A regular meeting of the Liquor Licensing Authority was held March 20, 2024, via Zoom Link, Chief
Municipal Judge Jill Hueser presiding.

Minutes from February 21, 2024, Liquor Licensing Authority meeting.
Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
March 6, 2024, visiting 14 liquor licensed establishments 2 of which served the underage
operative: a failure rate of 14.28% for the evening.
March 19, 2024, visiting 2 liquor licensed establishments none of which served the underage
operative: a failure rate of 10% for the evening.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 4.55% for 2024.

Liquor Kabinet, 3035 West Prospect Road,
Stipulation Agreement Approved
Woodrow Saunders, representative for Liquor Kabinet, LTD, stated he has had an opportunity to
review the stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $5000 fine in lieu of suspension), with 10 days held
in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to minors
prohibited.
Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for Liquor Kabinet, LTD, dba Liquor Kabinet, 3035 West Prospect Road.

Stipulation Agreement Approved
Israel Cabrera, representative for Alianzaa, LLC, stated he has had an opportunity to review the
stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to surrender it’s hotel-restaurant liquor license for violating Colorado Liquor Code 44-3-
901(6)(b)(I) – sell/serve/distribute liquor after hours.
Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for Alianzaa, LLC, dba Los Muertos Urban Kitchen & Cantina, 1027 West
Horsetooth Road, Suite F103.
Temporary Modification of Premise Application from
Blue Agave Grill, LLC, dba Blue Agave Grill, 2013 South College Avenue, Approved
Brenda Lucio, representative for Blue Agave Grill, LLC, stated this is for their April 13, 2024, 10-year
anniversary celebration.
Chief Municipal Judge Hueser approved the temporary modification of premise application from Blue Agave
Grill, LLC, dba Blue Agave Grill, 2013 South College Avenue.

application will allow expansion of alcohol display area to include wine.

This hearing was continued to the next regular meeting.

Andrew Webb, representative for Bread Fellow, LLC, briefly described the premises. In response to questions
from the Authority, Mr. Webb stated the patio is visible from inside and confirmed that he will post signs that
state “No Alcohol Beyond This Point”.
Mr. Webb briefly described the petitioning process and that the petitions indicate support for this application.
Chief Municipal Judge Hueser adopted Resolution 2024-002 approved the hotel-restaurant liquor license
application from Bread Fellow, LLC, dba Bread Fellow, 247 Linden Street.
New Application from Cinemark USA, Inc., dba
Cinemark Movie Bistro & XD, 335 East Foothills Parkway, #1125, Approved
Brian Proffitt, attorney representing Cinemark USA, Inc., stated he is ready to proceed. Charles Evanson,
General Manager, briefly described the premises, noting where alcohol will be stored. In response to questions
from the Authority and the Assistant City Attorney, Mr. Evanson described how they will make sure that
underage and/or visibly intoxicated patrons.
Patrick Maroney, representative for Alcohol Petitioning Services, briefly described the petitioning process and
that the petitions indicate support for this application.
Chief Municipal Judge Hueser adopted Resolution 2024-003 approving the lodging and entertainment liquor
license from Cinemark USA, Inc., dba Cinemark Movie Bistro & XD, 335 East Foothills Parkway, #1125.
Transfer of Ownership Application from Stone & Flower, LLC, dba
Stoneflower Market & Eatery, 2601 South Lemay, Unit 9, Approved
Kat Reeves, representative for Stone & Flower, LLC, stated that nothing has changed from the previous
owners. She stated that patrons will not see any difference in service. Ms. Reeves stated they do not accept
vertical IDs.
Chief Municipal Judge Hueser approved the transfer of ownership application from Stone & Flower, LLC, dba
Stoneflower Market & Eatery, 2601 South Lemay, Unit 9.

Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
June 17, 2024, visiting 17 liquor licensed establishments 1 of which served the underage
operative: a failure rate of 5.88% for the evening.
June 25, 2024, visiting 20 liquor licensed establishments none of which served the underage
operative: a failure rate of 0% for the evening.
July 11, 2024, visiting 16 liquor licensed establishments none of which served the underage
operative: a failure rate of 0% for the evening.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 5% for 2024.
Show Cause Hearing for Celli, Inc., dba The Coast,
254 Linden Street, Stipulation Agreement Approved
Billy Chelalis, representative for Celli, Inc., stated he has had an opportunity to review the stipulation
agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 25-day suspension, 10 days served (paid $1441.31 fine in lieu of suspension), with 15 days

held in abeyance for 1 year for violating 1 Code of Colorado Regulations 203-2, Rule 47-900(A) –

Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for Celli, Inc., dba The Coast, 254 Linden Street.
Show Cause Hearing for Taqueria Los Comales, LLC, dba
Los Comales, 111 West Prospect Road, Unit A, Stipulation Agreement
Zach Wilson, attorney representing Taqueria Los Comales, LLC, stated he has had an opportunity to
review the stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee
agreed to a 15-day suspension, 5 days served (paid $749.38 fine in lieu of suspension), with 10 days
held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to
minors prohibited.

to review the stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee
agreed to a 15-day suspension, 5 days served (paid $2087.00 fine in lieu of suspension), with 10 days
held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to
minors prohibited.

The Corner Slice, 172 North College Avenue, Suite C, Approved
Bryan Baker, representing CS Pizza FoCo, LLC, briefly described the proposed changes, stating the
patio was visible from inside the restaurant.

Transfer of Ownership Application from Konstruct Brewing, LLC, dba
Konstruct Brewing, 3027 East Harmony Road, Suite 2, Approved
Brian Lackey and Daniel Lackey, representatives for Konstruct Brewing, LLC, briefly described their
background. Mr. Brian Lackey stated that the patio area is visible from inside the brewery. In response
to questions, he described the premises.
Chief Municipal Judge Hueser approved the transfer of ownership application from Konstruct
Brewing, LLC, dba Konstruct Brewing 3027 East Harmony Road, Suite 2.
New Application from RGH Hospitality Ltd., dba
The Neighbor, 144 South Mason Street, Approved
Brian Proffitt, attorney representing RGH Hospitality, Ltd., stated they are ready to proceed. Connor
Garland, representative for RGH Hospitality Ltd., was sworn. In response to questions from the
Authority and Assistant City Attorney Coulehan, Mr. Garland stated they will primarily be an event
center, hosting weddings, concerts, holiday parties, etc. In response to questions from Assistant City
Attorney Coulehan, Alexandra Ruiz, representative for RGH Hospitality, Ltd., gave additional
information to address concerns related to the Lodging and Entertainment class of license.
Laura Lunn, representative for Alcohol Petitioning Services, was sworn and briefly described the
petitioning process, stating that the results indicate strong support for this application.
Chief Municipal Judge Hueser adopted Resolution 2024-006 approving a lodging and entertainment
application from RGH Hospitality Ltd., dba The Neighbor at 144 South Mason Street.

Joshua Dollgener, representative for Collective Vintage, LLC, was sworn. In response to questions
from the Authority and Assistant City Attorney Coulehan, Mr. Dollgener, described the scope and
intent of the business, confirming that they will meet the requirements of a tavern liquor license.
Mr. Dollgener briefly described the petitioning process, referencing the summary that was submitted.
He stated the results show strong support for this application.
Chief Municipal Judge Hueser adopted Resolution 2024-009 approving a tavern liquor license
application from Collective Vintage, LLC, dba Collective Vintage, at 1228 West Elizabeth Street D-1.
New Application from Fort Collins OT Senior Housing OPCO KP6, LLC, dba
Morningstar Senior Living at Old Town at 360 Tenney Court, Approved
Candace Salas, Christine Blatner, and Jacade Ross, representatives for Fort Collins OT Senior Housing
OPCO KP, LLC, were all sworn. Christine Blatner, Operations Services, briefly described the
business, stating this is a new build and that they only recently started moving in last week.
Carol Johnson, representative for Liquor Pros, was sworn and briefly described the petitioning
process. She stated the results indicate strong support for this application.
Chief Municipal Judge Hueser adopted Resolution 2024-010 approving a lodging and entertainment
application from Fort Collins OT Senior Housing OPCO KP6, LLC, dba MorningStar Senior Living
at Old Town, 360 Tenney Court.
New Application from Wayne Corp, LLC, dba
Music City Hot Chicken, 1820 North College Avenue, Approved
Samuel Graf, representative for Wayne Corp, LLC, was sworn. He stated this is a new location for
them. In response to questions from the Authority, Mr. Graf briefly described the premises.
Samuel Graf briefly described the petitioning process, stating the results indicate strong support for
this application.
Chief Municipal Judge Hueser adopted Resolution 2024-012 approving a hotel-restaurant liquor
license from Wayne Corp, LLC, dba Music City Hot Chicken, 1820 North College Avenue.

of the Ride to End Alzheimers event.

Ovations Food Services, LP, dba Canvas Stadium at Sonny Lubick Field, 751 West Pitkin Street.
