Appeal : 2287 The variance would reduce the required street side setback along Myrtle Street from 15' to 10' in order to allow the construction of an outside stairwell for a new basement to be constructed under an existing home. The existing basement walls are crumbling, and the owner would like to construct a stairwell as part of the new, replacement basement. Section 4.8(D)(3)(d), by Dana Christensen, Owner. 530 S. Whitcomb Street. 4. Appeal : 2288 The variance would allow three permanent housing project identification signs to be located along Shields Street, instead of at entrance locations into the housing complex. Specifically, the variance would allow three, 35 sq. ft. per face ground signs on Shields Street—one at the northeast comer of Shields & Wabash, one at the southeast comer of Shields &Arbor, and one on Shields halfway between Arbor& Wabash. The signs would advertise the new Four Seasons Condominium Project. Without a variance, the developer would be allowed a sign at each entrance —one at the entrance off Wabash, one on Century Drive, and one on Arbor. The applicant is proposing that no signs be placed along Century &Arbor in exchange for allowing signage on Shields. There also is little room on the north side to allow the stairwell, and the back yard is used for parking. --- Staff comments: None. Appeal 2288: --- 1020 Wabash Street --- Petitioner: Rick Birdsall, representative of Adcon Signs, Contractor — Zone: MMN --- 3.8.7(C)(1)(f) --- The variance would allow three permanent housing project identification signs to be located along Shields Street, instead of at entrance locations into the housing complex. The applicant is proposing that no signs be placed along Century & Arbor in exchange for allowing signage on Shields. --- Petitioner's statement of hardship: The entrances into the complex are off of minor streets -p -- Wabash, Arbor and Century. Signs at these entrances do not provide adequate identification along Shields Street, which is the major street adjacent to the development, and which is the street upon which visitors, delivery drivers, etc., will be driving on and looking for identification signs. Staff comments: The Board has granted some similar variances in the past to allow apartment complexes to place a sign along the major street bordering the project. These variances have been in instances where the project does not have an entrance off the major street. Sometimes, such a valance has been approved with the condition that no ID sign be allowed at the "actual"entrance into the complex. This particular variance request differs significantly from previous ones in that the applicant is requesting three signs on the major street instead of just one sign, as has historically been requested by previous applicants. This property and surrounding properties are located within the Residential Neighborhood Sign District, wherein sign regulations are more restrictive than regulations for properties that are not within this sign district. It is important to note that the Poudre Valley Plaza shopping center directly to the north of the Four Seasons project is only allowed one sign along Shields Street, and they are complying with the regulations for their property. The applicant in this case is asking for three times as many signs as is allowed for the adjacent commercial project. If the Board chooses to grant this particular variance request, then a precedent might be set, and certainly the commercial project to the north would expect that they could also obtain a variance to allow 3 signs along Shields, instead of the 1 sign that they are allowed. • Other Business: 40. :,R. 1 !
