NATHAN EPPERSON, SKOOKUM CRAFTSMANSHIP, LLC - REQUEST FOR VARIANCE TO THE PROJECT VERIFICATION REQUIREMENT FOR A NEW LICENSE AND SUPERVISOR’S CERTIFICATE DESCRIPTION: Mr. Nathan Epperson of Skookum Craftsmanship, LLC is requesting a variance to the project verification requirement to obtain a Class D1 license and supervisor’s certificate. STAFF: Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official Nathan Epperson introduced himself. Chair Richards outlined the hearing process. Staff Presentation Manno stated Mr. Epperson is requesting a variance to the project verifications for a new license and supervisor’s certificate. Manno outlined Mr. Epperson's denied license request which included project verifications for projects located in Fort Collins with Kevin Dewlen of FR Development listed as the principal contractor and supervisor’s certificate holder for the permits. Manno stated the nature of Mr. Epperson’s association with Mr. Dewlen and the details of these projects remain unclear. Additionally, Mr. Dewlen’s company’s lack of worker’s compensation coverage and the absence of recorded employees for FR Development is particularly concerning. Manno noted the Code’s project verification requirement cannot be filled by relying on projects that were completed within the city of Fort Collins as the license and supervisor’s certificate themselves are required to serve as a contractor or project supervisor. Manno stated the staff recommendation is for denial of the request given the lack of evidence showing experience for the license and supervisor’s certificate classification being requested. Manno outlined the role of the Commission and discussed what members should consider in this case. Additionally, Manno discussed Mr. Dewlen’s history and noted the supervisor’s certificate for Mr. Dewlen expired on June 24, 2023. Applicant Presentation Mr. Epperson stated he has been in the residential construction industry for most of his adult life and discussed his work experience for FR Development from 2013 until 2022. He stated he believed he followed the instructions for the licensing process properly and noted he passed the G13 exam and got a residential inspector certification. He stated his purpose in applying for this license is to build decks, finish basements, complete small additions, and to have the ability to possibly build a custom home or spec home. Staff Response Manno stated Mr. Epperson could be placed into a license classification that may be better suited to his needs at this time; however, a license cannot be issued based on what Mr. Epperson would like to do in the future with the information provided. Applicant Response Mr. Epperson stated he has worked in Fort Collins his entire life and commented on the Code requirement for project management outside the city. He stated he went back to the earlier projects under Mr. Dewlen as he is a respected contractor in the city. Additionally, Mr. Epperson stated his qualifications are well suited to carry a D1 license. ITEM 1, ATTACHMENT 1 BRC MAY 30, 2024 MINUTES - DRAFT Packet Page 5 City of Fort Collins Page 3 May 30, 2024 Commission Questions/Discussion Commissioner Dunbar asked Mr. Epperson to describe his daily responsibilities as a supervisor on the projects he submitted. Mr. Epperson replied he poured footings, measured for support beams, doublechecked framing, oversaw HVAC contractors, laid out cabinets for the trim contractor, and made punch lists as appropriate to ensure things were complete for the homeowners. Commissioner Zimmerman requested Mr. Epperson elaborate on why he provided project verifications from ten plus years ago and asked why FR Development has stated it never had any employees. Manno replied the company stated it did not have any employees and noted there is a requirement to provide a worker’s compensation policy if a company does have employees. Mr. Epperson stated he chose the projects he did as he has a good relationship with Mr. Dewlen, who is a respected contractor in the community. He stated he did not use later FR Development projects as he did not leave the company on the best terms in 2022. Commissioner Schneider asked Mr. Epperson about his experience with projects prior to permits being issued in terms of design, budget, and planning. Mr. Epperson replied he was not especially involved in the planning phase of the projects he submitted, though he feels he has more experience in that area now. Commissioner Poncelow asked Mr. Epperson to provide information as to what types of projects he was doing between 2015 and 2022. Mr. Epperson replied he was still working with FR Development at that time and was doing miscellaneous improvements on properties owned by the company when development slowed. He stated he then worked for the City of Fort Collins for a time and now does small home improvements that do not require a license. Chair Richards asked Mr. Epperson if he was aware FR Development was not claiming employees. Mr. Epperson replied in the negative and stated he was hired by the company as an employee in 2014 after being a subcontractor. Commissioner Dunbar asked Mr. Epperson if he has acted as supervisor on any projects since 2014. Mr. Epperson replied he was heavily involved in several projects but was not necessarily the primary project manager on those. He stated he was the primary supervisor on an addition project on Cherokee in 2018. Commissioner Dunbar noted the Commission has previously granted variances for using projects within the city of Fort Collins for project verification; however, they are usually more recent. Mr. Epperson stated he would need to do some research to determine those addresses. Commissioner Dunbar asked if Mr. Epperson would need to come back before the Commission if he were to revise his application to include newer project verifications within Fort Collins. Manno replied in the affirmative noting it still may be difficult to determine whether he is eligible for the D1 license depending on the extent of the projects. Manno concurred that the Commission has previously granted variances for projects in Fort Collins; however, the circumstances have varied. Commissioner Roberts requested more detail on Mr. Epperson’s work in a supervisor’s role after the projects that were provided were completed. Mr. Epperson replied he continued to do the same type of work for FR Development after Mr. Dewlen left the company; however, those projects were under different supervisors’ licenses. He stated he was essentially a site superintendent on most of the projects on which he worked. Commissioner Zimmerman stated he does not feel comfortable granting a variance with the provided information and suggested Mr. Epperson resubmit for a license based on more recent work. He also suggested a D2 license may be more appropriate. Commissioner Schneider asked Mr. Epperson if he has any licenses with any other jurisdictions or municipalities. Mr. Epperson replied in the negative. Commissioner Dunbar concurred with Commissioner Zimmerman. Commissioner Poncelow also concurred and suggested Mr. Epperson take some time to further review the work he did on the projects. Commissioner Roberts made a motion, seconded by Commissioner Dunbar, that the Building Review Commission deny the request for a variance to City Code Section 15-158(A)(2) finding based on agenda materials, information presented, and the discussion on the item, and the strict application of the Code, would not result in peculiar or exceptional practical difficulties to, or exceptional undue hardship on, Mr. Epperson, and Mr. Epperson failed to demonstrate that he possessed the other qualifications not specifically listed in City Code Chapter 15, Article to perform in a competent manner any construction authorized under the class D1 license and supervisor certificate. Furthermore, granting this variance would be a substantial detriment to the public good and would impair the intent and purpose of Article 5. Additionally, the Commission suggests that Mr. Epperson review more current work and provide more detail on those projects in a future license application. Commissioner Moscrip questioned whether the Commission would rather postpone a decision to allow for Mr. Epperson to gather more information instead of having to resubmit resulting in additional fees. Manno replied a new application and fee would not be required, just new project verifications. Chair Richards asked if the City places more weight on license holders who are in good standing adequately licensed within the city for project verifications. Manno replied in the negative and stated it would be the same process regardless. Chair Richards noted this decision is appealable to Council. THE MOTION PASSED 7-0. MICHAEL PATE, AMAROK FOR MIRANDA CABRERA, AJAX SAFETY AND SECURITY CONTRACTING, INC. - REQUEST FOR VARIANCE TO THE PROJECT VERIFICATION REQUIREMENT FOR A NEW LICENSE AND SUPERVISOR’S CERTIFICATE DESCRIPTION: Miranda Cabrera of AJAX Safety and Security Contracting, Inc. is requesting a new Class C1(DR) license and supervisor’s certificate to be issued without project verifications that will qualify for the license classification. STAFF: Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official Michael Pate introduced himself. Chair Richards outlined the hearing process. Staff Presentation Manno noted this application was originally submitted by Miranda Cabrera of Ajax Safety and Security Contracting requesting that a class C1(DR) license and supervisor’s certificate be issued without project verifications that qualify for the license classification. Manno noted Ajax offers commercial battery-charged electric security fence installation and the company has been contracted to install a commercial electric fence taller than 6 feet in height. Manno stated staff feels the license classification being sought falls far above what the company does and can qualify for; ITEM 1, ATTACHMENT 1 BRC MAY 30, 2024 MINUTES - DRAFT Packet Page 7 City of Fort Collins Page 5 May 30, 2024 however, there are no other licensing classifications that are suitable and due to the structural aspects of the project, this licensing classification is necessary. Manno noted Mr. Pate is appealing the denial of the initial application and is requesting a variance from the project verification requirement. Manno stated staff is recommending a variance of some type, either a one-time permit, a 30-day temporary permit, or something similar, and outlined the items for the Commission to consider. Applicant Presentation Mr. Pate stated Amarok is a security company that builds perimeter security systems, which he described. He noted Ajax is an installation company that Amarok has worked with throughout Colorado. Staff Response Manno stated limiting a license for these types of companies has worked in the past and noted staff does not have the ability to do that without Commission approval. Marcus Coldiron, Chief Building Official, stated the Code does not currently provide for a ‘catch-all’ license or the administrative ability to limit a license for these types of niche projects. Commission Questions/Discussion Chair Richards asked if there are multiple projects in Fort Collins the company is seeking to construct. Mr. Pate replied there is only one currently, though there may be more in the future. Commissioner Moscrip noted the Commission has run across this issue a few times for niche projects and expressed support for granting a license limited to fencing, not just for a single project. Commissioner Dunbar asked how Ajax is affiliated with Amarok. Mr. Pate replied Ajax is one of many third-party installers hired by Amarok allowing it to not have to hold licenses in every jurisdiction in which it works. Commissioner Dunbar clarified the variance would then be granted to Ajax. Commissioner Moscrip asked why Miranda Cabrera is not present representing Ajax. Mr. Pate replied he did not believe she needed to attend as he is present. Manno also noted staff was aware she would not be present. Commissioner Zimmerman made a motion, seconded by Commissioner Dunbar, that the Building Review Commission grant the requested variance to the prior project requirements under City Code Section 15-158(A)(2), 15-159(A)(6), and 15-160(A)(6) with respect to Ms. Cabrera’s application for a class C1 DR license and supervisor’s certificate. This variance is limited to allowing the issuance of a class C1 DR license solely for the installation of electric security fences that may be installed under such license. The Commission finds that granting the variance will not be a substantial detriment to the public good or substantially impair the intent and purposes of Chapter 15, Article 5, and the strict application of these Code sections would result in peculiar or exceptional practical difficulties for Ms. Cabrera because of the limited scope of the work that is being done and the inability of the Commission under current licensing categories to address these niche cases. THE MOTION PASSED 7-0. • OTHER BUSINESS Adam Hirschhorn stated he is working to craft a resilience policy for the City and asked the Commission if there are any new construction materials about which members are excited and whether there are any innovative modes of construction the Commission would like to see included. He provided his contact information for the members. ITEM 1, ATTACHMENT 1 BRC MAY 30, 2024 MINUTES - DRAFT Packet Page 9 Agenda Item 2 Item 2, Page 1 STAFF REPORT June 27, 2024 Building Review Commission STAFF Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official SUBJECT REQUEST FOR VARIANCE TO COMPLETE WORK OUTSIDE OF LICENSE LEVEL EXECUTIVE SUMMARY Ms. Dawn Spiker of Hahn Plumbing & Heating, Inc. is requesting a variance to the allowable scope of work of the currently held HVAC(RR) supervisor’s certificate. BACKGROUND Ms. Spiker currently holds a Class HVAC(RR) supervisor’s certificate with Hahn Plumbing & Heating, Inc. This supervisor’s certificate was approved and issued on November 3, 2022. The approval and issuance were based upon the submitted project verifications and testing. At the time of application submittal, it was determined that an HVAC(RR) – Repair Replace supervisor’s certificate could be granted. During recent email exchanges to determine if a new license classification could be granted, it was stated that, “Unfortunately, we are not able to submit ‘new commercial projects.’” Ms. Spiker’s appeal and request will fall under either an HVAC(C) and/or HVAC(R) license and supervisor’s classification which cannot be granted at this time due to lack of qualifying project verifications. There was some confusion on the appellants part during email exchanges in relation to something that was seen on a website relating to what the HVAC(R) license and supervisor’s certificate authorizes. Staff have investigated this and have been unable to find where the information stated in the email string is located on our website and ask the appellant for help in identifying where this information is, so that we may help reduce any confusion. The information on the website directly states what is in the City’s Municipal Code and is not what is stated in the email string. Ms. Spiker appeals to the commission to allow the installation of new mini-split systems with the currently held HVAC(RR) supervisor’s certificate. RELEVANT CITY CODE SECTIONS Section 15-160 – License classifications; fees; renewals (d) A specialized trade contractor license and a specialized trade contractor supervisor certificate shall be required for any contractor performing any specialized trade listed herein. Prior to any specialized trade supervisor being issued a supervisor certificate, the applicant for such certificate shall successfully complete a written examination as provided in § 15-157, or the applicant shall provide proof of equivalent technical qualification as determined by the Building Official. Applicants for a specialized trade contractor license or a specialized trade contractor supervisor certificate shall submit an application and documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed specialized trade projects as set forth under § 15-158 of this Article. Each Packet Page 10 Agenda Item 2 Item 2, Page 2 specialized trade contractor license regulated under this Article is listed and described hereunder with respect to the scope of work authorized by each such license as follows: HVAC-RR (repair and replacement) authorizes the replacement installation of environment nonportable heating, ventilation, air conditioning equipment and the related piping, ducts, venting, appliances, controls and electrical wiring (supplying not more than fifty [50] volts) associated with the repair or replacement. RECOMMENDATION Staff recommends approval of the request based upon provided written evidence stating the knowledge required to install new mini-split systems along with the following condition: -Must provide three project verifications for new (from nothing to something), completed mini-split installations. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a)The Code imposes peculiar or exceptional practical difficulties to the applicant; (b)The Code imposes undue hardship on the applicant; (c)The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the recommendation, the Commission may pass a motion to require the appellant to provide required project verifications to be granted a variance allowing the installation of new mini-split systems under the currently held supervisor’s certificate. If the Commission disagrees with the recommendation, the Commission may pass a motion to deny the appellants request to install new mini-splits under currently held supervisor’s certificate. Currently my HVAC RR license allows me to replace a full residential split system (furnace and air conditioner) but will not allow me to install a new from scratch simple mini-split system. Please let me explain the needed steps for installing a mini-split system and how it is quite similar to replacing a full residential split system. Steps to install a mini-split system: 1.Perform a Manual J Load Calculation. This is a calculation that helps identify the building’s HVAC capacity and the size of the equipment needed for heating/cooling a building. This calculation should also be performed before replacing a full residential split system. 2.Electrical. Ensure there are proper electrical connections for the outdoor condenser unit and the indoor head unit. If not, then hire a licensed electrician to put into place the proper connections. With a full residential split system, the electrical is more than likely already in place. This doesn’t mean that it is up to code, or that the condition of the electrical connections are good. 3. Setting Outdoor Condenser. The outdoor condenser needs to be placed on a condenser pad that is level and stable and the feet of the condenser properly secured to the pad. In a full residential split system this same step must occur, however the only diƯerence is that the condenser for a full residential split system usually doesn’t have feet that need to be secured to the pad. 4. Mounting of the Head Unit Indoors. This involves Ʊnding studs in the wall and mounting the bracket that is supplied with the unit to the wall. With a full residential split system, you must ensure that furnace is on set level on a non-combustible service. If the surface is combustible, then there must be a Ʊre block in place. In most cases the air conditioner coil is then set on top of the furnace. The furnace and air condition coil must then be connected and sealed properly to the existing supply and return ducting in the home. If the replacement furnace and coil are not the same exact size / layout as the previous unit then there may be a need to cut away and re-bend sheet metal. This complicated step of Ʊtting the furnace and air conditioner coil to the existing ducting is not needed as a mini-split system is a ductless system. 5. Connecting the Indoor Head Unit to the Outdoor Condenser. A lineset must be run between the two units to circulate the refrigerant. This is done by Ʊnding the easiest and shortest path between the two units. A hole will need to be drilled in the wall behind the head unit. Sometimes this hole penetrates the exterior of the building. Other times an exterior penetration will be at another location away from the Indoor Head Unit. With a replacement of a full residential split system, the lineset is already in place. The condition of the existing lineset will determine if it needs replaced or not. In some cases, running a replacement lineset in the same path as the existing lineset is prohibitive. This means a new path will need to be run and a new exterior penetration made. 6. Starting up the System. A pressure test of the system is Ʊrst performed to ensure there are no leaks at any of the connections. After the pressure test, a vacuum is then pulled on the refrigerant lineset to be sure there is no air or moisture in the lines. Once the lines have been properly vacuumed, the refrigerant charge is then released into the system. The system is then started up and tested for proper cooling and heating specs. These are the same exact steps taken for starting up a replacement full residential split system. One thing to mention is that when replacing a full residential split system, the old system must be properly evacuated of the old refrigerant. Proper procedures while completing this step is crucial for environmental reasons. With a new mini-split system this evacuation process doesn’t happen because there is no “old” refrigerant to remove. In conclusion, when comparing the steps needed to complete a full residential split system replacement and the steps needed to install a new mini-split system there are not many diƯerences. BACKGROUND Mr. Van Dixhorn was granted a Class E(R) license and supervisor’s certificate on May 2, 2024. This decision was based on the relatable experience on Eric’s home projects provided for the experience requirement. However, for the long term he would like to have a Class D2 license and supervisor’s certificate so that he can move into completing additions to homes. Staff could not make a viable connection between the completed capital projects to structures that people live and work within. To this point, Mr. Van Dixhorn appeals to the commission to be granted a higher license classification than was originally granted. RELEVANT CITY CODE SECTIONS Section 15-159 – Minimum experience qualifications (a) Minimum experience requirements for Classes A, A-DR, B, B-DR, C-1, C-1-DR, C-2, C-2-DR, D-1, D-2, D-DR, E, ER and MM general contractor licenses, specialized trade contractor licenses, and associated supervisor certificates as described in § 15-160 are as hereafter provided in this Section. In order to qualify for such minimum experience, all construction and specialized trade installation projects are subject to the Building Official's review and approval for sufficient variety and complexity. All such projects shall have been constructed or installed primarily by the applicant or under the applicant's direct control. The particular license type and respective required minimum documented experience are described as follows: (10) To qualify for a Class D-2 license or supervisor certificate, the applicant must have constructed or acted principally in the role of supervisor for the construction of three (3) completed projects classified as additions or alterations to R-3 Occupancies (single-family or townhomes), each project being at least one thousand (1,000) square feet. RECOMMENDATION Staff recommends denial of this request based on the lack of permitted residential construction experience for the request being sought. The multifaceted project consisted of the construction of eight new vehicular bridge structures along with a pedestrian bridge featuring an access stair building. Additionally, the project involved lighting and electrical components, grading, concrete pavement, concrete barrier, asphalt pavement, storm sewer, erosion control, permanent signing, traffic control, pavement marking, retaining walls, among other incidental items. The attached documentation provides further insight into the project's scope and specifics. This complex project demanded meticulous coordination among diverse stakeholders due to its pivotal role in facilitating traffic flow to and from a Level 1 trauma center, Froedtert Hospital, as well as serving critical entities such as the Milwaukee County Sheriff's Office, Children’s Hospital of Wisconsin, the Medical College of Wisconsin and others. Eric Van Dixhorn assumed the role of lead project manager for Zenith Tech, spearheading the project's execution. Initially, Eric operated in an on-site supervisory capacity, overseeing day-to-day operations. Subsequently, he transitioned into the role of project director, assuming oversight responsibilities for subcontractors, Zenith Tech's engineers, and superintendents.
