HomeMy WebLinkAboutZoning Board Of Appeals - Minutes - 01/10/2002A regular meeting of the Zoning Board of Appeals was held on Thursday January 10, 2002, in the Council Chambers of the Fort Collins Municipal Building at 300 LaPorte Avenue, Fort Collins. BOARD MEMBERS PRESENT: Robert Donahue David Lingle Andy Miscio Steve Remington Diane Shannon William Stockover BOARD MEMBERS ABSENT: Martin Breth STAFF MEMBERS PRESENT: Paul Eckman, Deputy City Attorney Jenny Nuckols, Zoning Inspector Stacie Soriano, Staff Support to the Board 1. ROLL CALL The meeting was called to order by Chairperson Stockover, and roll call was taken. 2. APPROVAL OF MINUTES: A motion was made by Board Member Remington to approve the minutes from the December 13, 2001 meeting. Board Member Stockover seconded the motion. The motion passed with Board Members Donahue, Lingle and Shannon abstaining. 3. APPEAL NO. 2365 - Approved. Address: 727 Laporte Avenue Petitioner: Howard and Diana Perko Zone: NCL Section: 4.6(E)(4) Back round: The variance would reduce the required side -yard setback along the east lot line from 5 feet to 3 feet in order to allow a two-story addition to the rear of the existing home. The addition will extend 10.5 feet beyond the existing rear of the home and will line up with the existing east wall, which is already only 3 feet from the lot line. Petitioner's Statement of Hardship: The lot is very narrow, only 33 feet, and the house is already non -conforming. The addition will not increase the height of the existing building. Staff Comments: Nuckols presented an introduction to this appeal. The Applicants wanted to decrease the east property line from five feet to three feet. The house currently sits at a three-foot setback on the east side. On the west side of the property, the house is at a six-foot setback. The existing patio cover on the house will be removed. The addition will extend the full width of the house and line up with the existing exterior walls. Shannon asked if the tree looking toward the alley would be effected by the addition. Nuckols responded that she did not believe so. Nuckols stated the Applicant could answer the question appropriately. Nuckols noted that board packets contained a site plan with the proposed addition, proposed and existing elevations, existing and proposed floor plan. Shannon asked staff if any complaints were received from any neighbors. Nuckols stated staff did not receive any complaints. Shannon asked staff if Historic Preservation would be involved in the approval process. Nuckols responded that the Applicant would have to get permission from Historic Preservation. Nuckols told Shannon the Applicants could obtain concurrent approval from Historic Preservation while applying for the building permit. Lingle asked that should the Board grant a variance to a setback requirement, would the setback be changed the entire length of the property line or just specific to the ten feet of the addition? Nuckols responded that it would be specific to the ten feet of the addition. Applicant Participation: Diana Perko, 727 Laporte Avenue, addressed the Board. Applicant Perko stated that she did have written consent from her neighbors on the east and west side. Perko stated that she did want to keep the tree. The Applicant also noted that she has begun to obtain approval from the Historic Preservation office. Board Discussion: Shannon stated that this appeared to be the typical narrow lot situation_ Remington said that a 33-foot wide lot created a hardship. Remington expressed his support for the variance request. Remington made a motion to approve appeal 2365 based on the lot's nonconforming status and the hardship of a narrow lot. Shannon seconded the motion. Rollcall: Yeas: Miscio, Donahue, Stockover, Lingle, Shannon and Remington. Nays: None. 4. Other Business Nuckols wanted to remind the Board that the February meeting will be the annual ZBA breakfast starting at 8:00 am., and the meeting will start at 8:45 a.m. Meeting adjourned at 8:45 a.m. William Stockover, Chairperson OIL&Peter Barnes, Zoning Administrator
