Box 580 * Fort Collins, Colorado 80522-0580 CITIZEN REVIEW BOARD (970) 416-2707 crb@fcgov.com Citizen Review Board Subcommittee Meeting Minutes Zoom Meeting March 9, 2022 Case PSU 2021-043 Present:Mark Partridge, Subcommittee Chair; Beth Grant, Subcommittee Member; Melissa Rosas, Subcommittee Member; Shamera Loose, Alternate Member Absent:None Staff:Jenny Lopez-Filkins, Senior Assistant City of Fort Collins Attorney Adam McCambridge, Fort Collins Police Services Criminal Investigation Unit Lieutenant Kim Cochran, Sergeant, Internal Affairs, Fort Collins Police Services Sara Lynd, Lieutenant, Fort Collins Police Services Call to Order: The subcommittee meeting was called to order at 7:07 p.m. by Chairperson Mark Partridge. It was noted that there were no citizens or other attendees and no absences. Case PSU 2021-043:Mark Partridge advised that pursuant to the provisions of Sections 2-138 et seq. of the Code of the City of Fort Collins, the Citizens Review Board Subcommittee would undertake a review of an internal investigation conducted by the Office of Police Services, Case No.PSU 2021-043. Executive Session: Prior to entering Executive Session.At 7:20 p.m. a motion made by Melissa Rosas, As authorized by City Code sections 2-71(d)(2), 2-31(a)(1) b., and 2-31(a)(2) as well as Colorado Revised Statutes sections 24-6-402 (4)(f) and 24-6-402 (4)(b), I move to go into executive session for the purpose of receiving and considering evidence relating to internal investigation number PSU 2021-043 conducted by Police Services, and for the purpose of meeting with the City Attorney to receive legal advice regarding the manner in which the subcommittee’s actions may be affected by existing law. Please note that no formal action or decision will be made in executive session, motion was seconded by Beth Grant, and unanimously approved by the committee. Executive Session:Called to order at 7:23 pm for comments. Adjournment: A motion was made by Melissa Rosas, seconded by Mark Partridge, and approved unanimously to adjourn at 8:38 p.m. Continuation of the subcommittee meeting was scheduled for 3 PM EST on March 11, 2022. It was noted that there were no citizens or other attendees and no absences. For the allegation of: 1. Expectations of Conduct, Policy 340.3 Conduct that May Result in Discipline ●(m) Use of unnecessary force in the performance of duty or the mental or physical abuse of any person in custody. Melissa Rosas put forth a motion to exonerate the officer, Mark Partridge seconded the motion. The motion was unanimously approved. The subcommittee voted to disagree with the finding of sustained made as a result of the Fort Collins Police Services Internal Affairs investigation. After review, the subcommittee voted with the finding of exonerated. 2. Expectations of Conduct, Policy 340.3 Conduct that May Result in Discipline ●(r) Any conduct by an employee on or off-duty that tends to impair the effectiveness, efficiency, or morale of the Agency, may cause the public to lose confidence in the police department, violates the public trust or negatively affects the reputation of the Agency or any employee. Melissa Rosas put forth a motion to exonerate the officer, Mark Partridge seconded the motion. The motion was unanimously approved. The subcommittee voted to disagree with the finding of sustained made as a result of the Fort Collins Police Services Internal Affairs investigation. After review, the subcommittee voted with the finding of exonerated. Mark Partridge put forth the motion, recommending additional role play training scenarios, like this incident, be provided to all officers in basic and continued training. The motion was unanimously approved. Melissa Rosas put forth a motion for an additional refresher course on hold techniques for the officers involved in this incident. The motion was unanimously approved.
