Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Regulatory Licensing Specialist Consent Agenda Approved  Minutes from August 21, 2024, Liquor Licensing Authority meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  August 29, 2024, visiting 15 liquor licensed establishments 1 of which served the underage operative: a failure rate of 5.55% for the evening.  September 10, 2024, visiting 15 liquor licensed establishment, none of which served the underage operative: a failure rate of 0%. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 4.58% for 2024. Show Cause Hearing for Suite 152, Inc., dba The Yeti @ The Rec Room, Bldg 23, Suite 152 Old Town Square, Stipulation Agreement Erik Fischer, attorney representing Suite 152, Inc., stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 22-day suspension, 7 days served (paid $4783.36 fine in lieu of suspension), with 15 days held in abeyance for 1 year for violating City of Fort Collins Municipal Code 3-81 – Report of Disturbances. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 20-day suspension, 8 days served (paid $5389.88 fine in lieu of suspension), with 21 days held in abeyance for 1 year for violating Colorado Revised Statute 44-03-901(1)(a) – sale to visibly intoxicated person by employee and Colorado Regulation 47-900(A) – orderliness, loitering, serving of intoxicated persons. Chief Municipal Judge Hueser approved the findings, conclusion and order, accepting the stipulation agreement as presented Ratso Rizzo, Inc., dba Trail Head Tavern, 148 West Mountain Avenue. Transfer of Ownership Application from All In One Market, LLC, dba Magnolia Street Market, 710 East Magnolia Street, Approved Dasia Mula, representative for All In One Market, LLC, stated he will check with the Larimer County Health Department whether or not he needs a food license. In response to questions from Liquor Enforcement Officer Ripsam, he stated the premises will remain the same as the previous owner. Chief Municipal Judge Hueser approved the transfer of ownership application from All In One Market, LLC, dba Magnolia Street Market, 710 East Magnolia Street. Transfer of Ownership Application from M&A Liquors, LLC, dba Fish’s Liquor Mart, 1007 East Harmony Road, Approved Hem Chandra Bhattarai and Chhatra Bhattarai Khatri, both representatives for M&A Liquors, LLC, stated they received training from the previous owner. Chief Municipal Judge Hueser approved the transfer of ownership application from M&A Liquors, LLC, dba Fish’s Liquor Mart, 1007 East Harmony Road. Transfer of Ownership Application from Lu Yu Sushi, Inc., dba Sushi Izumi, 200 West Prospect Road, Approved Ricky Lu and Dan Ling Dong, representatives for Lu Yu Sushi, Inc., briefly described their history with the sale and service of alcohol. Chief Municipal Judge Hueser approved the transfer of ownership application from Lu Yu Sushi, Inc., dba Sushi Izumi, 200 West Prospect Road. Chief Municipal Judge Hueser approved the transfer of ownership application from 28 Holding Limited, dba Sushi-Fi, 921 East Harmony Road, #104. Transfer of Ownership Application from JM Garman, LLP, dba Yocomo Sushi, 822 South College Avenue, Approved Jesus Munguia, representative for JM Garman, LLP, through Translator Yvonne Paez, briefly described the premises. He stated if they add any outdoor area, he will complete a modification of premise application. Chief Municipal Judge Hueser approved the transfer of ownership application from JM Garman, LLC, dba Yocomo Sushi, 822 South College Avenue. New Application from Bas Bleu Theatre Company, dba Bas Bleu Theatre Company, 401 Pine Street, Approved Anaya Echohawk-Flint, representative for Bas Bleu Theatre Company, was sworn. In response to questions from the Authority, Ms. Echohawk-Flint described the premises. Ms. Echohawk-Flint briefly described the petitioning process and that the results show support for this application. Chief Municipal Judge Heuser adopted Resolution 2024-019 approving the lodging and entertainment liquor license application from Bas Bleu Theatre Company, dba Bas Bleu Theatre Company, 401 Pine Street. New Application from Ovations Food Services, LP, dba Ovations at Moby Arena/Bob Davis Hall, 951 West Plum Street, Approved Loren Brown, attorney representing Ovations Food Services, LP, stated they are ready to proceed. In response to questions from Mr. Brown, Shawn Sumstine, General Manager, described the premises, where alcohol is stored, and training for staff. Eva Garretson, representative for LiquorPros, was sworn. Ms. Garretson described the petitioning process and that the results indicate support for this application. Chief Municipal Judge Hueser adopted Resolution 2024-017 approving the Lodging and Entertainment liquor license application from Ovations Food Services, LP, dba Ovations at Moby Arena/Bob Davis Hall, 951 West Plum Street.
