Building Review Commission ITEM 1, ATTACHMENT 1 BRC OCTOBER 31, 2024 MINUTES - DRAFT Packet Page 4 City of Fort Collins Page 2 October 31, 2024 2.JERRY LEMONS, LEMONS HEATING & COOLING – REINSTATEMENT OF SUPERVISOR’S CERTIFICATE REQUEST WITHOUT UPDATED EXAM DESCRIPTION: his license and his supervisor’s certificate to be issued without the required passing International Code Council (ICC) testing certificate of the code year requred for the reinstatement of a supervisor’s certificate. STAFF: Neighborhood Services Marcus Coldiron, Chief Building Official Chair Richards outlined the hearing process. Staff Presentation Russ Hovland, Building Department Chief Plans Examiner, stated Mr. Lemons was an approved contractor and tested under both the 1991 UMC in 2001 and the 2006 IBC. Hovland stated the current ordinance requires an exam with the most recent code, if available, and in this case, someone with an expired license would need to test under the 2018 code. Hovland noted Mr. Lemons’ application packet has been received and reviewed. Applicant Presentation Jerry Lemons, Lemons Heating & Cooling, said he has been in business for nearly 25 years and has held a Fort Collins license for that entire duration. Additionally, he stated he holds licenses in several other area jurisdictions and employs a full-time engineer. He stated he was unaware his Fort Collins license lapsed and commented on the fact that most of his work is in Weld County. Staff Response Hovland stated Mr. Lemons was a licensed contractor until May 23rd, when his license expired. He noted everything in Mr. Lemons’ application packet is complete other than the testing requirement. Hovland stated it is staff’s recommendation that the request be denied and that the test be required. Applicant Response Mr. Lemons stated he has employees in place to take care of issues and noted all area municipalities are under different codes. Commission Questions/Discussion Commissioner Schneider asked if Mr. Lemons has any open permits that are unresolved. Mr. Lemons stated his application packet included the last two permits he held in Fort Collins and stated he has never had any violations or outstanding issues. Commissioner Schneider asked if Mr. Lemons would have needed to update his testing if he hadn’t let his permit expire. Hovland replied he would not have had that requirement. Mr. Lemons stated he did not receive any information from the City about his license expiring and only found out when a contractor attempted to pull a permit. Commissioner Poncelow asked if the engineer employed by Mr. Lemons is current on testing. Mr. Lemons replied he was unsure. Commissioner Dunbar asked Hovland if staff has record of sending expiration notices. Hovland replied in the affirmative. Commissioner Schneider stated notices typically go out about 60 days in advance of expiration. Hovland replied there is a 30-day grace period. David Howell clarified the grace period is actually 60 days. Vice Chair Moscrip asked Mr. Lemons if there is a reason he cannot take the test. Mr. Lemons replied he is in his busy season and having the time to take the test would be difficult. Commissioner Dunbar asked how many permits are currently pending the license reinstatement. Mr. Lemons replied there was only one and he lost that contract, though there may be two others coming forward. Chair Richards stated this is an unfortunate circumstance, though it seems as though the Commission needs to uphold the precedent it has set for other applicants. Commissioner Dunbar stated that while maintaining licenses in several jurisdictions can be difficult, it is important, and that responsibility falls to the contractor. Commissioner Schneider noted Mr. Lemons has held his license for 25 years and having a timing error does not mean he is unqualified to do his job. He stated it is difficult for small business owners to operate right now and expressed support for reinstating the license. Vice Chair Moscrip concurred it is an unfortunate circumstance and commented on his experience as a small business owner. He stated it is important for contractors to keep their licenses current. Commissioner Schneider stated there was only a lapse of a couple months. Commissioner Zimmerman noted there is already a 60-day grace period, and historically the Commission has not deviated from that. He stated a line needs to be set, and the City has set that at 60 days. Chair Richards asked if there is any additional contact from the City once the grace period begins. Howell replied there is no other point of contact after a license expires, just the letter that goes out approximately 60 days prior. Commissioner Zimmerman suggested there should be some communication after a license expires notifying contractors of the grace period. He stated this could provide an impetus to change the notification process and justify an exception in this case with that in mind. Commissioner Poncelow concurred the City could do a better job with notification; however, it remains Mr. Lemons’ responsibility. He asked Mr. Lemons if he has made any changes to how he monitors his licenses. Mr. Lemons replied he has worked with his office manager to place expiration dates on a calendar. Commissioner Dunbar stated it is a courtesy that the City sends out the notification, and when a license is issued, it is clear when it is going to expire. Chair Richards stated no one is questioning Mr. Lemons’ ability to do his work, and there are no outstanding issues. He stated the Commission could strongly recommend that a secondary notification be implemented; however, he stated he is of the opinion that the appeal needs to be denied based on established precedent. Commissioner Dunbar concurred. Chair Richards made a motion that the Building Review Commission deny the requested variance to City Code Section 15-157(c). The Commission finds that based upon the materials presented and discussion on this item: The strict application of Section 15-157(c) would NOT result in peculiar or exceptional practical difficulties or exceptional or undue hardship upon Mr. Lemons; and Mr. Lemons failed to demonstrate that they possess other ITEM 1, ATTACHMENT 1 BRC OCTOBER 31, 2024 MINUTES - DRAFT Packet Page 6 City of Fort Collins Page 4 October 31, 2024 qualifications not specifically listed in City Code Chapter 15, Article V, which qualify them to perform in a competent manner the construction authorized under an HVAC license and supervisor’s certificate. Furthermore, granting this variance would be a substantial detriment to the public good and would impair the intent and purposes of Chapter 15, Article V.Commissioner Dunbar seconded. The motion passed 5-1 with Commissioner Schneider dissenting. Chair Richards noted the decision could be appealed to City Council and requested the City revisit the license expiration notification process. ITEM 1, ATTACHMENT 1 BRC OCTOBER 31, 2024 MINUTES - DRAFT Packet Page 7 Agenda Item 2 Item 2, Page 1 Building Review Commission STAFF Marcus Coldiron, Chief Building Official, Community Development and Neighborhood Services Shar Manno, Manager, Customer Support, Community Development and Neighborhood Services SUBJECT REINSTATEMENT OF SUPERVISOR’S CERTIFICATE REQUEST WITHOUT UPDATED EXAM EXECUTIVE SUMMARY Mr. Jason Brokhausen of Basements Unlimited (previously Tradesmen Remodeling, LLC) is requesting a reinstatement of his supervisor’s certificate to be issued without the required passing International Code Council (ICC) testing certificate of the code year required for the reinstatement of a supervisor’s certificate. BACKGROUND The E(R) license and supervisor’s certificate for Mr. Brokhausen of Tradesmen Remodeling, LLC expired on September 8, 2024. When initially licensed with the City of Fort Collins on December 15, 2015, a ICC W13 exam certificate (covering the 2012 code year) was submitted and accepted. Mr. Brokhausen’s license and supervisor’s certificate previously expired on December 9, 2019, and he completed a reinstatement on September 20, 2020. On November 20, 2024, the Contractor Licensing Team received an application from Mr. Brokhausen to complete a business name change for his company to change the name from Tradesmen Remodeling, LLC to Basements Unlimited; however, it was not accepted due to the packet being incomplete and the license and supervisor’s certificate being expired. Before the Contractor Licensing Team can accept a business name change application for Tradesmen Remodeling, LLC, Mr. Brokhausen will need to complete a reinstatement of his license and supervisor’s certificate. To obtain a reinstated supervisor’s certificate, an applicant must have received a passing score on an approved examination for the currently adopted building code or other applicable code, or the equivalent of such exam as approved by the Chief Building Official. The City of Fort Collins currently follows the 2021 ICC codes. Typically, this would mean that the passing testing certificates required for any new or reinstatment licensing request must cover the 2021 code year. However, due to a lag in ICC making 2021 code year testing available, the Chief Building Official has been allowing acceptance of 2018 code year testing, with some exceptions where the 2015 code year is the only cycle available. Mr. Brokhausen’s passing testing certificate on file covers the 2012 IRC testing; therefore, reinstatement of Mr. Brokhausen’s supervisor certificate will require him to provide a passing G13 ICC testing certificate that covers the 2018 code year. Packet Page 8 Agenda Item 2 Item 2, Page 2 RELEVANT CODE SECTION Sec. 15-157. - Supervisor certificate; fees; examinations; renewals. (c)Prior to obtaining a supervisor certificate, except as provided otherwise in this Article, an applicant for such certificate shall have passed a written examination administered or approved by the City or the equivalent of such examination as determined by the Building Official. Every applicant who undergoes a written examination administered by the City shall pay a nonrefundable examination fee of seventy-five dollars ($75.) prior to such examination. Any applicant who fails to achieve a minimum score of s eventy-five (75) percent shall be entitled to another examination covering the same license class or specialized trade, provided that the applicant shall not be permitted more than two (2) such examinations within any six -month period unless otherwise approved by the Commission. Alternatively, an applicant may be granted a third such examination within any six-month period upon the applicant demonstrating to the satisfaction of the Building Official adequate preparation for the examination by successfully completing a class or coursework covering the building code or other code as applicable, or the equivalent thereof as approved by the Building Official. The applicant shall pay a nonrefundable re-examination fee of fifty dollars ($50.) for each subsequent examination covering the same license class or specialized trade. Examinations shall be given at a time and place designated by the Building Official. The written examination for a supervisor certificate may be waived by the Building Official provided that the applicant can prove that he or she has passed a satisfactory written examination equivalent in scope to that administered by the City. (d)A supervisor certificate may be renewed provided that the biennial fee is paid, and renewal occurs within sixty (60) days following the anniversary date such certificate was issued, and further provided that the adopted building code or other applicable code over which an examination was administered remains in effect at the time of renewal. When such adopted code over which the renewing certificate holder passed an examination has been substantially revised prior to the time of such renewal, the certificate holder must attest and certify, on a form provided by the city, that he or she has received and reviewed a copy of the City's latest amendments or has attended a city-provided training class. The holder of an expired certificate may be reissued such certificate by submitting a new application and paying all applicable fees as set forth in § 15-158. Such applicant shall not be required to pass an examination as prescribed in Subsection (c) above, provided that the adopted building code or other applicable code over which such applicant passed an examination remains in effect at the time the renewed certificate is obtained. RECOMMENDATION Staff recommends denial of this request based on the fact that the applicant has not completed approved ICC code year testing as required for the reinstatement of a supervisor’s certificate under City Code Section 15-157. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a)The Code imposes peculiar or exceptional practical difficulties to the applicant; (b)The Code imposes undue hardship on the applicant; (c)The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. Packet Page 9 Agenda Item 2 Item 2, Page 3 If the Commission agrees with the staff recommendation, the Commission may pass a motion to deny the requested variance, which would require the applicant to provide a G13 ICC testing certificate that covers the 2018 code year in order to reinstate their supervisor’s certificate. If the Commission disagrees and feels that a variance to the reinstatment testing requirement is reasonable, the Commission may pass a motion to approve the requested variance to the testing requirement under Code Section 15-157(c), which would allow Mr. Brokhausen’s supervisor’s certificate to be reinstated without up-to- date ICC testing. My name is Matthew Brede. I am a police officer in Northern Colorado and have known Jason for approximately 5 years. I first met Jason as I was an Elder at Immanuel Lutheran Church in Loveland, Colorado. As an elder, and later the Head Elder at the church, I met him and his family and began our relationship which has grown over the years. I even recruited him to fill the role of an Elder and spiritual leader within the church. The Brokhausen family attended our church regularly and their daughter attended the Elementary School. My wife, Dana Brede, was her 2nd and 3rd grade teacher as well. The family was a wonderful presence in the church. Since our meeting, I also worked with Jason as he was the owner of Tradesman Remodeling. In my professional capacity, I called Jason regarding a sub-contractors employee who had been accused of a theft. Jason worked with me, providing every bit of information regarding the sub-contractor that he knew as well as got me in touch with the employer of the suspect. I was able to take the information and help he provided me to successfully close a case. Jason also told me that he broke ties with that particular subcontractor due to the unsavory behavior. In about 2019, Jason reached out to me and requested me to be an accountability partner as he and his wife were going through a season in their marriage. This was when our relationship became much more personal. Jason asked me to join a bible study that he hosted. We studied the Bible and supported each other in our personal and spiritual journey. As my personal life took a steep turn into stress due to a critical illness, Jason and his family supported me as well. Our relationship became personal to a level I have never had with a friend. After knowing him for many years, I know Jason to be a trustworthy, loving man with a heart of gold and honesty. As a person who has taken an oath to protect our community, I vouch for Jason’s character and honesty. According to the Boards and Commissions Manual, work plans should set out major projects and issues for discussion for the following year. The purpose of this item is to approve the 2025 Annual Work Plan of the Building Review Commission. The Commission may also meet as needed in order to convene special hearings. Staff anticipates that the Building Review Commission will hear several appeals by contractor license applicants who do not strictly meet the qualification criteria specified in the City Code. Under its quasi-judicial review authority, the Commission is empowered to grant variances from such criteria when it determines there are practical difficulties or that an undue hardship would be imposed on the applicant; or, when the Commission determines the applicant has sufficient specialized training, education, or additional relevant experience. The Commission is also empowered to render disciplinary action, including suspension or revocation of regulated contractor licenses, under which any specified infractions listed in the regulations are committed. Additionally, in its code appellate function, the Commission may hear appeals from strict application of the building codes or from an interpretation of the codes by the Building Official. The Commission will continue to hear cases involving challenges to the Building Official’s interpretation of the adopted building codes, as well as the adopted International Property Maintenance Code (IPMC). In its advisory capacity, the Commission is expected to participate as a member of the Code Adoption Review Committee in the review of the international series of codes. The Commission will be asked to make recommendations to Council regarding any suggested revisions based on local conditions and community priorities. 2025 Agenda: 1.) Adoption of the 2024 International codes. a.Code Adoption Review Committee will be re-established in Q1 2025. b.Present to Boards and Commissions throughout late spring & summer 2025. c.Present to Council for adoption by the end of 2025.
