A regular meeting of the Liquor Licensing Authority was held October 15, 2025, via Zoom Link, Assistant Judge Brandi Nieto presiding. All applications were heard via Zoom. Staff in attendance: Kevin Haugland, Assistant City Attorney Carrie Ripsam, Liquor Enforcement Officer Max Rader, Liquor Enforcement Officer Cecilia Good, Senior Deputy City Clerk Talisa Gula-Yeast, Regulatory Licensing Specialist 1. AGENDA REVIEW Item 4c - Show Cause Hearing for Taqueria Del Barrio was moved ahead to become Item 3a. Item 3 - Compliance Check Update moved after Item 6a. 2. CONSENT CALENDAR, APPROVED a. Minutes from the September 17, 2025, Liquor Licensing Authority Meeting 3. SHOW CAUSE HEARINGS a. Taqueria Del Barrio, LLC, DBA Taqueria Del Barrio, located at 1802 N. College Ave., Stipulation Agreement Natalia Pommier interpreted this hearing for Jesus Santiago. Assistant Judge Nieto reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, five (5) days will be served by a paying a fine in lieu of suspension (paid $500.00 fine in lieu of suspension) with ten (10) days held in abeyance for 1 year for violating the following: • C.R.S. § 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited Jesus Santiago, representative of Taqueria Del Barrio, LLC, stated he had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant Judge Nieto approved the findings, conclusion and order, accepting the stipulation agreement as presented for Taqueria Del Barrio, LLC, DBA Taqueria Del Barrio, located at 1802 N. Laporte Ave., Stipulation Agreement Assistant Judge Nieto reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension: five (5) days will be served by a paying a fine in lieu of suspension (paid $500.00 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating the following: • C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited Peter Linder, representing Ernest and Kristen Schmidtberger, stated they had an opportunity to review the stipulation agreement and have agreed to the terms. Assistant Judge Nieto approved the findings, conclusion and order, accepting the stipulation agreement as presented for Ernest and Kristen Schmidtberger (SP), DBA City Park Liquor, located at 2016 W. Laporte Ave. c. Fresh Foods, Inc., DBA Fresh Foods, located at 1100 W. Mountain Ave., Stipulation Agreement Assistant Judge Nieto reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension: fifteen (15) days will be served by a paying a fine in lieu of suspension (paid $2,832.99 fine in lieu of suspension) for violating the following: • C.R.S. § 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited Ben Dishman, representative of Fresh Foods, Inc., stated he had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant Judge Nieto approved the findings, conclusion and order, accepting the stipulation agreement as presented for Fresh Foods, Inc., DBA Fresh Foods, located at 1100 W. Mountain Ave. d. The Rockies, Inc., DBA The Rockies, located at 1660 N. College Ave, Stipulation Agreement Assistant Judge Nieto reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension: five (5) days will be served, with ten (10) days held in abeyance for 1 year for violating the following: • C.R.S. § 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited Prakash Sapkota, representative of The Rockies, Inc., stated he had an opportunity to review the stipulation agreement and have agreed to the terms. College Ave. 4. NEW LICENSE a. Beer and Wine License for Chipotle Mexican Grill Inc, DBA Chipotle Mexican Grill #1095, located at 2120 E Harmony Rd, Unit 107, Approved Assistant Judge Nieto swore in Brandon Perez-Vasquez and Laura Lunn. Brian Profitt, legal representative for Chipotle Mexican Grill Inc., asked Laura Lunn about the process and results of the petition conducted. Mr. Profitt then asked Brandon Perez-Vasquez, Area Manager for Chipotle Mexican Grill, about the operations of the business. Assistant Judge Nieto noted that Resolution 2025-013 required a reference to TIPS training to be removed as it is no longer a State of Colorado recognized alcohol server training program. Assistant Judge Nieto adopted the amended Resolution 2025-013 approving the Beer and Wine License for Chipotle Mexican Grill Inc, DBA Chipotle Mexican Grill #1095, located at 2120 E Harmony Rd, Unit 107. 5. TRANSFER OF OWNERSHIP a. Sun & Soil LLC, DBA Tasty Harmony, located at 160 W Oak St, Postponed Assistant Judge Nieto swore in Francisco Xavia. Francisco Xavia, representative of Sun & Soil LLC, described his plans for business operations, alcohol control, and training. Assistant Judge Nieto postponed the transfer of ownership application from Sun & Soil LLC, DBA Tasty Harmony, located at 160 W Oak St. to the November 19, 2025 Regular Liquor License Authority Meeting to verify whether the patio is a part of the licensed premises and updated Wholesaler Affidavits could be provided to the Clerk’s Office. 6. CHANGE OF LOCATION a. The MDE Project, Inc., DBA Yellow Crunch, located at 225 Pine St, Approved Viviana Henao, representative of The MDE Project, Inc., described her plans for business operations, alcohol control, and training. Assistant Judge Nieto conditionally approved the change of location application from The MDE Project, Inc., DBA Yellow Crunch, located at 225 Pine St., requiring the issuance of a Certificate of Occupancy before the move can occur. COMPLIANCE CHECK UPDATE Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks: September 17, 2025, visiting 16 liquor license establishments, 2 of which served the underage operatives: a failure rate of 12.50% for the evening. October 1, 2025, visiting 12 liquor license establishments, 4 of which served the underage operatives: a failure rate of 33.33% for the evening. Liquor Enforcement Officer Ripsam stated the overall failure rate is 20.82% for 2025. 8. OTHER BUSINESS None 9.
