1. Roll call.
2. Appeal 2145. The variance would reduce the required side yard setback from the west
lot line from 5 feet to 1 foot, 4 inches in order to allow a one-story addition to be
constructed on the front of the house. The addition would extend 9 feet on the front, and
add 162 sq. ft. of floor area to the living room. Section 29-119(5) by David Neff and
Claire Carren, 1524 W. Oak Street.
3. Appeal 2146. The applicant is requesting that the Board review a staff determination that
the use of a blue colored light to illuminate the walls of the first 8 floors of the First
National Bank building constitutes a "sign" as defined in the sign code. The bank is
exploring the possibility of using a new type of light to illuminate the building. Currently,
"white" lighting is used to illuminate the natural white walls. The proposed lighting would
result in "blue"walls. Section 29-1 (definitions) by Tim Stein, Accurate Sign
Maintenance, 205 W. Oak Street.

--- Petitioner's statement of hardship: The original west wall of the home was
constructed only 1 A"from the lot line. Structurally and architecturally, the best way
to add on is along the existing wall. The lot is an older lot in the old part of town.
The home is located towards the rear of the lot, and the house on the adjacent lot
is towards the front. Therefore, the addition will not be near any other existing
structure.

lighting is not a sign, and is requesting that the Board review the staff decision.
--- Staff comments: The Code defines a sign in part as "...any ...device, symbol,
trademark, object or design which conveys a recognizable meaning, identity or
distinction...which by reason of its form, location, manner of display, color, ...attracts
or is designed to attract attention to the subject or to the premises upon which it is
situated, or is used as a means of identification, advertisement or announcement."
Staff will make a presentation at the meeting regarding why the intended
lighting devices may qualify as signs.
