 15, 1998 and
March 4, 1999 Planning and Zoning Board Hearings
(Continued).
2. #54-98 Johnson/Harmony Annexation & Zoning
Discussion:
3. Recommendation to City Council for an Amendment to the
Master Street Plan.
4. Recommendation to City Council and Larimer County Planning
Commission for an Amendment to the Fossil Creek Reservoir
Area Plan.
Member Craig pulled Consent Item #2 for discussion. There was no more consent
agenda.
Project: Recommendation to City Council for an Amendment
to the Master Street Plan and;
Recommendation to City Council and the Larimer
County Planning Commission for an Amendment to
the Fossil Creek Reservoir Area Plan.
Project Description: Adoption of an Amendment to the Master Street Plan
and Fossil Creek Reservoir Area Plan relating to
street classification and alignment changes within the
southeast area of Fort Collins.

Staff Recommendation: Staff recommends the adoption of an Amendment to
the Master Street Plan and to both City Council and
the Larimer County Planning Commission to adopt
the Amendment to the Fossil Creek Reservoir Area
Plan relating to street classification and alignment
changes within the southeast area of Fort Collins.
Mark Jackson, Transportation Planner gave the staff presentation.
Mr. Jackson addressed the concerns the Board had with Amendment #2, the
realignment and reclassification of a two lane street section between the intersection of
Trilby and Timberline Road, and County Road 36. The original east -west connection
will be changed from a connector to a collector street with the new alignment.
Mr. Jackson reported that per the Planning and Zoning Board and the Transportation
Boards wishes, the alignment of Cambridge Ave. has been adjusted slightly west to
match with the Trilby/County Road 36 connection.
Public Input
None
Member Craig asked how close reference #4 on the map would be to the waterway to
the north and would there be more traffic on the road with the realignment.
Pete Wray, City Planner replied that there would be the same amount of traffic on the
road but the on street driveway access is being limited. The road would be two-lane
with bike lanes, and that staff supports the idea of having an east -west connection in
that area. He felt this alignment was more appropriate than the one proposed a year
ago.
Member Craig also had a concern with #9.
Eric Bracke, Transportation Planner responded that when the Celestica Overall
Development Plan came in, there was a connection that was provided from Harmony
Technology Parkway over to Cambridge Avenue, which was a couple hundred feet
south of Harmony. Mr. Bracke stated that Cambridge was not shown on the Overall
Development, but it has always been assumed that Cambridge would continue to the
south. Mr. Bracke explained that staff was working with Celestica, Hewlett Packard and

the property owners to move Cambridge Road to the west to help provide a buffer for
those residences that are along Cambridge.
Member Craig stated that at the time of the Overall Development Plan for Celestica,
she stated that this connection was an issue. She stated that a former member
considered the alternative compliance that the Board was giving a concession. She
also looked up the neighborhood meeting minutes and it was presented to the
neighborhood that there would not be a connection. She felt that this has been
misrepresented.
Mr. Bracke stated that Celestica did not need that access point to make their project
work. Most of the traffic will be headed to the north and west. Properties to the south
definitely need a collector system to get back to Harmony Road and Cambridge was
always intended to do that.
Member Craig asked about the connection currently being constructed, Technology
Parkway and the configuration of the roads being changed. She asked what drove the
decision to change the configuration.
• Mr. Bracke replied that staff was doing a more detailed analysis and getting more
information of how this area would function.
Member Craig felt that if Cambridge Avenue was such an important link, that the Master
Street Plan of 1996 should have shown the road going through; and when the Overall
Development Plan for Celestica was done, it should of shown the road going through.
There should have been accesses shown on the plan instead of asking for an
alternative compliance.
Member Craig felt the neighbors have been misrepresented for at least two years with
the understanding that Cambridge Avenue would not be going through as a collector
road.
Member Carpenter asked if this change had any neighborhood input.
Planner Wray replied that notifications were sent to two of the main areas. The
Huntington Hills area on item 1 and the property owners adjacent to the remainder of
the changes. He stated that the notices included meetings with the Transportation
Board and the Planning and Zoning Board. Mr. Wray also has met individually with
landowners in the area. Planner Wray stated that he had not received any negative
. feedback on any of the changes proposed.

Member Davidson was concerned that the notices did not give the impression to
property owners of the increase in traffic due to the proposed changes, which he felt
was a misrepresentation by the City.
Member Gavaldon moved to recommend to City Council approval of the following
amendments to the Master Street Plan, Item 2, 3, 4, 5, 8 and 10. Member
Carpenter seconded the motion. The motion was approved 6-0.
Member Gavaldon moved to recommend to City Council approval of amendment
7 to the Master Street Plan. Member Carpenter seconded the motion. The motion
was approved 6-0.
Member Craig commented that she would not be able support amendments 6 and 9
because she felt they were misrepresented based on her previous comments made.
Eric Hutchinson, homeowner at 4700 Cambridge stated that they have lived in their
house for one year and that he has not had very much input from anyone. He stated
that the information he has received was from Mr. Kaplan and Mr. Shepard. He stated
that he would like to see some of the charts, graphs, roads and have someone talk to
him.
Member Craig asked if staff could work with Mr. Hutchinson and his neighbors. She
asked that staff hold a mini neighborhood meeting to inform the neighbors and get their
input. She felt she could be more comfortable with what the city was doing if the
neighbors would have some input.
Mr. Jackson replied that staff could work with the neighbors.
Member Craig moved to continue amendments 6 and 9 to the June 3, 1999
Planning and Zoning Board hearing. Member Davidson seconded the motion.
The motion was approved 6-0.
Member Craig moved to recommend approval to City Council on the following
amendments to the Fossil Creek Area Plan, 11, 12,13 and 14. Member Gavaldon
seconded the motion. The motion was approved 6-0.
Member Craig moved to continue amendments 15 and 16 of the Fossil Creek Area
Plan revisions until the June 3, 1999 Planning and Zoning Board hearing.
Member Gavaldon seconded the motion. The motion was approved 6-0.

Project: Johnson/Harmony Annexation & Zoning, #54-98
Project Description: Voluntary request to annex approximately 63.26
acres; located south of East Harmony Road and east
of Cambridge Avenue. The recommended zoning is
the Harmony Corridor District (HC) and is located
within the Harmony Corridor Plan.
Staff Recommendation: Staff recommends approval of the annexation and
recommends that the property be placed in the
Harmony Corridor District, HC.
Hearing Testimony, Written Comments and Other Evidence:
Ron Fuchs, City Planner gave a brief presentation.
Member Craig was concerned that the annexation would create an enclave for the 5
• surrounding property owners.
Planner Fuchs stated that notices were sent to the 5 owners and staff had not received
any comments from any of the 5 property owners.
Planner Fuchs clarified that this annexation does create an enclave and in 3 years and
1 day of the approval of this annexation the city could annex those properties if they so
choose.
Member Craig asked the applicant if he had spoke to the property owners that would be
affected by this annexation.
Les Kaplan, applicant replied that he did not hold a neighborhood meeting and it was
hard for him to represent what they do and don't understand. He stated that if the land
owners were annexed they would become non -conforming uses and would be able to
continue to use their properties as they are now.
Mr. Kaplan spoke about Cambridge Avenue and that the connection has been shown
on the Harmony Corridor Plan for years. The property owners were noted when the
Corridor Plan was in the works, first initially, then for the update. He stated that it has
been about 7 years where Cambridge Avenue has been shown as a street that would
be extended. The connection is also shown on the Fossil Creek Area Plan and
numerous other public documents. Mr. Kaplan did not think that the existence of

Cambridge Avenue going by their houses is a piece of information that this annexation
is introducing, it is something that has been public knowledge for quite some time. Mr.
Kaplan asked for it to be clear for the record that this annexation is not a prelude to
forcibly annex anyone, and it is not negating the fact that there would be future public
hearings if the Board would decide to exercise the tool of forced annexation in the
future.
Member Craig asked that this annexation be continued until the property owners have
been notified appropriately. She felt that it was a big impact for these property owners
and that each of the 4 owners should be called individually.
Member Davidson commented that most annexations do not include enclaves, and
most people do not know what one is or what the repercussions are. He felt that the
property owners should know what the repercussions of an enclave are, so they can be
given the choice to show up and be concerned about this annexation.
Chairperson Colton asked Planner Fuchs to review what notification was given.
Planner Fuchs replied that the respective parties received a written notice of the
annexation. Staff did not contact the parties in person.
Member Davidson asked if the parties were notified that it was an enclave annexation.
Planner Fuchs replied no.
Deputy City Attorney Eckman added that a written notification was more than the State
requires for an annexation, it only requires a notice by publication.
Member Carpenter was concerned with this and the previous project that the Board is
setting a precedent to call every citizen when something is going to affect their property.
She felt it was incumbent upon citizens to know what is going on. There has been no
indication that any of the citizens that received written notice are concerned about this
annexation and do not want it.
Public Input
None.
Member Carpenter suggested that the Board forward a recommendation to City Council
tonight and in between this hearing and the Council hearing have staff contact the
property owners to make sure they understand what is going on with this annexation.

Member Gavaldon moved to recommend to City Council approval of the Johnson
Harmony Annexation, #4-99.
Member Carpenter seconded the motion.
Chairperson Colton felt that the proper notification was given per the City Code. If the
Board wants to address enclave annexations as a separate issue, then it should be
addressed as a policy item. He suggested that Planner Fuchs contact the property
owners to make sure they know about the enclave annexation.
Member Davidson would not support this annexation because he felt the property
owners should understand the situation and felt the notification should have included
the information. He also suggested that an attempt by staff be made to notify the
property owners to make sure they know what an enclave annexation is before it goes
to Council.
Member Craig suggested that the Board take the issue on as a policy item on their
agenda. She suggested sending a letter to Council voicing the Board's concerns for
future enclaves that the notification is more detailed and gives more information on
enclave annexations.
The motion was approved 5-1 with Member Davidson voting in the negative.
Member Gavaldon moved to recommend to City Council approval of the
requested zoning of HC, Harmony Corridor for the Johnson Harmony Annexation,
#4-99.
Member Carpenter seconded the motion.
The motion was approved 5-1 with Member Davidson voting in the negative.
Member Gavaldon updated the Board on the Mason Street Corridor meeting and
upcoming open houses.
The meeting was adjourned at 8:35 p.m.
