The variance would reduce the required side yard setback along the south lot line from 5 ft. to 1 ft. 4 inches in order to allow a proposed second story addition to be built at the same setback as the existing first floor. The variance would also increase the maximum allowed building height from 30 ft. to 36 ft. 3 inches at one point, in order to allow a turret as part of the addition. Section 29-167(5), 29-167(6) by Thomas Ridgely, 422 Peterson St.. 3. Appeal No. 2136. The variance would reduce the required side yard setback along the east lot line from 5 ft. to 2 ft. for a new one and a half car detached garage/studio. The new garage will replace the existing garage. Section 29-119(5) by Mark Anderson, 815 K Oak Street. 4. Appeal No. 2137. The variance would reduce the required landscape buffer setback along Riverside Avenue from 50 ft. to 28 ft. (at the narrowest point) This would be consistent with other developments along Riverside. Section 29-371 by Don Skaggs, 1450 Riverside Avenue. 5. Other business. ZONING BOARD OF APPEALS AGENDA Regular Meeting July 13, 1995 Appeal 2135: --- 422 Peterson St. --- Petitioner: Thomas Ridgely, owner. --- Zone: NCM Zone --- Section 29-167(5), 29-167(6) --- The variance would reduce the required side yard setback along the south lot line from 5 ft. to 1 ft. 4 inches in order to allow a proposed second story addition to be built at the same setback as the existing first floor. The variance would also increase the maximum allowed building height from 30 ft. to 36 ft. 3 inches at one point, in order to allow a turret as part of the addition. - --- Petitioner's statement of hardship: The existing support wall for the addition is already located only 1 ft. 4 inches from the lot line. The addition will be built right on top of this existing wall. This will give the house a more finished , original appearance. The turret will give the home a Queen Anne appearance and will be the only part of the structure above 30 ft. --- Staff comments: None. Appeal 2136: --- 815 W. Oak Street --- Petitioner: Mark Anderson, owner. --- Zone: NCL Zone --- Section 29-119(5) -- The variance would reduce the required side yard setback along the east lot line from 5 ft. to 2 ft. for a new one and a half car detached garage/studio. The new garage will replace the existing garage. --- Petitioner's statement of hardship: The existing garage is in bad repair, and the owner would like to replace it. The lot is narrow(47.5 ft. wide), and there is mature landscaping along the west side of the lot. If the 5 ft. setback were met, the effective, useable area of the yard would be reduced. The second floor studio will be used for personal use. --- Staff comments: None. n Appeal 2137: --- 1450 Riverside Avenue --- Petitioner: Don Skaggs, buyer. --- Zone: IL Zone --- Section 29-371 --- The variance would reduce the required landscape buffer setback along Riverside Avenue from 50 ft. to 28 ft. (at the narrowest point). This would be consistent with other developments along Riverside. The proposed development is for two, office/warehouse buildings. --- Petitioner's statement of hardship: The topography of the lot is such that it slopes to the rear. Reducing the landscape buffer allows the building to be moved forward on the lot to avoid the slope. Additionally, if the building needs to be located 22 ft. further back, it will be difficult to provide adequate truck loading and maneuvering area behind the building. This section of Riverside contains 6 different zoning districts. This IL zone is the only one of the six that requires a 50 ft. setback. The others all require 15 feet. So, the 28 ft. proposed exceeds the requirement of adjacent properties. -- Staff comments: A similar variance was approved by the Board on April 12, 1990 (see enclosed copy of minutes), however that particular project was never started. The section of Riverside Avenue between Prospect and Lemay is a hodgepodge of zoning districts. There are 6 different zoning districts in this short stretch. This project is located in the IL zone, which is the only one of the 6 which requires a 50 foot setback. All of the other zones in this area require only a 15 foot landscape setback adjacent to the parking lot. There are three other businesses on Riverside which are located in the 1L zone, but they were all in existence prior to the Code being changed to require a 50 foot setback in this zone. l crw . a r F f - � 6-aO4-4-
