Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Regulatory Licensing Specialist Consent Agenda Approved  Minutes from March 20, 2024, Liquor Licensing Authority meeting.  Minutes from June 4, 2024, Liquor Licensing Authority meeting.  Minutes from July 17, 2024, Liquor Licensing Authority meeting. Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  June 17, 2024, visiting 13 liquor licensed establishments 1 of which served the underage operative: a failure rate of 7.69% for the evening. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 5.13% for 2024. Show Cause Hearing for After 8 Smoke Shop, LLC, dba After 8 Smoke and Liquor, 4032 South College Avenue, Stipulation Agreement Greg Carter, attorney representing After 8 Smoke Shop, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, 5 days served (paid $749.38 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to minors prohibited. Chief Municipal Judge Hueser approved the temporary modification of premise from Ovation Food Services, dba Canvas Stadium, 751 West Pitkin Street. Change in Location from Shellabella Enterprises, Inc., dba Domenic’s 921 East Harmony Road, Unit A101, Approved Brian Tessari, representative for Shellabella Enterprises, Inc., briefly described the premises. In response to a question from the Authority, Mr. Tessari stated that they are able to see the patio from inside the restaurant. Chief Municipal Judge Hueser approved the change in location from Shellabella Enterprises, Inc., dba Domenic’s 921 East Harmony Road, Unit A101. Transfer of Ownership application from JM Garman, LLP, dba Yocomo Sushi, 822 South College Avenue, Unit 150 Failed to appear. New Application from Timberline Nails and Lashes, LLC, dba Royce Spa, 2203 South College Avenue, Unit 150, Approved Vinh Nguyen, representative for Timberline Nails and Lashes, LLC, was sworn. Carol Johnson, representative for Liquor Pros, briefly described the petitioning process, stating that the results indicate strong support for this application. Mr. Nguyen briefly described the premises, stating the alcohol is locked and that employees will be required to have completed TIPs or equivalent training in order to serve their customers. Chief Municipal Judge Hueser adopted Resolution 2024-014 approving the hotel-restaurant liquor license application from Timberline Nails and Lashes, LLC, dba Royce Spa, 2203 South College Avenue, Unit 150. In response to questions from Assistant City Attorney Coulehan, Mr. Tand briefly described the premises, confirming that all areas depicted on the diagrams are connected. Chief Municipal Judge Hueser adopted Resolution 2024-015 approving the hotel-restaurant liquor license application from Slyce Pizza Co, 163 West Mountain Avenue. New Application from Carnalitos, LLC, dba Zocalo Cocina Y Cantina, 1027 West Horsetooth Road, Unit 111, Denied Froylan Martinez, representative for Carnalitos, LLC, was sworn. Mr. Martinez briefly described the petitioning process. Geri Sandoval, representative for GOAL Academy High School, Assistant Director for Operations, was sworn. In response to questions from Assistant City Attorney Coulehan, Ms. Sandoval, described the how this school is conducted. Damien Wilson, Lead Building Inspector, stated they have received an application for a change in occupancy, but that it has not been approved yet. In response to a question from Assistant City Attorney Coulehan Mr. Wilson stated he would make the final decision regarding the occupancy. Mr. Brian Proffitt made his closing arguments. Assistant City Attorney Coulehan made her closing arguments. Chief Municipal Judge Hueser found that the school located within 500 feet of Carnalitos, LLC, dba Zocalo Cocina Y Cantina, 1027 West Horsetooth Road, Unit 111 meets the requirements of a school as stated in the Colorado Revised Statutes and that the license cannot be issued.
