1 . Roll call.
2 . Appeal 2042. The variance would reduce the required lot width
from 60 feet to 50 feet for a new single family dwelling in
the RL zone. The house will replace the existing home that is
on the lot. Section 29-133 (2 ) by Jim Klein, 804 Alta Vista.
3 . Appeal 2043. The variance would reduce the required side yard
setback along the west lot line from 5 feet to 2 feet in order
to allow a 12 foot addition to the existing garage. The west
wall would line up with the existing west wall of the garage.
The property is located in the NCM zone. Section 29-167 (5 ) by
Edmund C. Secor, 621 Laporte Avenue.
4 . Appeal 2044 . The variance would allow the parking lot for the
new Fire Station #10 to be located between the building and
Timberline Road, when the code requires that parking lots in
the RH zone must be setback from the street a distance equal
to or greater than the building setback. Section 29-492 ( 3) (C)
by Poudre Fire Authority, 2067 Vermont Dr.
5 . Appeal 2045 . The variance would reduce the required side yard
setback along Sherwood Street for this corner lot from 15 feet
to 9 . 5 feet for a one-car garage addition on the north side of
the home. The property is located in the NCM zone. Section
29-167 (5) by Joe Bastian, 428 West Oak Street.

--- The variance would reduce the required lot width from 60 feet
to 50 feet for a new single family dwelling in the RL zone.
The house will replace the existing home that is on the lot.
--- Petitioner' s statement of hardship: The existing house is in
a state of disrepair and can 't be salvaged The Housing
Authority would like to move an existing home onto the lot to
replace the one that is already there. The new house will
comply with all setback requirements. The lot is platted with
' only 50 feet of width and many similar variances have been
granted in this area.
--- Staff comments: This is not an uncommon request in this
subdivision. Four similar variances have been granted within
one block of this lot.

--- Section 29-167 (5 )
--- The variance would reduce the required side yard setback along
the west lot line from 5 feet to 2 feet in order to allow a 12
foot addition to the existing garage. The west wall would
line up with the existing west wall of the garage. The
property is located in the NCM zone.
--- Petitioner ' s statement of hardship: The house has very little
storage area. The addition would allow for a storage area in
the garage and still function as a two-car garage. The
existing wall is already only 2 feet from the lot line, so the
new construction would be no closer than the existing
building. The lot is only 40 feet wide, so it is very narrow.
--- Staff comments: None.

--- The variance would allow the parking lot for the new Fire
Station #10 to be located between the building and Timberline
Road, when the code requires that parking lots in the RH zone
must be setback from the street a distance equal to or greater
than the building setback.
--- Petitioner ' s statement of hardship: The overhead garage doors
for the fire trucks need to be as far away from the
intersection as possible in order to assure adequate emergency
response time. Therefore, they need to be on the west end of
the building and the building needs to be located as far west
as possible. In order to do this, the parking lot must be
located east of the building. The intent of this code
requirement is to preserve the residential streetscape of
areas in the RH zone. However, this area of RH land is not in
a residential neighborhood and the parking lot location will
be similar to other uses nearby.

--- The variance would reduce the required side yard setback along
Sherwood Street for this corner lot from 15 feet to 9 . 5 feet
for a one-car garage addition on the north side of the home.
The property is located in the NCM zone.
--- Petitioner' s statement of hardship: The curb cut and driveway
are existing at this location. If the addition is moved to
the east, then a large, mature tree may need to be removed.
The existing barn/garage will be removed to accommodate a
solar home to the north. The lot is narrow, being
approximately 45 feet at the point where the garage will be
built. A number of the homes to the north are also setback
between 9 and 9 1/2 feet, so this would not change the
character of the street, and the addition will still be 29 . 5
feet from the curb.
