Regular Meeting
Wednesday, February 21, 2001
City of Fort Collins Human Resources Conference Room
Present: Rick Aulino, Brian Carroll, Maria Martinez, Carole Stansfield, and Becky
Richardson.
Absent: Monica Garcia, Jay Molock
Staff: Lt. Karen Carlson, Greg Tempel, Wendy Hartzell
Public: Students from CSU to observe.
Call to
order: The meeting was called to order at 5:39 p.m. The January minutes were
reviewed. The Board corrected it's statement regarding the absence
policy that a member may have four absences, excused or unexcused in
any calendar year. This is incorrect and the policy is that a member may
not have 4 or more absences from regularly scheduled meetings in a
calendar year, without written notification. Rick Aulino made a motion to
approve the minutes as changed. Carole Stansfield seconded the
motion. No discussion and the motion carried 5-0.
Public
Input: The Board explained its meeting process and answered questions from
CSU students present.
Absences: Monica Garcia is absent as her son is in Children's Hospital in Denver.
She gave advance verbal notification but could not provide written
notification due to the circumstances. Jay Molock did not give prior notice
of his absence.
Voice
Mail
Message: Becky Richardson reported that she has been unable to respond to the
caller who had left a voice mail message. There have been no other
contacts.
Discussion
of Cases
Reviewed: Case #00-31 — Rick Aulino reported that the subcommittee reviewed the
case and returned it to Police Services for further investigation. The
subcommittee will complete its review after the case is returned to it from
Police Services. Subcommittee member Jay Molock was absent from the
scheduled subcommittee meeting, and the subcommittee members voted
to proceed with the alternate member taking his place.
Pending
Cases: A new case will be coming to the Board next month.
New
Business: Board improvement - Rick Aulino made a motion to table this
discussion to March. Maria Martinez seconded the motion. There
was no discussion and the motion passed 5 — 0.
CRB Satisfaction Survey — Rick Aulino passed out a draft survey for the
Board to review. Mr. Aulino asked if the Board still considered the survey
a good idea. Becky Richardson commented that the Board should not
expect to get a lot of response. Brian Carroll suggested tailoring one for
Police Services feedback, e.g., how knowledgeable was Police Services in
answering Police/CRB process questions. Board members will review
and comment on the survey at the March meeting.
Becky Richardson commented that she is concerned about subcommittee
members talking to complainants in one-on-one situations before a
subcommittee hearing on the case. There was discussion regarding
whether information given in this conversation would be considered new
information. Some complainants cannot attend a meeting or are reluctant
to participate and may want to speak with an individual subcommittee
member. The group reviewed the Bylaws, Section 5.4, and its intent. If
subcommittee members conduct one-on-one interviews with complainants
or other witnesses, this would be considered receiving information outside
of the process. Mr. Tempel stated that "clarifying questions" could be
considered new information that should only be received by the entire
subcommittee, per section 5.4. The Board decided that the subcommittee
chair should be responsible for notifying the complainant of the
subcommittee hearing. Lt. Carlson will be notifying officers and CSO's of
the hearing pursuant to the Bylaws. Greg Tempel will draft language to
amend the Bylaws to clarify that the subcommittee chair or designee
will contact the complainant to give notification of a subcommittee
hearing. He will bring a draft to the March meeting.
There was discussion regarding absent members at subcommittee
hearings. Brian Carroll commented that an unexcused absence at a
subcommittee hearing has much more impact on other members and the
process than an unexcused absence from a regular Board meeting. It
was clarified that there must be three subcommittee members present for
the hearing to proceed.
A flyer regarding what happens after a complaint is filed was reviewed. It
will be handed out after a person files a complaint. The Board may
consider giving something to Police to hand out at the time of incident.

Old
Business:
Rick Aulino commented that he found articles regarding other citizen
review boards and will forward the internet address to interested Board
members.
Pet Project — Brian Carroll stated there still is a lot that can be done with
regard to getting more information out to the public about the process.
Further discussion will be tabled to March.
Board Terms — Lt. Carlson reported that when a Board is first created, the
first term is not counted toward eligibility for other terms if the first term is a
partial term. The second term of a Board member is counted toward term
limits. Greg Tempel commented that the Boards and Commission
Handbook states: "No person may serve for more than 8 consecutive
years (2 complete terms)."
Adjournment: Rick Aulino made a motion to adjourn the meeting. Becky
Richardson seconded the motion. There was no discussion and
the motion passed 5-0. The meeting adjourned at 6:37 p.m.

Wednesday, March 21, at 5:30 p.m. in the Human Resources
Conference Room.

Call To Order:
The meeting was called to order at 6:47 p.m.
Listen to public input:
There were two members of the public attending the meeting, but neither of them had any
input.
Go into executive session:
Becky made a motion to enter executive session to consider case #IA00-33. It is
requested that both Greg and Francis join us in the executive session to answer some
specific questions we had. Carole seconded. There was no discussion and the motion
passed 3-0. We entered executive session at 6:5o p.m. At around 7:10 p.m., Francis left
executive session. At around 7:25 p.m., Greg left executive session. At 8:55 p.m. the
subcommittee left executive session.
Come out of executive session and vote:
The subcommittee left executive session at 8:55 p.m. Carole made a motion to reconvene
to continue discussing case #IA00-33 on Wednesday, February 28 at 5:30 at Human
Resources Conference Room, 200 W. Mountain. Becky seconded. There was no
discussion and the motion passed 3-0. The meeting adjourned at 9:00.
