Jim Broderick, Staff Liaison Public: Sheila Snyder, Complainant, Daniel Luciano, Greg With Call to Order: The meeting was called to order at 6:03 p.m. by Subcommittee Chairwoman Richardson Case No. 2003-16: Subcommittee Chairwoman Richardson advised that, pursuant to the provisions of Sections 2-138 et seq. of the Code of the City of Fort Collins, the Citizen Review Board Subcommittee would undertake a review of an internal investigation conducted by the Office of Police Services, Case No. 2003-16, relating to alleged events of police officer actions in violation of administrative policy or applicable law. Subcommittee Chairwoman Richardson requested that all parties wishing to address the Subcommittee be identified and advise the Subcommittee of the form of materials to be presented and the time required for such presentation. Ms. Snyder identified herself and advised the Subcommittee that she would make a verbal presentation and that Mr. Luciano would present testimony and materials on her behalf. Subcommittee Chairwoman Richardson advised that the parties' presentations would be limited to ten (10) minutes each, unless such time was extended by the Subcommittee. Ms. Snyder advised the Subcommittee that Mr. Luciano would commence the initial presentation to the Subcommittee. Mr. Luciano identified himself as a private investigator and indicated that his mother was the owner of the residence wherein the incident had taken place on January 7, 2003. Mr. Luciano indicated that he had participated in certain events that took place during the incident and that he had been requested by Ms. Snyder to look into the matter further on her behalf. Mr. Luciano began his presentation with a historical review of Ms. Snyder's domestic relationship with her former spouse and the matter of child custody orders which were the subject of the alleged violation of policy, General Directive B-3 "Civil Cases", commonly referred to as a "civil standby." Mr. Luciano presented various materials to the Subcommittee for review relating to the custody orders which were the subject of the request for the civil standby. Ms. Snyder provided elaboration on the materials presented by Mr. Luciano and responded to questions by various Subcommittee members. Citizen Review Board Subcommittee Meeting Minutes Wednesday, December 17, 2003 Council Information Center City Hall West Page 2 Executive Session: At 6:35 p.m. Subcommittee Chairwoman Richardson offered the following motion: "As authorized by City Code section 2-71 (d)(2) and 2-31(a)(2), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number 2003-16 conducted by Police Services, and for the purpose of meeting with the City Attorney to receive legal advice regarding the manner in which the Subcommittee's actions may be affected by existing law." Subcommittee Member Evans seconded the motion. There was no discussion and the motion carried 3-0. Prior to adjourning into executive session, Subcommittee Chairwoman Richardson advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the Subcommittee while in executive session. Regular Session: At 7:12 p.m. Subcommittee Vice Chairwoman Martinez moved to adjourn from executive session. Subcommittee Member Evans seconded the motion. There was no discussion and the motion carried 3-0. At 7:14 p.m. Subcommittee Member Evans moved that the Subcommittee review of the internal investigation, case number 2003-16, prepared by the Office of Police Services be continued to the next regular meeting date or a date to be determined by the availability of the City Attorney for the purpose of securing legal advice. Subcommittee Vice Chairwoman Martinez seconded the motion. There was no discussion and the motion carried 3-0. Subcommittee Chairwoman Richardson advised the Complainant that she would be notified by mail and telephone of the continued date and time. Adjourn: At 7:22 p.m. Subcommittee Vice Chairwoman Martinez moved to adjourn. Subcommittee Chairwoman Richardson seconded the motion. There was no discussion and the motion carried 3-0.
