ECO RETAINING WALLS – REQUEST FOR A NEW LICENSE AND SUPERVISOR’S CERTIFICATE WITHOUT REQUIRED EXAM AND PROJECT VERIFICATIONS Mr. Mark Roe of ECO Retaining Walls, Inc. is requesting a new Class C1(DR) license and supervisor’s certificate to be issued without a passing International Code Council (ICC) testing certificate of the code year required for a new license or reinstatement of a license and project verifications for retaining walls as opposed to full new commercial builds. STAFF: Shar Manno, Manager Customer Support, Community Development and Neighborhood Services Marcus Coldiron, Chief Building Official, Community Development and Neighborhood Services Mark Roe, Eco Retaining Walls, and Joel Sandoval, Eco Retaining Walls, introduced themselves. Chair Richards outlined the hearing process. STAFF PRESENTATION Shar Manno, Customer Support Manager, outlined the request for a variance to the required exam and project verifications required for a new Class C1(DR) license and supervisor’s certificate. She discussed the Code requirements related to evidence of a passing score on the applicable written examination and project verifications. She discussed those submitted by Mr. Roe, which were deemed insufficient. Additionally, she noted that Mr. Roe has 14 active permits and issued a 30- day temporary on June 26, 2025, which expired on July 26, 2025. Manno stated staff is recommending approval of Mr. Roe’s request for a variance based on the application verification materials received that demonstrate that Mr. Roes does have the experience necessary for a C1(DR) Limited (to retaining walls only) license and supervisor’s certificate. She outlined the items for the Commission to consider. APPLICANT PRESENTATION Mark Roe, Eco Retaining Walls, stated the reasons for requesting a variance to the exam requirements of the Class C1(DR) license and supervisor’s certificate, specifically that the company does not build full structures and the testing covers all aspects of codes required for full structure builds for both residential and commercial. He noted his experience building retaining walls and seeks a limited variance that is limited to their scope of work. Joel Sandoval, Eco Retaining Walls, stated the reasons for requesting a variance to the project verifications requirements of the Class C1(DR) license and supervisor’s certificate, specifically that the company has a specialized scope of work. He discussed that the company exclusively builds retaining walls. (**Secretary’s Note: Vice Chair Moscrip joined the meeting at this point.) ITEM 1, ATTACHMENT 1 DRA F T Packet Pg. 5 7/31/25 – MINUTES COMMISSION QUESTIONS/DISCUSSION Commissioner Roberts and Commissioner Schneider discussed whether there will be any fencing or structures on top of the retaining walls, as part of the scope of work, if the Commission approves this request for variance. They discussed that a permit does not need to be pulled for fencing that is six feet or less in height. Mr. Sandoval noted that they do not install fencing as part of their scope of work. Commissioner Richards asked Mr. Roe to discuss Mr. Roe’s role and process at the job site, under the supervisor’s certificate. Mr. Roe noted that he is responsible for submitting the permit application, holding a pre-structure meeting, meeting with the crew onsite, and supervising the job per the plans and specifications. Mr. Roe discussed his strict testing for reinforcement walls and compaction. Commissioner Poncelow expressed his concern about having fourteen jobsites under one supervisor. Mr. Roe explained that the fourteen permits are on one job site, one project, and each permit is for one wall each. Assistant City Attorney Shehan noted that Commissioner Moscrip arrived after the staff and applicant presentations. The Commission discussed whether Moscrip had enough information to vote on the matter and the result of abstention, if any. Commissioner Poncelow moved that the Building Review Commission grant the requested variance to waive the written examination requirement under City Code Sections 15-157(c) and 15-158(c)(1) with respect to Mr. Roe’s application for a Class C1(DR) license and supervisor’s certificate. This variance is limited to allowing the issuance of a Class C1(DR) license and supervisor’s certificate solely for the installation of retaining walls that may be built under such license. The Commission finds that: granting this variance will not be a substantial detriment to the public good or substantially impair the intent and purposes of Chapter 15, Article V; and Mr. Roe has demonstrated to the satisfaction of the Commission that they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which the Commission has determined qualify them to perform in a competent manner the installation of retaining walls authorized under a Class C1(DR) license and supervisor’s certificate. Commissioner Zimmerman seconded. Yeas: Poncelow, Roberts, Schneider, Zimmerman, Moscrip, and Richards. Nays: none. THE MOTION CARRIED. BACKGROUND Street Media Group is a company that offers advertising strategies including the installation of bus stop structures. They have been hired to complete bus stop locations in Fort Collins and must acquire contractor licensing to pull required permits. Mr. Hammond submitted a new licensing request on July 28, 2025, which was incomplete pending receipt of an ICC exam certificate and required documents for project verifications. The license and supervisor’s certificate required to complete the types of projects Mr. Hammond would like to complete is a Class C1 due to the structural nature of the bus stops. The required license classification description and qualification are as follows. • Class C1 License Description: : Authorized to construct or demolish any building or structure in the City that is regulated under the building code, and which does not exceed 20,000 square feet in floor area and/or three (3) stories in height, including all work authorized by license types below this level. • Minimum Experience Required: To qualify for Class C1, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings of occupancy classifications other than Group R, up to 20,000 square feet in floor area and/or up to three stories in height. City Code Section 15-158 requires the applicant to submit project verifications demonstrating satisfaction of this requirement. • Exam Requirements: The City Code requires that an applicant for a Class C1 license or supervisor’s certificate provide evidence of a passing score on the following written examination or its equivalent: General Contractor Class C1, Class C1-DR, Class C2, Class C2-DR, and Class E: • ICC National Standard Building Contractor B Exam G12, over the 2018 IBC/2018 IRC; and the Concrete Manual: Concrete Quality and Field Practices 2021 IBC and ACI 318-19. Packet Pg. 7 Agenda Item 2 Item 2, Page 2 • ***The ICC National Standard Building Contractor A Exam G11 would also be accepted for the license categories noted above. Mr. Hammond now seeks a variance to allow him to be issued a limited license and supervisor’s certificate without satisfying the above-stated examination requirement and by submitting project verifications that match and demonstrate he has the experience required to complete the projects he was hired to do. The issues that Mr. Hammond feel are relevant are that, since the company only installs bus stops and does not build full structures, he does not satisfy the minimum experience requirements for a full Class C1 license and, therefore, cannot provide the project verifications required to obtain such license or supervisor’s certificate. He also feels that the testing covers more than what the company does and needs. They do not build full structures, and the testing covers all aspects of codes required for full structure builds for both residential and commercial. Below is from the International Code Council’s accreditation website. Staff are aware that this testing is more than what Street Media Group and Mr. Hammond do, however, there are numerous aspects of the testing that are relevant. Packet Pg. 8 Agenda Item 2 Item 2, Page 3 RELEVANT CITY CODE SECTIONS Sec. 15-157. - Supervisor certificate; fees; examinations; renewals. (c) Prior to obtaining a supervisor certificate, except as provided otherwise in this Article, an applicant for such certificate shall have passed a written examination administered or approved by the City or the equivalent of such examination as determined by the Building Official. Every applicant who undergoes a written examination administered by the City shall pay a nonrefundable examination fee of seventy-five dollars ($75.) prior to such examination. Any applicant who fails to achieve a minimum score of seventy-five (75) percent shall be entitled to another examination covering the same license class or specialized trade, provided that the applicant shall not be permitted more than two (2) such examinations within any six -month period unless otherwise approved by the Commission. Alternatively, an applicant may be granted a third such examination within any six-month period upon the applicant demonstrating to the satisfaction of the Building Official adequate preparation for the examination by successfully completing a class or coursework covering the building code or other code as applicable, or the equivalent thereof as approved by the Building Official. The applicant shall pay a nonrefundable re-examination fee of fifty dollars ($50.) for each subsequent examination covering the same license class or specialized trade. Examinations shall be given at a time and place designated by the Building Official. The written examination for a supervisor certificate may be waived by the Building Official provided that the applicant can prove that he or she has passed a satisfactory written examination equivalent in scope to that administered by the City. Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect or professional engineer directly involved in the construction of said project, and said person shall have worked directly with the applicant. . . . (c) Subject to the qualification requirements of § 15-159 and subject to any applicable variances which may have been granted by the Board pursuant to § 15-156 and provided further that the applicant has not committed any acts described in § 15-162 of this Article without the Board having first conducted a hearing and having made a determination regarding the applicant's fitness to be granted a license or supervisor certificate, the Building Official shall issue to the applicant the license or supervisor certificate applied for upon receipt of all of the following: (1) Evidence of a passing score on the applicable written examination or equivalent as specified in this Article; (4) All documents required to be provided in Subsection (a) above. Sec. 15-159. - Minimum experience qualifications. (a) Minimum experience requirements for Classes A, A-DR, B, B-DR, C-1, C-1-DR, C-2, C-2-DR, D-1, D-2, D-DR, E, ER and MM general contractor licenses, specialized trade contractor licenses, and associated supervisor certificates as described in § 15-160 are as hereafter provided in this Section. In order to qualify for such minimum experience, all construction and specialized trade installation projects are subject to the Building Official's review and approval Packet Pg. 9 Agenda Item 2 Item 2, Page 4 for sufficient variety and complexity. All such projects shall have been constructed or installed primarily by, the applicant or under the applicant's direct control. The particular license type and respective required minimum documented experience are described as follows: (5) To qualify for a Class C-1 license or supervisor certificate, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings of Type III, IV or V construction. ADDITIONAL INFORMATION All other contractor license application materials and payment have been received from the appellant. RECOMMENDATION Staff recommends approval of Mr. Hammonds request for variances to the testing, project verification, and minimum experience requirements for a Class C1 license and supervisor’s certificate under City Code Sections 15-157(c), 15-158 and 15-159(a)(5) with the condition that the license and supervisor’s certificate will be limited to the installation of bus stop structures only. In support of this recommendation, staff finds that, based on the application and project verification materials received, Mr. Hammond does have the experience necessary for a Class C1 Limited (to bus stops only) license and supervisor’s certificate. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether either variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the recommendation or otherwise determines that variances to the testing, project verification, and minimum experience requirements are reasonable, the Commission may pass a motion to approve the variances to the testing certificate requirement under Code Sections 15-157(c) and 15-158(c)(1); the project verifications requirement under Section 15-158, and the minimum experience requirement under Section 15-159(a)(5), with or without staff’s recommended condition, which would allow the Building Official to grant a new Class C1 license and supervisor’s certificate to the appellant without receiving an applicable testing certificate or project verifications. If the Commission disagrees with the recommendation and determines that the appellant has not satisfied the standard for a variance, the Commission may pass a motion to deny any of all of the requested variances, which would require the appellant to provide the required testing certificate and/or satisfy the minimum experience reuqirement and provide the required project verifications, before he can be granted a Class C1 license and supervisor’s certificate.
