Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Max Radar, Liquor Enforcement Officer Aimee Jensen, Regulatory Licensing Specialist Consent Agenda Approved  Minutes from April 16, 2025, Liquor Licensing Authority Meeting Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  May 12, 2025, visiting 13 liquor licensed establishments, 3 of which served the underage operative: a failure rate of 23.07% for the evening.  May 12, 2025, visiting 14 liquor licensed establishments, 2 of which served the underage operative: a failure rate of 18.52% for the evening.  May 19, 2025, visiting 15 liquor licensed establishments, 3 of which served the underage operative, a failure rate of 17.24%. Liquor Enforcement Officer Ripsam stated the overall failure rate is 23.53% for 2025. Show Cause Hearing for GottiWebs, LLC, dba Bondi Beach Bar, 110 Old Town Square, Suite 120, Stipulation Agreement Michael Weber, representative for GottiWebs, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 10-day suspension, with 10 days held in abeyance for 1 year for violating City of Fort Collins Municipal Code 3-81 – Report of Disturbances. May 21, 2025 P a g e 2 | 6 Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for GottiWebs, LLC, dba Bondi Beach Bar, 11 Old Town Square, Suite 120. Show Cause Hearing for The Colorado Room, Ltd, dba The Colorado Room, 642 South College Avenue, Stipulation Agreement Justin Serr and Daniel James Shea, representatives for The Colorado Room, Ltd, stated they have had an opportunity to review the stipulation agreement and have agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, 5 days served (paid $810.59 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code – Sales/Service to Minors Prohibited. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for The Colorado Room, Ltd., dba The Colorado Room, 642 South College Avenue. Show Cause Hearing for Hunan of Fort Collins, Inc., dba Hunan Chinese Restaurant of Fort Collins, 731 East Harmony Road, Suite 300, Stipulation Agreement Anabey Sunseri, representative for Hunan of Fort Collins, Inc., stated she has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 16-day suspension, 5 days served (paid $500 fine in lieu of suspension), with 11 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code – Sales/Service to Minors Prohibited. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for Fort Collins, Inc., LLC, dba Hunan Chinese Restaurant of Fort Collins, 731 East Harmony Road, Suite 300. Show Cause Hearing for Great Western Cane Co, LLC, dba Japango FTC/Sugar Salt Sand by Japango, 123 South College Avenue, Stipulation Agreement Jonathan M. Banis, representative for Great Western Cane Co, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, 5 days served (paid $2152.35 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code – Sales/Service to Minors Prohibited. Show Cause Hearing Wing & Tong, Inc., dba Masa Hibachi, 2400 East Harmony Road, Suite #102, Stipulation Agreement Guo Tong Zhou, through Interpreter Rose Yan, representative for Wing & Tong, Inc., stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 16-day suspension, 5 days served (paid $805.48 fine in lieu of suspension), with 11 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code – Sales/Service to Minors Prohibited. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for Wing & Tong, Inc., dba Masa Hibachi, 2400 East Harmony Road, Suite #102. Show Cause Hearing Red Robin International, Inc., dba Red Robin Gourmet Burgers & Brews, 701 East Harmony Road, Stipulation Agreement Adam Stapen, attorney representing Red Robin International, Inc, stated he has had an opportunity to review the stipulation agreement with his client and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 16-day suspension, 5 days served (paid $528 fine in lieu of suspension), with 11 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code – Sales/Service to Minors Prohibited and C.R.S. 44-3-901(6)(p)(I)(A) Unlawful Acts – To permit a person under eighteen years of age to sell, dispense, or participate in the sale or dispensing of any alcohol beverage. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for Red Robin International, Inc., dba Red Robin Gourmet Burgers & Brews, 701 East Harmony Road. May 21, 2025 P a g e 4 | 6 Show Cause Hearing for Smashburger Acquisition – Denver, LLC, dba Smashburger #1006, 2550 East Harmony Road, #100 Stipulation Agreement Kevin Coates, attorney representing Smashburger Acquisition – Denver, LLC, stated he has had an opportunity to review the stipulation agreement with his client and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting that the licensee agreed to a 20-day suspension, 10 days served from June 2, 2025 through June 11, 2025, with 10 days held in abeyance for 1 year for violating C.R.S. 44-3-901(1)(b)(I) of the Colorado Liquor code. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for Smashburger Acquisition – Denver, LLC dba Smashburger #1006, 2550 East Harmony Road, #100. Show Cause Hearing for Done Well Hospitality Group, LLC, dba The Still Whiskey Steaks, 151 North College Avenue, Stipulation Agreement Tyler Charles and Jeff Brown, both representatives for Done Well Hospitality Group, LLC, stated they have had an opportunity to review the stipulation agreement and have agreed to the terms Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, 5 days served (paid $3438.47 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating City of Fort Collins Municipal Code 3-81 – Report of Disturbances. Assistant Municipal Judge Kaspar approved the findings, conclusion and order, accepting the stipulation agreement as presented for Done Well Hospitality Group, LLC, dba The Still Whiskey Steaks, 151 North College Avenue. Temporary Modification of Premise Application from Ovations Food Services, dba Canvas Stadium at Sonny Lubick Field, 751 West Pitkin Street, Approved Kristen Solano, catering manager for Ovations Food Services, briefly described the proposed addition to the New Belgium porch on the north side of the stadium. In response to a question from the Authority, she stated that trained staff will be checking id’s and that they have had this event for several years. Assistant Municipal Judge Kaspar approved the temporary modification of premise application from Ovations Food Services, dba Canvas Stadium at Sonny Lubick Field, 751 West Pitkin Street. May 21, 2025 P a g e 5 | 6 Temporary Modification of Premise Application from Fort Collins Barbecue, LLC, dba Smok, 327 East Foothills Parkway, Suite 110, Approved Matt Collier, district manager for Fort Collins Barbecue, LLC, briefly described the proposed addition to the outdoor area from their restaurant. In response to a request from Liquor Enforcement Officer Ripsam, he stated he will instruct staff to watch for patrons bringing their own alcohol into the added outdoor area. Assistant Municipal Judge Kaspar approved the temporary modification of premise application from Fort Collins Barbecue, LLC, dba Smok, 327 East Fort Collins Parkway, Suite 110. New Hotel-Restaurant Liquor License Application from Kingpot Fort Collins, LLC, dba Captain Hook Seafood House, 2880 East Harmony Road, Approved Nan Yin, representative for Kingpot Fort Collins, LLC, was sworn. Eva Garretson, representative for Kingpot Fort Collins, LLC, was sworn. She briefly described the petitioning process and that the results of this survey indicates strong support for this application. In response to questions from the Authority, Mr. Yin stated he will require all his employees to be properly trained prior to being allowed to sell and serve alcohol. Assistant Municipal Judge Kaspar adopted Resolution 2025-006 approving the hotel-restaurant liquor license application from Kingpot Fort Collins, LLC, dba Captain Hook Seafood House, 2880 East Harmony Road. New Hotel-Restaurant Liquor License Application from Morpho Bleu, LLC, dba Philippe French Bistro & Bakery, 133 South College Avenue, Approved Philippe Boutinet, representative for Morpho Bleu, LLC, was sworn. In response to questions from the Authority, Mr. Boutinet stated he has received permission from the City’s Engineering Department to use the public sidewalk for his patio. He stated he is strictly a restaurant and not a bar. Mr. Boutinet described his petitioning process and stated that the petitions indicate strong support for this application. Assistant Municipal Judge Kaspar adopted Resolution 2025-007 approving the hotel-restaurant liquor license application from Morpho Bleu, LLC, dba Philippe French Bistro & Bakery, 133 South College Avenue.
