TROY HAMMOND, STREET MEDIA GROUP – REQUEST FOR A NEW CLASS C1 LICENSE AND SUPERVISOR’S CERTIFICATE WITHOUT REQUIRED EXAM OR PROJECT VERIFICATIONS Mr. Troy Hammond of Street Media Group is requesting that he be granted a new Class C1 license and supervisor’s certificate without submitting either a passing International Code Council (ICC) testing certificate of the code year required for a new license and supervisor’s certificate or project verifications that meet the quailification requirements. STAFF: Shar Manno, Manager Customer Support, Community Development and Neighborhood Services Russ Hovland, Sr Plans Examiner, Community Development and Neighborhood Services Troy Hammond, Street Media Group, introduced himself. Chair Richards outlined the hearing process. STAFF PRESENTATION Shar Manno, Customer Support Manager, outlined the request for a variance to the required exam and project verifications required for a new Class C license and supervisor’s certificate. She discussed the Code requirements related to evidence of a passing score on the applicable written examination and project verifications. She discussed those submitted by Mr. Hammond, which were deemed insufficient. Additionally, she noted that Mr. Hammond and Street Media Group has been hired to complete bus stop locations in Fort Collins and must acquire contractor licensing to pull required permits. Manno stated staff is recommending approval of Mr. Hammond’s request for a variance based on the application verification materials received that demonstrate that Mr. Hammond does have the experience necessary for a C1 Limited (bus stops only) license and supervisor’s certificate. She outlined the items for the Commission to consider. APPLICANT PRESENTATION Troy Hammond, Street Media Group, discussed the company’s history, and stated the reasons for requesting a variance to the exam requirements of the Class C1 license and supervisor’s certificate, specifically that the company does not build full structures and the testing covers all aspects required for full structure builds for both residential and commercial. He noted his experience building bus stops and transit amenities and seeks a limited variance that is limited to their scope of work. COMMISSION QUESTIONS/DISCUSSION Chair Richards and Mr. Hammond discussed Mr. Hammond’s role in the company, Mr. Hammond’s day-to-day involvement, and type of structures to be built. Mr. Hammond noted the shelters and installations include roofs. He stated that the shelters come in parts and the company uses a crane and equipment necessary for installation. They discussed that the shelters are installed with foundation systems, reinforcing, benches, and pass the required City inspections. Russ Hovland, Sr Plans Examiner, clarified the process, including the internal coordination between Building Services Department and Engineering Department. Commissioner Dunbar and Chair Richards noted the similarities between flagpole installations, retaining walls, netting, and other specialized trades that have asked for a limited license for their projects. Commissioner Dunbar moved that the Building Review Commission grant the requested variance to waive the written examination requirement under City Code Sections 15-157(c) and 15- 158(c)(1) and the project verification requirement under City Code Section 15-158, and the minimum experience requirement under City Code Section 15-159(a)(5) with respect to Mr. Hammond’s application for a Class C1 license and supervisor’s certificate as shown in the materials for this hearing. This variance is limited to allowing the issuance of a Class C1 license and supervisor’s certificate solely for the installation of bus stop structures that may be built under such license. The Commission finds that: granting this variance will not be a substantial detriment to the public good or substantially impair the intent and purposes of Chapter 15, Article V; and Mr. Hammond has demonstrated to the satisfaction of the Commission that they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which the Commission has determined qualify them to perform in a competent manner the installation of bus stop structures authorized under a Class C1 license and supervisor’s certificate. Commissioner Zimmerman seconded. Yeas: Dunbar, Moscrip, Roberts, Schneider, Zimmerman, and Richards. Nays: none. THE MOTION CARRIED. BACKGROUND Mr. Mizer was granted a Class D2 license and supervisor’s certificate on July 10, 1998. He has completed 56 residential permits since inception, and his file shows that an exam waiver was granted initially; however, he has since provided a passing exam certificate for N13 covering the 2009 code year. Mr. Mizer now seeks to complete a new project, which requires a higher license classification than Class D2. The scope of the project to be completed is a basement finish for 1 unit of a four plex. Details received for the project include concrete foundation walls with one wall being a common wall, 2x4 wood framed walls, soffits over mechanical and beams with no structural changes, minor underground plumbing for a bathroom, additional heat runs and cold air returns. The license and supervisor’s certificate required to complete this project is a Class C2(DR) due to the scope of work and type of structure the work is being done to. The required license classification description and qualification are as follows: Class C2(DR) License Description: A Class C-2-DR Structural Damage Repair/Restoration license holder shall be authorized to make repairs or restoration to: (1) structural damage to any building or structure in the City regulated under the building code classified as Type V construction and a Group R or a Group U, Division 1 occupancy which does not exceed three (3) stories in height; and (2) structural damage to other ancillary Type V buildings or structures that are associated with a particular multiple-unit housing project, including all work authorized by damage repair and restoration license types below this level. Approval Requirements: To be granted approval for Class C2(DR) level projects, the applicant must submit project verifications demonstrating they have performed or acted principally in the role of supervisor for the significant structural repair or construction of three (3) buildings classified as Type V construction and of Group R occupancy and provide a passing testing certificate. For the variance being sought, the testing required is: •ICC National Standard Building Contractor B Exam G12, over the 2018 IBC/2018 IRC; and the Concrete Manual: Concrete Quality and Field Practices 2021 IBC and ACI 318-19. •The ICC National Standard Building Contractor A Exam G11, would also be accepted for the license categories noted above. Packet Pg. 7 Agenda Item 2 Item 2, Page 2 Staff received Mr. Mizer’s application packet for a Class C2(DR) license; however, the application was deemed incomplete due to the age and the level of the testing certificate received, as well as no project verifications being attached. Mr. Mizer is specifically interested in completing the project described above, and consequently he now seeks a variance to allow him to be issued a one-time-use Class C2(DR) license and supervisor’s certificate without satisfying the above-stated examination and project verification requirements. RELEVANT CITY CODE SECTIONS Sec. 15-157. - Supervisor certificate; fees; examinations; renewals. (c) Prior to obtaining a supervisor certificate, except as provided otherwise in this Article, an applicant for such certificate shall have passed a written examination administered or approved by the City or the equivalent of such examination as determined by the Building Official. Every applicant who undergoes a written examination administered by the City shall pay a nonrefundable examination fee of seventy-five dollars ($75.) prior to such examination. Any applicant who fails to achieve a minimum score of seventy-five (75) percent shall be entitled to another examination covering the same license class or specialized trade, provided that the applicant shall not be permitted more than two (2) such examinations within any six-month period unless otherwise approved by the Commission. Alternatively, an applicant may be granted a third such examination within any six - month period upon the applicant demonstrating to the satisfaction of the Building Official adequate preparation for the examination by successfully completing a class or coursework covering the building code or other code as applicable, or the equivalent thereof as approved by the Building Official. The applicant shall pay a nonrefundable re-examination fee of fifty dollars ($50.) for each subsequent examination covering the same license class or specialized trade. Examinations shall be given at a time and place designated by the Building Official. The written examination for a supervisor certificate may be waived by the Building Official provided that the applicant can prove that he or she has passed a satisfactory written examination equivalent in scope to that administered by the City. Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect or professional engineer directly involved in the construction of said project and said person shall have worked directly with the applicant. (c) Subject to the qualification requirements of § 15-159 and subject to any applicable variances which may have been granted by the Board pursuant to § 15-156 and provided further that the applicant has not committed any acts described in § 15-162 of this Article without the Board having first conducted a hearing and having made a determination regarding the applicant's fitness to be granted a license or supervisor certificate, the Building Official shall issue to the applicant the license or supervisor certificate applied for upon receipt of all of the following: (1) Evidence of a passing score on the applicable written examination or equivalent as specified in this Article; (4) All documents required to be provided in Subsection (a) above. Packet Pg. 8 Agenda Item 2 Item 2, Page 3 Sec. 15-159. - Minimum experience qualifications. (a) Minimum experience requirements for Classes A, A-DR, B, B-DR, C-1, C-1-DR, C-2, C-2-DR, D-1, D-2, D-DR, E, ER and MM general contractor licenses, specialized trade contractor licenses, and associated supervisor certificates as described in § 15-160 are as hereafter provided in this Section. In order to qualify for such minimum experience, all construction and specialized trade installation projects are subject to the Building Official's review and approval for sufficient variety and complexity. All such projects shall have been constructed or installed primarily by, the applicant or under the applicant's direct control. The particular license type and respective required minimum documented experience are described as follows: (8) To qualify for a Class C-2-DR license or supervisor certificate, the applicant must have acted principally in the role of supervisor for the significant structural repair construction on three (3) buildings of Type V construction, with one (1) building being at least three (3) stories in height. RECOMMENDATION Staff recommends denial of Mr. Mizer’s request for the variances to the testing, project verification, and minimum experience requirements for a one-time Class C2(DR) license and supervisor’s certificate under City Code Sections 15-157(c), 15-158 and 15-159(a)(5). In support of this recommendation, staff finds that, based on the application, testing and project verification materials received, Mr. Mizer does not have the experience necessary for a Class C2(DR) license and supervisor’s certificate. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a higher license classification can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the recommendation and determines that the appellant has not satisfied the standard for a variance, the Commission may pass a motion to deny any and all of the requested variances, which would require the appellant to provide all required testing and project verification materials before he can be granted a higher license classification, Class C2(DR). If the Commission disagrees with the recommendation and determines that one-time-use variances to the testing, project verification, and minimum expierience requirements are reasonable, the Commission may pass a motion to approve the variances to the testing certificate requirement under Code Sections 15-157(c) and 15- 158(c)(1); the project verifications requirement under Section 15-158; and the minimum experience requirement under Section 15-159(a)(5), with the condition that the Class C2(DR) license and supervisor’s certificate granted be limited to a one-time-use to allow the appellant to complete the project described in the hearing materials. This variance would allow the Building Official to grant a one-time-use Class C2(DR) license and supervisor’s certificate to the appellant without receiving an applicable testing certificate or project verifications. Staff does recognize that Mr. Mizer has extensive experience in single-family detached remodels, and that this experience may have some transferability into multi-family remodels and thanks the Commission for thoughtful consideration.
