HomeMy WebLinkAboutLIQUOR LICENSING AUTHORITY - MINUTES - 08/20/2025LIQUOR LICENSING AUTHORITY MINUTES Regular Meeting – August 20, 2025 1:00 p.m. A regular meeting of the Liquor Licensing Authority was held August 20, 2025, via Zoom Link, Chief Municipal Judge Hueser presiding. All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Max Rader, Liquor Enforcement Officer Cecilia Good, Senior Deputy City Clerk Consent Agenda Approved • Minutes from the July 16, 2025, Liquor Licensing Authority Meeting Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks: • July 23, 2025, visiting 18 liquor license establishments, 3 of which served the underage operative: a failure rate of 16.67% for the evening. • July 30, 2025, visiting 13 liquor license establishments, 3 of which served the underage operative: a failure rate of 23.07% for the evening. Liquor Enforcement Officer Ripsam stated the overall failure rate is 20.88% for 2025. Summary Suspension Hearing for Celli Inc., dba The Coast, 254 Linden St The transfer of ownership from Celli Inc. to MBM Live LLC was moved as it related to this hearing. Present for the hearing: William Chelales, sole proprietor of Celli Inc. dba The Coast Manley Feinburg, member of MBM Live LLC Gabriel Torres, member of MBM Live LLC Rachael Ardanuy, attorney representing Celli Inc. Brian Hanning, attorney representing MBL Live LLC Assistant City Attorney Holly Coulehan stated that there was no additional information than what was in the motion and affidavits. She did note that the licensee has complied with the terms of the summary suspension. Mr. Hanning explained the situation regarding the transfer of ownership and affirmed that Celli Inc. was still in control of the liquor license. Ms. Ardanuy provided further testimony stating that Celli Inc. maintains control of the liquor license and manages all financials for that portion of the business at The Coast. The transfer of ownership for MBM Live LLC is postponed until the September 17th hearing. Show Cause Hearing for Mini Corporation, dba Match-Ups, 625 S Mason St, Stipulation Agreement Ryan Cordsen and Nicole Hellmer, representatives for Mini Corporation., stated they have had an opportunity to review the stipulation agreement and have agreed to the terms. Chief Municipal Judge Hueser reviewed the terms of the stipulation agreement, noting the licensee agreed to a 17-day suspension: 7 days will be served by a paying a fine in lieu of suspension (paid $ 1,760.29 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited. Chief Municipal Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Mini Corporation, dba Match-Ups, 625 S Mason St. Show Cause Hearing for Gaku Ramen III, LLC, dba Gaku Ramen, 223 Linden St, Unit 1A, Stipulation Agreement David Sweeny and Joe Vicari, representatives of Gaku Ramen III, LLC, stated they have had an opportunity to review the stipulation agreement and have agreed to the terms. Chief Municipal Judge Hueser reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension: five (5) days will be served by a paying a fine in lieu of suspension (paid $500 fine in lieu of suspension), with ten (10) days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited. Chief Municipal Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for Gaku Ramen III, LLC, dba Gaku Ramen, 223 Linden St, Unit 1A. Show Cause Hearing for Dillon Companies, INC./Kroger/RASC/Tax, dba King Soopers #146, 2535 S College Ave, Stipulation Agreement Adam Stapen and Allie West, representatives for Dillon Companies, Inc./Kroger/RASC/Tax, stated they have had an opportunity to review the stipulation agreement and have agreed to the terms. Chief Municipal Judge Hueser reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension: five (5) days will be served by a paying a fine in lieu of suspension (paid $5,000 fine in lieu of suspension), with ten (10) days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor Code – Sales/Service to Minors Prohibited. Chief Municipal Judge Hueser reviewed the terms of the stipulation agreement, noting the licensee agreed to a 19-day suspension, nine (9) days served with ten (10) days held in abeyance for 1 year for violating the following: C.R.S. § 44-03-901(1)(b)(I) - Selling/Serving Alcohol to a Minor C.R.S. § 44-03-901(1)(g) - Selling/Serving a sealed container at retail without the proper license C.R.S. § 44-03-301(4)(a) - Fail to Conspicuously Display Currently Issued Liquor License Chief Municipal Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented for La Mia Piadina, LLC, dba La Piadina, 234 N College Ave., Unit B3. New Beer and Wine License for Chipotle Mexican Grill Inc., dba Chipotle Mexican Grill #5697, 2539 South College Ave., Unit 101, Approved Brian Proffitt, legal representation, Brandon Perez Vazquez, area manager, and Laura Lunn, with Alcohol Beverage Petitioning were present to represent Chipotle Mexican Grill Inc. Judge Hueser swore in Laura Lunn. Ms. Lunn explained the petition process and the results. Mr. Proffitt and Mr. Vazquez responded to questions from the judge. They stated they have not applied for a takeout and delivery permit. In response to questions from the Authority, Brandon Perez Vazquez stated he will require all his employees to be properly trained prior to being allowed to sell and serve alcohol. Chief Municipal Judge Hueser adopted Resolution 2025-008, approving the Beer and Wine liquor license application from Chipotle Mexican Grill Inc., dba Chipotle Mexican Grill #5697, 2539 South College Ave., Unit 101. New Beer and Wine Liquor License for LV Nail Spa Number 8 LLC, dba LV Nail Spa, 238 E Harmony Rd, D-14, Approved New Beer and Wine Liquor License for LV9 Nail Spa LLC, dba LV Nail Spa, 1801 S College Ave, Units A and B, Approved New Beer and Wine Liquor License for LVX LLC, dba LV Nail Spa, 3531 S College Ave, Unit 100, Approved The applications submitted by LV Nail Spa Number 8 LLC, LV9 Nail Spa LLC, and LVX LLC were considered together due to their related ownership and operations. Eva Garretson, with LiquorPros, was sworn in. She explained the petitioning process and statistics for the three LV Nail Spa locations. He answered questions from Brandon Sandberg, LV Nail Spa’s legal representation, regarding the operations of the three LV Nail Spas. In response to questions from the Assistant City Attorney Coulehan, Dao Tran stated he will require all his employees to be properly trained prior to being allowed to sell and serve alcohol. Chief Municipal Judge Hueser adopted Resolution 2025-009, Resolution 2025-010, and Resolution 2025-011 approving the Beer and Wine liquor license applications from LV Nail Spa Number 8 LLC, LV9 Nail Spa LLC, and LVX LLC, located at 238 E Harmony Rd, D-14, 1801 S College Ave, Units A and B, and 3531 S College Ave, Unit 100. Transfer of Ownership Hearing for MBM Live LLC, dba Sound Bar, 254 Linden St, Postponed to September 17th Meeting Transfer of Ownership Hearing for Lobos Inc., dba Cancun Mexican Grill & Cantina, 1006 Spring Creek Lane, Unit B-7, Approved Erika Kaiser and Armando Ibarra, representative for Lobos Inc., described their business plan and proposed activities. She answered questions from the Authority. Armando Ibarra was sworn in. In response to questions from the Authority, Armando Ibarra stated the current employees have already had alcohol server training. The City recommended updated training Chief Municipal Judge Hueser approved the transfer of ownership application from Lobos Inc., dba Cancun Mexican Grill & Cantina, 1006 Spring Creek Lane, Unit B-7. Transfer of Ownership Hearing for Mitra Hospitality LLC, dba Indigo, 144 N Mason St, Unit 8, Approved Nishan Sontakke, owner of Mitra Hospitality LLC, was sworn in by Judge Hueser. In response to questions from the Erika Kaiser, legal representation for Mitra Hospitality LLC, he stated he will require all his employees to be properly trained prior to being allowed to sell and serve alcohol. Chief Municipal Judge Hueser conditionally approved the transfer of ownership application from Mitra Hospitality LLC, dba Indigo, 144 N Mason St, Unit 8 with the request for an updated diagram that shows the licensed area on the patio. Change of Location Hearing for CC’s Flowers LLC, dba CC’s Flower Truck, 153 N College Ave, Approved Caitlin Dunnagan, representative of CC’s Flowers LLC, was sworn in by Judge Hueser. She described the reason for the change of location and answered questions from the Authority. Judge Hueser swore in Caitlin Dunnagan, who completed a petition to assess needs and desires in the new location. She described the petitioning process and the results.
