REED BRICKELL, DICK BRICKELL & SONS, INC. – REQUEST FOR A NEW SUPERVISOR’S CERTIFICATE WITHOUT REQUIRED EXAM DESCRIPTION: supervisor’s certificate to be issued without a Council (ICC) testing certificate of the code year required for a new supervisor’s certificate. STAFF: Neighborhood Services Marcus Coldiron, Chief Building Official Vice Chair Moscrip outlined the hearing process. Reed Brickell briefly outlined the history of his retaining wall company and his request for a new Class C1(DR) license and supervisor’s certificate to be issued without a passing ICC testing certificate. He noted two associations that oversee retaining wall regulations do not require or have any testing for retaining wall installation and stated the ICC has little or no education or testing related to retaining wall installation. Mr. Brickell went on to detail the type of specialized licenses he holds for his work in other municipalities and stated he is currently under contract for a job at Union Park. Staff Presentation Shar Manno, Manager, Customer Support, Community Development and Neighborhood Services, stated Dick Brickell & Sons, Inc. is a company that offers small- and large-scale residential and commercial retaining wall installation and noted a full and complete application packet has been received minus the testing for the license. Manno stated the license and supervisor’s certificate required for the types of projects Mr. Brickell would like to complete is the Class C1(DR) due to the height, square footage, and structural nature of the retaining walls, which currently requires a passing G12 ICC testing certificate that covers the 2018 Code year. Manno stated Mr. Brickell has argued the applicable testing covers more than what the company does. Manno stated staff is recommending denial of the request as the applicant has not completed the approved ICC testing as required for the issuance of any supervisor’s certificate. She outlined the applicable standards for a variance. Applicant Presentation (**Secretary’s Note: Mr. Brickell essentially made his presentation in his opening remarks.) Staff Response None. Applicant Response None. Commission Questions/Discussion Commissioner Poncelow asked if restrictions could be placed on the license limiting work allowed to only certain items. Manno replied staff has discussed that option, and based on previous discussions with the City Attorney, it was determined that limiting a license was not something that could be done; however, a variance to the supervisor’s certificate testing could be offered. Mr. Brickell stated he would have no problem with a license restriction either in terms of work allowed or timing. ITEM 1, ATTACHMENT 1 BRC JANUARY 30, 2025 MINUTES - DRAFT Packet Page 5 City of Fort Collins Page 3 January 30, 2025 Commissioner Poncelow made a motion, seconded by Commissioner Zimmerman, that the Building Review Commission grant the requested variance to waive the written examination requirement under City Code Section 15-157(c) with respect to Mr. Brickell’s application for a supervisor’s certificate. The Commission finds that granting this variance will not be a substantial detriment to the public good or substantially impair the intent and purposes of Chapter 15, Article V. The strict application of 15-157(c) would result in exceptional or undue hardship on Mr. Brickell because asking him to complete a test on a Code that is not applicable to his profession would cause that undue hardship and Mr. Brickell has demonstrated to the satisfaction of the Commission they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which the Commission has determined qualify them to perform in a competent manner any construction authorized under the Class C1(DR) license and supervisor’s certificate. Commissioner Poncelow stated the business obviously has the qualifications to do the work and noted staff is working to address the licensing issues caused by this type of situation. Commissioner Schneider concurred the applicant is qualified to perform the retaining wall work, but shared concerns that the license allows for the building of structures. Assistant City Attorney Shehan clarified the Commission does have the option to impose conditions on a granted variance. Commissioner Poncelow made a motion, seconded by Commissioner Zimmerman, to amend the motion as follows: that the Building Review Commission grant the requested variance to waive the written examination requirement under City Code Section 15-157(c) with respect to Mr. Brickell’s application for a supervisor’s certificate. This variance is limited to allowing the issuance of a supervisor’s certificate solely for the building of retaining walls that may be built under such license. BACKGROUND A permit application for building permit number B2409482, with the following project description, was submitted on January 2, 2025: The Ellie – Bldg. A, new 3 story, 22,665 sq. ft, 13 Plex condo building slab on grade foundation. Attached garages on main level - 4880 sq. ft. Energy = Prescriptive. City Water. Over 150A service (per unit). Job Contact: TBA There is also a plan to build a second building that is 12 units. Both building on the corner of Londele and Suniga. Through email communications and the submitted permit application, staff has determined that the minimum license and supervisor’s certificate classification needed for this project will be a Class C-2. Mr. Feyen submitted a contractor’s licensing application packet requesting a Class B license and supervisor’s certificate on January 17, 2025. After a thorough review of his application packet, the Contractor Licensing Team determined that the highest license classification for which Mr. Feyen qualifies for and can be granted is a Class D-1, based on the following facts: 1. The project verifications submitted show that the structures are of single-family attached, meaning they are separated by individual property lines; 2. All three project verifications were internally verified by a Drayson Bowman (internal to Vector); and 3. The G12 level of ICC testing is insufficient to satisfy the approved ICC testing requirement for supervisor certificate classifications above a Class C. To this point, Mr. Bowman on behalf of Mr. Feyen now seeks a variance to allow Mr. Feyen to be granted a license classification of Class B to allow him to complete the stated projects without satisfying the applicable minimum experience or examination requirements, described below. The following summarizes the scope of work authorized under the Class B and Class D-1 licenses, along with the minimum experience requirements for each: Packet Page 7 Agenda Item 2 Item 2, Page 2 A Class B license authorizes the license-holder to construct, demolish or deconstruct any building or structure in the City regulated under the building code up to and including five (5) stories in height, and including all work authorized by license types below this level. • Minimum Experience Required: To qualify for Class B, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings of occupancy classifications other than Group R, each must have exceeded 20,000 sq. ft. in floor area and/or have been 3-stories in height. A Class D1 license authorizes the license-holder to construct, demolish or deconstruct any building or structure in the City classified by the building code as a Group R, Division 3 occupancy housing not more than two (2) dwelling units, or a Group U, Division 1 occupancy, or townhouses (aka single-family attached) as regulated by the International Residential Code, including all work authorized by residential license types below this level. • Minimum Experience Required: To qualify for a Class D1 license, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings classified as R-3 occupancies (single-family or townhomes). The Exam requirements applicable to each license classification are as follows: General Contractor Class A, Class A-DR, Class B and Class B-DR: • ICC National Standard Building Contractor A Exam G11, over the 2018 IBC; and the Concrete Manual: Concrete Quality and Field Practices 2021 IBC and ACI 318-19 General Contractor Class C1, Class C1-DR, Class C2, Class C2-DR and Class E: • ICC National Standard Building Contractor B Exam G12, over the 2018 IBC/2018 IRC; and the Concrete Manual: Concrete Quality and Field Practices 2021 IBC and ACI 318-19. • ***The ICC National Standard Building Contractor A Exam G11, would also be accepted for the license categories noted above. General Contractor Class D1, Class D2, Class D-DR, Class ER & Class MM (Residential Only Licenses): • ICC National Standard Building Contractor C Exam G13, over the 2018 IRC RELEVANT CITY CODE SECTIONS Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect or professional engineer directly involved in the construction of said project, and said person shall have worked directly with the applicant. (c) Subject to the qualification requirements of § 15-159 and subject to any applicable variances which may have been granted by the Commission pursuant to § 15-156 and provided further that the applicant has not committed any acts described in § 15-162 of this Article without the Commission having first conducted a hearing and having made a determination regarding the applicant's fitness to be granted a Packet Page 8 Agenda Item 2 Item 2, Page 3 license or supervisor certificate, the Building Official shall issue to the applicant the license or supervisor certificate applied for upon receipt of all of the following: (1) Evidence of a passing score on the applicable written examination or equivalent as specified in this Article; Sec. 15-159. - Minimum experience qualifications. (a) Minimum experience requirements for Classes A, A-DR, B, B-DR, C-1, C-1-DR, C-2, C-2-DR, D-1, D-2, D-DR, E, ER and MM general contractor licenses, specialized trade contractor licenses, and associated supervisor certificates as described in § 15-160 are as hereafter provided in this Section. In order to qualify for such minimum experience, all construction and specialized trade installation projects are subject to the Building Official's review and approval for sufficient variety and complexity. All such projects shall have been constructed or installed primarily by, the applicant or under the applicant's direct control. The particular license type and respective required minimum documented experience are described as follows: (3) To qualify for a Class B license or supervisor certificate, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings, each of which must have exceeded three (3) stories in height. (7) To qualify for a Class C-2 license or supervisor certificate, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings classified as Type V construction and of Group R occupancy. At least one (1) such building described herein shall not be less than three (3) stories in height as defined in the building code. (8) To qualify for a Class C-2-DR license or supervisor certificate, the applicant must have acted principally in the role of supervisor for the significant structural repair construction on three (3) buildings of Type V construction, with one (1) building being at least three (3) stories in height. (9) To qualify for a Class D-1 license or supervisor certificate, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) entire buildings classified as R-3 Occupancies (single-family or townhomes). Sec. 15-160. - License classifications; fees; renewals. (a) The particular contractor license required, and corresponding maximum scope of construction authorized under each license is described hereunder: (3) A Class B general contractor license holder shall be authorized to construct, demolish or deconstruct any building or structure in the City regulated under the building code up to and including five (5) stories in height, and including all work authorized by license types below this level. (7) A Class C-2 general contractor license holder shall be authorized to construct, demolish or deconstruct any building or structure in the City classified by the building code as Type V construction and a Group R or a Group U, Division 1 occupancy that does not exceed three (3) stories in height, including all work authorized by license types below this level, and including other ancillary Type V buildings or structures that are associated with a particular multi-family housing project, such as management offices, community and recreation buildings, maintenance buildings and similar uses. (8) A Class C-2-DR Structural Damage Repair/Restoration license holder shall be authorized to make repairs or restoration to: (1) structural damage to any building or structure in the City regulated under the building code classified as Type V construction and a Group R or a Group U, Division 1 occupancy which does not exceed three (3) stories in height; and (2) structural damage to other ancillary Type V buildings or structures that are associated with a particular multiple-unit housing project, including all work authorized by damage repair and restoration license types below this level. (9) A Class D-1 general contractor license holder shall be authorized to construct, demolish or deconstruct any building or structure in the City classified by the building code as a Group R, Division 3 occupancy housing not more than two (2) dwelling units, or a Group U, Division 1 Packet Page 9 Agenda Item 2 Item 2, Page 4 occupancy or townhomes (aka single-family attached) as regulated by the International Residential Code, including all work authorized by residential license types below this level. RECOMMENDATION Staff recommends denial of this request based on the fact the project verifications and testing certificate submitted do not demonstrate the applicant is qualified to perform work authorized under a license classification above Class D-1. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a higher license classification can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the staff recommendation, the Commission may pass a motion to deny the requested variances, which would require the appellant to demonstrate they have satisfied all applicable minimum experience and ICC testing requirements in order to be granted a higher license classification than Class D-1. If the Commission disagrees and feels that a variance to the minimum experience and ICC testing requirements for a higher license classification is reasonable, the Commission may pass a motion to approve the requested variances to the applicable minimum expierence requirements under Code Sections 15-158 and 15-159 and the ICC testing requirement under Code Section 15-158 , which would allow the issuance of a license and supervisor’s certificate above a Class D-1 (in its motion, the Commission will need to identify the specific license classification for which the variances are being granted). It is highly recommended and preferred that all plans and documents be submitted electronically following the process outlined below. This new system allows online public access to code inspections, projects, and permits. Contractors and designers will be able to make applications for permits and projects, submit plans, view and respond to plan review comments and schedule and see inspection results along with paying any fees due, all electronically. Electronic Submittal Requirements: • All digital files shall be Microsoft Windows compatible • Digital documents shall be in PDF format • All sheets shall be oriented so that the top of the page is always at the top of the computer monitor, and to scale. • All text shall be no smaller than 11 point. • All construction documents shall be in one file so the plan reviewer may scroll through the file, and have the ability to view all pages without opening another file. BACKGROUND Judge Netting Mountain West is a company that offers gold course netting installation. The Building Department has received an application packet requesting a Class C1(DR) license and supervisor’s certificate; however, it is incomplete. For the application to be considered complete, the applicant will need to submit three complete project verifications and a certificate deomstrating a passing score on applicable ICC testing. Alternatively, the applicant may obtain a variance to the testing reuirement. The license and supervisor’s certificate required for the types of projects Mr. Ecker would like to complete is a Class C1(DR) due to the pole height, square footage, and/or structural nature of the project. The required license classification description and qualification are below: Class C1(DR): Authorized to add additions to and/or make repairs or restoration to structural damage to any building or structure in the City regulated under the building code that does not exceed 20,000 square feet in floor area and/or three (3) stories in height, including all work authorized by damage repair and restoration license types below this level. • To qualify, the applicant must have performed or acted principally in the role of supervisor for the significant structural repair construction on three (3) buildings of occupancy classifications other than Group R, up to 20,000 square feet in floor area and/or up to three stories in height. To obtain a supervisor’s certificate, an applicant must have received a passing score on an approved examination for the currently adopted building code or other applicable code, or the equivalent of such exam as approved by the Chief Building Official. Issuance of the supervisor certificate sought by Mr. Ecker currently requires a passing G12 ICC testing certificate that covers the 2018 code year. Mr. Ecker now seeks a variance to allow him to be issued a supervisor’s certificate without satisfying this examination requirement. The issue that Mr. Ecker feels is relevant is that the applicable testing covers more than what the company does and needs. They do not build full structures, and the testing covers all aspects of codes required for full structure builds for both residential and commercial. Below is from the International Code Council’s accreditation website. Staff are aware that this testing is more than what Judge Netting Mountain West and Mr. Ecker do, however, there are numerous aspects of the testing that are relevant. (c) Prior to obtaining a supervisor certificate, except as provided otherwise in this Article, an applicant for such certificate shall have passed a written examination administered or approved by the City or the equivalent of such examination as determined by the Building Official. Every applicant who undergoes a written examination administered by the City shall pay a nonrefundable examination fee of seventy-five dollars ($75.) prior to such examination. Any applicant who fails to achieve a minimum score of s eventy-five (75) percent shall be entitled to another examination covering the same license class or specialized trade, provided that the Packet Page 55 Agenda Item 3 Item 3, Page 3 applicant shall not be permitted more than two (2) such examinations within any six -month period unless otherwise approved by the Commission. Alternatively, an applicant may be granted a third such examination within any six-month period upon the applicant demonstrating to the satisfaction of the Building Official adequate preparation for the examination by successfully completing a class or coursework covering the building code or other code as applicable, or the equivalent thereof as approved by the Building Official. The applicant shall pay a nonrefundable re-examination fee of fifty dollars ($50.) for each subsequent examination covering the same license class or specialized trade. Examinations shall be given at a time and place designated by the Building Official. The written examination for a supervisor certificate may be waived by the Building Official provided that the applicant can prove that he or she has passed a satisfactory written examination equivalent in scope to that administered by the City. RECOMMENDATION Staff recommends approval of this request with the following conditions: - License and supervisor’s certificate will be limited to the installation of large scale netting systems only. - Mr. Ecker must satisfy all other application packet requirements under City Code before a license and supervisor’s certificate can be issued, including submission of three satisfactory project verifications to the Building Department. In support of this recommendation, staff finds that Judge Netting Mountain West can show adequate required experience and is comfortable with this company and individual completing the project they have been hired to complete. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the staff recommendation or otherwise feels that a variance to the testing requirement is reasonable, the Commission may pass a motion to approve the requested variance to the testing requirement under Code Section 15-157(c), with or without staff’s recommended condition, which would allow issuance of a supervisor’s certificate to Mr. Ecker without required ICC testing. If the Commission disagrees with the staff recommendation and determines that the applicant has not satisfied the standard for a variance, the Commission may pass a motion to deny the requested variance, which would require the applicant to provide a G12 ICC testing certificate that covers the 2018 code year in order to issue a new supervisor’s certificate.
