Call to Order
Chair Valerie Remington called the meeting to order at 11:58 a.m.
Approval of Minutes
Peter Shostak moved to approve the May 18, 2004 meeting minutes. Sidney Simonson
seconded. Motion passed unanimously (5-0).
III. Performance Management System
Wynette Cerciello Assistant Human Resources Director reported that since John
Fischbach, City Manager has resigned, this program is starting over. Tomorrow there
will be a meeting with the Executive Lead Team (ELT) to discuss their pay philosophy
and what they are looking for in a performance management system. Peter Shostak
asked if we will start over again when the new city manager is hired, and how many
times can you start over. Wynette said that's possible, but the ELT will be making the
decision on the content and format. James Lyall said that this is a discovery process for
the ELT and so the time won't be wasted.
Wynette explained that the timeline has been slowed down considerably and that it will
be a multi -phase process and may not be implemented until the next city manager is on
board. Amy Sharkey, Compensation Administrator said that Darin Atteberry, Interim
City Manager shared with employees at last Tuesday's Issues and Answers that he
supports pay for performance.
Peter Shostak said that slow is good but we must be mindful that if the economic crunch
goes away then the pressure of paying for performance will be there. On one hand we
have more time to work out the process because salaries are frozen, but we have also
lost significant ground and catch up salaries will be difficult.
Valerie Remington commented that there was also the potential for disaster to have a
plan hurriedly put in place.

Amy Sharkey said that other cities with pay for performance include the City of Loveland
and Boulder. She said that it looks like the trend is moving away from time and grade
structures and this includes the federal government. Amy said that the City of Fort
Collins had a pay for performance structure previously and it didn't work, so we want to
make sure we don't repeat the same mistakes.
IV. Ad Hoc Benefits Committee
Wynette said that Rick DeLaCastro Human Resources Director and Amy Sharkey have
been reviewing the initial report. The final report is due on July 23 and the Committee
will be meeting on August 2 and August 9. If the Board would like to review the report
we can provide copies and get the Board's feedback by July 30. Peter Shostak said he
would like a copy. Joan Busch will forward a copy of the report to all Board members.
V. Fair Labor Standards Act Change
Amy Sharkey reported that changes have been made to the Fair Labor Standards Act
that affects the tests to determine exempt and non-exempt status. Amy provided a
handout noting the changes. The salary basis has changed and part-time employees
making $23,660 or less are automatically non-exempt. Amy and other Human
Resources staff will be reviewing all jobs, starting with exempt positions. Review of
exempt jobs will be completed by August 23 and non-exempt jobs will be reviewed by
the end of the year. Amy anticipates very few changes to current exempt jobs, but
there could be some non-exempt jobs switching to exempt.
Peter Shostak commented that some employees going from non-exempt to exempt
could take a hit because of working overtime. Has the City thought about
implementation? Amy said that staff is working on this, and that they will be meeting
with managers. Managers also know that staff is reviewing exempt employees first and
then will move to non-exempt employees. Valerie Remington asked if there was a lot of
overtime. Wynette commented that is would be hard to say, but that it's primarily
seasonal.
VI. Pending Employee Issues
Wynette Cerciello advised the Board that the Human Resources Reps have had 12
investigations going on in the last couple of months. At this time, there are no appeals
pending. Sidney Simonson said that seems like a lot and is that normal? Wynette said
it's becoming the norm, but other cities are experiencing the same issues. Peter
Shostak asked if there was another word to use for investigations as that gives a
negative connotation. There was no decision on this point.
