DAWN SPIKER, HAHN PLUMBING & HEATING, INC. - REQUEST FOR VARIANCE TO COMPLETE WORK OUTSIDE OF LICENSE LEVEL DESCRIPTION: Ms. Dawn Spiker of Hahn Plumbing & Heating, Inc. is requesting a variance to the allowable scope of work of the currently held HVAC(RR) supervisor’s certificate. STAFF: Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official Chair Richards outlined the hearing process. Dawn Spiker introduced herself as the business manager and supervisor for Hahn Plumbing and Heating. Staff Presentation Shar Manno stated this request is for a variance to complete work outside of a currently held license level, which is currently HVAC(RR). The request is for work that will fall under either an HVAC(C) or an HVAC(R) license, neither of which can currently be granted due to the lack of qualified project verifications. Manno outlined the work that can be done under Ms. Spiker’s current license which allows for repair and replacement of like equipment. Manno stated staff is recommending approval of this request based upon evidence provided indicating Ms. Spiker has the knowledge to install new mini-split systems along with the condition that three project verifications for new, completed mini- split installations are provided. Manno outlined the items that should be considered by the Commission. Applicant Presentation Ms. Spiker stated it is more complicated to do a commercial retrofit, which is allowed by the current RR license, than to install a new mini-split system, which is entirely ductless. Additionally, Ms. Spiker noted Hahn brings in licensed electricians for any type of electrical work. Staff Response Manno stated Ms. Spiker’s description of the work leads her to believe approval can still be granted. Applicant Response Ms. Spiker asked how she is to provide the three project verifications given the fact that she cannot do mini-split installations with her current license, and she cannot do work for any other contractor. Commission Questions/Discussion Commissioner Zimmerman asked if Ms. Spiker could submit residential installations of mini-split systems, residential installations of a heat pump system, or residential installations of furnaces with air conditioners as project verifications. Manno replied project verifications include work that has been completed with a passing inspection; in this case, that would be three mini-split installations that have been completed and permitted from any company the individual has worked for in the past. If this variance to Ms. Spiker’s RR license is granted, she would be able to install residential or commercial mini-split systems as a variance; she would not be granted a new license type. Commissioner Zimmerman asked Ms. Spiker if she is able to meet those requirements for project verification. Ms. Spiker replied in the negative noting she does not currently hold the proper license for new installations for either residential or commercial projects. Ms. Spiker replied she has completed multiple retrofit projects for residential air conditioning and furnaces. Commissioner Poncelow asked if the current license allows Ms. Spiker to replace a mini-split system. Manno replied that the RR license would allow for that. Commissioner Dunbar asked if the RR license allows for the installation of a new condensing unit in a house that currently only has a furnace. Manno replied that is considered to be a new component; therefore, that installation would fall under the R license. Commissioner Dunbar asked if Hahn Plumbing works in jurisdictions other than the City of Fort Collins. Ms. Spiker replied in the affirmative. Commissioner Dunbar asked Ms. Spiker if her license is the same or similar in the other jurisdictions. Ms. Spiker replied in the affirmative. Commissioner Poncelow stated mini-split system installations do seem to be significantly less complicated. He asked if the Code has not kept up in terms of the fairly new technology. Marcus Coldiron, Chief Building Official, replied mini-split systems are quite a bit simpler than a full HVAC installation. He stated the contractor licensing code has not been updated since 2012; therefore, there is some work to be done in that realm. Additionally, he stated there is more concern from a code standpoint when dealing specifically with new commercial installations as opposed to new residential installations. Ms. Spiker noted Hahn’s primary clientele is residential and therefore she would be fine with the granting of a variance for only residential mini-split installations. Commissioner Dunbar asked about the type of training that is required for installing mini-split systems. Ms. Spiker replied installers do trainings with the manufacturers. Chair Richards asked if Ms. Spiker would be able to provide some documentation showing staff has completed that training. Ms. Spiker replied she would check with the manufacturers to see if they have certificates. Chair Richards asked if Ms. Spiker is seeking to install only new mini-split systems. Ms. Spiker replied in the affirmative and noted Hahn is solely a service company and does not work with new construction. Chair Richards asked about the City inspection process for residential mini-split systems. Coldiron replied inspectors walk through the entire system, including any new or existing wall penetrations and the electric system. He noted ducted mini-split systems are made and questioned whether Ms. Spiker’s request would allow for the installation of those systems, which are more complex. Commissioner Zimmerman expressed concern about allowing for a variance for the existing license given the number of systems available. He stated he has full confidence that the applicant is competent to install mini-split systems but questioned the best way to accomplish allowing that. Manno stated staff’s intent was to add the variance to the current license, not to grant an R license as it is completely different. Manno stated the City’s permit system can include a condition notice that lets the permit technicians know that the variance was granted for this specific item. Coldiron noted the Commission would be able to establish the variance as strictly or broadly as desired. Commissioner Zimmerman asked if Hahn has commercial clients. Ms. Spiker replied the company is seeking to be able to install ductless residential mini-split systems only. Commissioner Schneider stated installing a new ductless system is no different than replacing an existing HVAC system and stated he has no concerns about allowing a variance for residential ductless systems. Commissioner Dunbar made a motion, seconded by Commissioner Poncelow, that the Building Review Commission grant the requested variance to the allowable scope of work for an HVAC(RR) supervisor’s certificate under City Code Section 15-160(d) to allow Dawn Spiker to install new mini-split systems with their currently held HVAC(RR) supervisor’s certificate, finding that granting this variance would not be a substantial detriment to the public good or substantially impair the intent or purposes of Chapter 15, Article V, and Dawn Spiker has demonstrated to the satisfaction of the Commission that they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which the Commission has determined qualifies them to perform the installation of new mini-split systems in a competent manner. The motion passed 5-0. 3. ERIC VAN DIXHORN, NOCO OUTDOOR LIVING DBA ARCHADECK OF NORTHERN COLORADO - REQUEST FOR HIGHER LICENSE CLASSIFICATON THAN GRANTED DESCRIPTION: Mr. Eric Van Dixhorn of Noco Outdoor Living dba Archadeck of Northern Colorado is requesting that he be granted a higher license classification than he was originally granted. STAFF: Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official Eric Van Dixhorn introduced himself. Chair Richards outlined the appeal process. Staff Presentation Shar Manno stated this is request for a higher license classification than what was originally granted, which was a class ER license and supervisor’s certificate based on the experience Mr. Van Dixhorn provided. Mr. Van Dixhorn is seeking a class D2 license and supervisor’s certificate which would allow him to move into completing additions to homes. Manno noted Mr. Van Dixhorn has vast experience in building large capital projects, primarily bridges; however, despite that experience, it was difficult for staff to connect it to home building. Manno stated the E(R) license allows for non- structural residential work and stated staff is requesting denial based on the lack of permitted residential experience; however, she requested the Commission offer some guidance on the issue. Applicant Presentation Mr. Van Dixhorn discussed the work done by Archadeck noting it is part of a larger franchise which has 60 locations throughout the country. He stated the class E(R) license does cover most of the projects he is anticipating; however, he would like to be able to build two-story decks as well as small additions which would require a class D2 license. He discussed his education and experience as a civil engineer. He stated structural work on additions is similar to, though simpler than work he has completed on bridges. Staff Response Manno commended Mr. Van Dixhorn’s application package. Assistant City Attorney Shehan noted the Commission should view the appeal as a request for a variance to the minimum experience requirements for a D2 license as the Commission does not have the authority to grant a license. Commission Questions/Discussion Commissioner Dunbar asked Mr. Van Dixhorn if he has any completed projects in Fort Collins. Mr. Van Dixhorn replied in the negative noting the business is just launching. Chair Richards asked Mr. Van Dixhorn if the parent company provides support or oversight. Mr. Van Dixhorn replied there is a full support team based out of Richmond which includes a director of engineering and drafting and a director of construction. He noted Archadeck will be providing all the plans and drawings for the permits and stated the company will send employees to Fort Collins to ensure early, more complicated projects are completed properly. Additionally, Mr. Van Dixhorn stated he has spoken with a licensed engineer in Fort Collins who has agreed to provide assistance as necessary. Chair Richards asked if Mr. Van Dixhorn will be self-performing most of the work or hiring subcontractors. Mr. Van Dixhorn replied he will be hiring licensed subcontractors starting out. Commissioner Schneider requested staff clarify the testing requirements for an E license versus a D. Manno replied it is the same level of testing. Commissioner Poncelow asked if Mr. Van Dixhorn currently holds a civil engineering license in Colorado. Mr. Van Dixhorn replied he never applied for a civil engineering license in the state. Commissioner Schneider asked Mr. Van Dixhorn if he holds licenses in any other municipalities. Mr. Van Dixhorn replied in the negative but stated he plans on applying for those licenses at some point, though most of his work will be in Fort Collins. Commissioner Schneider noted some area municipalities do not have the same requirements as Fort Collins and getting a license there may open the door for Mr. Van Dixhorn to complete projects to provide as verification for Fort Collins. Commissioner Dunbar stated Mr. Van Dixhorn clearly has the expertise to complete the type of work mentioned; however, he expressed concern about the lack of completed projects and stated he would be more likely to allow a variance if there were some completed projects to review, even if they were completed under the E license. Chair Richards concurred and expressed concern Mr. Van Dixhorn has yet to complete any projects under the license he currently holds. Mr. Van Dixhorn requested clarification as to what types of projects would require a D2 license, specifically asking if it would be required for the addition of a three-season room which is essentially a deck with a structure around it. Manno replied that would not fall under the existing license as the ER is considered a non-structural residential license classification, though it includes decks, pergolas, and unenclosed structures. The D2 license would allow for construction of multi-story decks and stairs as well as additions to residential structures. Mr. Van Dixhorn asked about a screened porch. Manno replied it would fall under the ER license. Mr. Van Dixhorn commented on his experience building stairways as part of bridge construction and asked if that experience could be used to allow him to construct two-story decks. Commissioner Schneider stated Mr. Van Dixhorn seems to have technical knowledge and experience; however, adding on to homes is different from building large capital projects. He stated he would be comfortable with a condition of approval to add two-story decks and stairway connections to the existing license. Manno stated that would be reasonable from a staff perspective. Chair Richards noted the Code language around project verification does make it challenging for individuals to primarily work in Fort Collins and asked if staff is looking to make any alterations to ITEM 1, ATTACHMENT 1 BRC JUNE 27, 2024 MINUTES - DRAFT Packet Page 8 City of Fort Collins Page 6 June 27, 2024 that requirement. Manno replied discussions have been ongoing as to whether there is potential for a mentorship program; however, the current thinking is that Fort Collins is experience-based which is why project verification is currently required. Chair Richards asked about the Archadeck employees that may assist with projects. Mr. Van Dixhorn replied those individuals would be available to him as he is starting out and stated he is very comfortable asking questions and will not cut corners. Commissioner Poncelow asked if the D2 license would allow for the construction of a new house. Manno replied in the negative and stated the license would allow for the construction of additions up to 1,000 square feet. Coldiron noted the D2 license would also allow for any structural repairs or modifications to an existing single-family or duplex. Commissioners discussed the best way to move forward in terms of motions. Commissioner Poncelow made a motion, seconded by Commissioner Zimmerman, that the Building Review Commission deny the requested variance to City Code Section 15- 159(a)(10). The Commission finds that based upon the materials presented and discussion on this item: The strict application of Section 15-159(a)(10) would not result in peculiar or exceptional practical difficulties to or exceptional or undue hardship upon Eric Van Dixhorn; and Eric Van Dixhorn failed to demonstrate that they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which qualify them to perform in a competent manner any construction authorized under the D-2 license classification sought. Furthermore, granting this variance would be a substantial detriment to the public good and would impair the intent and purposes of Chapter 15, Article V. The motion passed 5-0. Commissioner Poncelow made a motion, seconded by Commissioner Schneider, that the Building Review Commission grant the requested variance to the minimum experience requirements under City Code Section 15-159(a)(10) with respect to Eric Van Dixhorn’s request to allow construction of two-story decks under the current license classification of ER. The Commission finds that granting this variance will not be a substantial detriment to the public good or substantially impair the intent and purposes of Chapter 15, Article V, and Eric Van Dixhorn has demonstrated to the satisfaction of the Commission that they possess other qualifications not specifically listed in City Code Chapter 15, Article V, which the Commission has determined qualifies them to perform in a competent manner any construction authorized under the ER, including two-story decks. Assistant City Attorney Shehan clarified the Commission is seeking to increase the scope of work allowed under the E® license, which is related to City Code Section 15-160. Commissioner Poncelow made an amendment to his motion to replace City Code Section 15-159(a)(10) with City Code Section 15-160(c)(13). Commissioner Schneider accepted the amendment. The motion passed 5-0. • OTHER BUSINESS Coldiron provided an update on the 2024 Building Code adoption noting the first Building Code adoption committee meeting was held at the beginning of the month. He noted ICC has yet to release the International Energy Conservation Code; therefore, the committee has opted to delay the work of adopting the new Building Codes until that Code is released. ITEM 1, ATTACHMENT 1 BRC JUNE 27, 2024 MINUTES - DRAFT Packet Page 10 Agenda Item 2 Item 2, Page 1 STAFF REPORT July 25, 2024 Building Review Commission STAFF Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official SUBJECT REQUEST FOR VARIANCE TO PROJECT VERIFICATIONS REQUIRED FOR A NEW LICENSE AND SUPERVISOR’S CERTIFICATE EXECUTIVE SUMMARY Mr. Barry Hall of Palmer Construction is requesting a variance to the project verification requirement to obtain a license and supervisor’s certificate. BACKGROUND The City Code requires that an applicant for a license or supervisor’s certificate provide documents to verify that he or she has acted in the principal role of contractor and primary project supervisor on at least three projects. However, it is not possible to satisfy the letter of this requirement by relying on projects that were completed within the City of Fort Collins because the license/supervisor certificate itself is required to serve as a contractor or project supervisor in the first place. Mr. Hall recently applied for a new Class C1 license and supervisor’s certificate on April 8, 2024. His application listed two (2) project verifications from within the City of Fort Collins, on which Paul Brinkman was the principal contractor and supervisor’s certificate holder. Mr. Hall was affiliated with Mr. Brinkman, and the two may have worked together on these projects. Nevertheless, the application does not satisfy the letter of the code section and was therefore denied. Mr. Hall now appeals the denial. He is applying for a variance from the project verification requirement so that he can use projects on which he was not principal contractor or supervisor to satisfy the requirement. RELEVANT CITY CODE SECTIONS Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect or professional engineer directly involved in the construction of said project and said person shall have worked directly with the applicant. Packet Page 11 Agenda Item 2 Item 2, Page 2 RECOMMENDATION Staff recommends denial of Mr. Hall’s appeal to use two City of Fort Collins projects as verification. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. Here, based on his application materials, Mr. Hall cannot strictly comply with Section 15-158. He has no contractor license or supervisor’s certificate and therefore cannot demonstrate that he ever served as a principal contractor or supervisor on any projects within the City of Fort Collins. His application materials list one project outside City limits. However, staff is cognizant of the difficulty Section 15-158 imposes on new entrants to this industry, however, Mr. Hall is no longer a new entrant into the industry and based upon submitted material by the appellant, it does appear that there is experience outside of the City of Fort Collins that would qualify Mr. Hall for a lower license classification. Though staff cannot recommend a variance here, it does recommend that the BRC carefully consider the substance of Mr. Hall’s experience in deciding this matter. ATTACHMENTS 1. Appeal Form 2. VARIANCE TO COMPLETE WORK OUTSIDE OF LICENSE LEVEL EXECUTIVE SUMMARY Mr. William Davis and representatives Mr. Gregory Knapp and Mr. Jacob Baca of Groundworks Colorado, LLC dba Complete Basement Systems are requesting a variance to the allowable scope of work for the currently held Class D1 license and supervisor’s certificate. BACKGROUND Mr. Davis currently holds a Class D1 license and supervisor’s certificate for Groundworks Colorado, LLC dba Complete Basement Systems. The license and supervisor’s certificate were approved and issued on April 24, 2023. The approval and issuance were based upon the submitted project verifications and testing. At the time of application submittal, it was determined that a Class D1 license and supervisor’s certificate could be granted. On May 7, 2024, Mr. Knapp and Chief Building Official Coldiron had a conversation in regard to permit B2402971 for property address 225 E. Skyway Drive and if the hold that is currently in place could be lifted resulting in a permit issuance. Property background: - The structure was built in 1988 as a residential single-family home. - And, at that time it was located in the Larimer County Tax District. - In the year 2006 the property was annexed into the City of Fort Collins Tax District as part of the Southwest Enclave, Phase One Annexation. - Mr. Coldiron was told that at the time of annexation, the property was operating as a childcare facility and that Planning has deemed the use as legal non-conforming and that if the use does not change, continued use as a childcare facility is approved. Staff was unable to locate any formal agreement for this specific property. - The property is currently operating as a stand-alone childcare facility, not a primary residence with an approved business. Per the Larimer County’s Assessors website, 225 E Skyway Dr. carries the property type of residential with an occupancy type of school – classroom. With this classification and per building and licensing code, the contractor would need at a minimum a Class C1(DR) license and supervisor’s certificate to complete the scope of work hired to complete. Mr. Davis, Mr. Knapp, and Mr. Baca appeal to the commission to allow the installation of 3 push piers on the SE stair foundation to help mitigate future vertical movement and install 6 wall anchors on the east basement foundation wall to help mitigate lateral movement. Packet Page 64 Agenda Item 3 Item 3, Page 2 RELEVANT CITY CODE SECTIONS Section 15-160 – License classifications; fees; renewals (d) A specialized trade contractor license and a specialized trade contractor supervisor certificate shall be required for any contractor performing any specialized trade listed herein. Prior to any specialized trade supervisor being issued a supervisor certificate, the applicant for such certificate shall successfully complete a written examination as provided in § 15-157, or the applicant shall provide proof of equivalent technical qualification as determined by the Building Official. Applicants for a specialized trade contractor license or a specialized trade contractor supervisor certificate shall submit an application and documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed specialized trade projects as set forth under § 15-158 of this Article. Each specialized trade contractor license regulated under this Article is listed and described hereunder with respect to the scope of work authorized by each such license as follows: Class D1: Authorized to construct, demolish or deconstruct any building or structure in the City classified by the building code as a Group R, Division 3 occupancy housing not more than two (2) dwelling units, or a Group U, Division 1 occupancy, or townhouses (aka single-family attached) as regulated by the International Residential Code, including all work authorized by residential license types below this level. Class C1(DR): Authorized to add additions to and/or make repairs or restoration to structural damage to any building or structure in the City regulated under the building code that does not exceed 20,000 square feet in floor area and/or three (3) stories in height, including all work authorized by damage repair and restoration license types below this level. RECOMMENDATION Staff recommends approval for a one-time variance to be granted based upon Chief Building Official Coldiron’s assessment in that this structure was built as a single-family dwelling and even though it is now classified as a childcare facility, the structure has not been altered past a single-family residence. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the recommendation, the Commission may pass a motion to allow a one-time variance to the currently held Class D1 licanse and supervisor’s certificate to complete the stated scope of work to complete the installation of 3 push piers on the SE stair foundation to help mitigate future vertical movement and install 6 wall anchors on the east basement foundation wall to help mitigate lateral movement. If the Commission disagrees with the recommendation, the Commission may pass a motion to deny the appellant’s request. and WHEREAS, the unincorporated area described on Exhibit "A," attached hereto and incorporated herein by this reference (the "Southwest Enclave"), has been entirely surrounded by and contained within the boundaries of the City of Fort Collins for a period of more than three years; and WHEREAS, the Cityhas entered into an intergovernmental agreement with LarimerCounty, Colorado, dated November 21, 2000, which states, in Section 8(D) thereof, that the City will pursue the annexation of enclaves within the City's boundaries as such enclaves become eligible for annexation; and WHEREAS, the annexation of enclaves promotes the orderly progression of urban -level development in the enclaves in a manner that is consistent with the City's master plans, allows for the cost-effective delivery of services to the enclaves, and ensures that those who benefit from City services help pay for those services; and WHEREAS, for the foregoing reasons, it is important that the City pursue the annexation of the Southwest Enclave; and WHEREAS, the City Council has approved various measures, some of which involve amendments to the City Code, in order to accommodate various concerns of the residents and property owners in the Southwest Enclave, which measures include covering with reserve funds a substantial portion ofthe state -mandated service rights fees for customers ofthe Poudre Valley Rural Electric Authority ("PVREA"), undergrounding electric utilities at no cost to property owners, phasing in monthly stormwater utility fees over a five year period, allowing barbed wire and electrically charged fences in certain zone districts, changingthe amortization period from five years to seven years for nonconforming signs, and changing the licensing requirements for businesses that qualify as second hand dealers and flea markets: and WHEREAS, as the Southwest Enclave is annexed, the City is committed to providing the same high level of services to residents and property owners within said enclave as it provides to those who reside or own property in other parts of the City; and WHEREAS, accordingly, the City Council believes it to be in the best interests of the City to annex the Southwest Enclave in phases, so that, over time, the City will be better able to manage the costs of providing such services to the area without compromising its financial well being of the City or the provision of services to other areas of the City; and WHEREAS, after receiving various reports and recommendations from City staff, the City Council has detennined that the portion of the Southwest Enclave known as the South College Frontage Area, which is described as "Phase One" on Exhibit " B," attached hereto and incorporated herein by this reference, should forthwith be annexed as the first phase of the Southwest Enclave annexation because: a) it forms the southernmost entrance to the City, which makes it imperative that the City begin to apply its land use standards, including design standards, to the area in order to create an attractive gateway to the City and to promote the economic development of the City; b) it generates significantly more tax revenues than the rest of the Southwest Enclave because development in the area is primarily commercial, which means that the revenues from the area will make it more feasible for the City to fund and provide critical services to the area, such as police services; c) it generally has a higher crime rate than the rest of the Southwest Enclave, which makes the provision of urban level law enforcement services in the area more time sensitive than in the rest of the enclave; and d) it requires fewer city -funded amenities such as recreational and cultural facilities because of its non-residential nature; and WHEREAS, the annexation of subsequent phases of the Southwest Enclave should be finalized as soon as, in the judgment of the City Council, the City can absorb the costs associated with annexing such phases without jeopardizing the financial condition of the City or the provision of services to other areas of the City, and as soon as the City's Electric Utility is in a position to extended utility services to areas contained within such phases in a logical and sequential fashion; and WHEREAS, in order to accomplish these objectives within a reasonable period of time, the City Manager has recommended to the Council a tentative time frame for such phased annexation, together with criteria for determining the precise point in time when the annexation of various phases of the Southwest Annexation should take effect; That, if the City Manager believes that the filing of the annexation map for a particular phase should be expedited in order to allow for the orderly, sequential extension of electric utility infrastructure throughout the Southwest Enclave, or to ensure that any significant proposals for the development or redevelopment of property within said enclave are reviewed under all relevant City land use regulations, then the City Manager may request that the City Council modify Exhibit C" accordingly. That, within forty-five (45) days after the recording of each annexation map for Phases Two through Four, the City Manager shall notify all property owners within such phase of the recording of said map and the fact that the annexation of such phase has taken effect. Said notice shall be mailed to the then current address of each such property owner as shown in the records of the Larimer County Assessor's office. Failure to send any such notice shall not invalidate the annexation of the area contained within such phase. Section 4. That the areas contained within each phase of the Southwest Enclave Annexation shall be placed within a zone district in the City by ordinance of the Council no later than ninety (90) days after the date of recording of the annexation map for such phase with the Larimer County Clerk and Recorder, following such notice as may be required by law. That upon annexation, the service rights fee for all existing PVREA services transferred within the Southwest Enclave as applicable pursuant to paragraphs (h) of Section 26-464, i) of Section 26-465, 0) of Section 26-466, (1) of Section 26-467, (m) of Section 26-468, and (d) of Section 26-469 of the Code of the City of Fort Collins, shall be five (5) percent of the total of all charges for electric power service, and shall continue and be applicable to any property so annexed until such time as the city has fulfilled any associated statutory obligation for payment to PVREA. BACKGROUND Mr. Epperson is returning to the Building Review Commission, as requested by the Commission, providing a letter and new examples of projects he claims he was the on-site supervisor for. He continues to request a Class D1 license and supervisor’s certificate. The Commission requested that the projects be of more recent work: -4588 Ingalls Dr. – No project verification form attached (referenced in letter), permit attached, yes, CO attached, yes. Permit date 2015 The previously submitted project verifications were from 2013 and 2014 respectively. RELEVANT CITY CODE SECTIONS Sec. 15-158. - Applications; review; issuance. (a)Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2)Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect or professional engineer directly involved in the construction of said project and said person shall have worked directly with the applicant. Packet Page 156 Agenda Item 4 Item 4, Page 2 RECOMMENDATION Staff recommends denial of the request for a Class D1 license and supervisor’s certificate based on commission conversation and responses to experience questions from the May 2024 hearing. However, Staff does recommend approval of a Class D1(DR) license and supervisor’s certificate which would allow Mr. Epperson the ability to build decks, finish basements, and complete small additions to residential homes. This is based on the experience he was able to speak to and staff is comfortable issuing this licensing level. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a license and supervisor’s certificate can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code.
