Board Members Present: Shamera Loose, Elizabeth Grant, Veronica Olivas, Mike O’Malley, Michael Ruttenberg, Amy Hoeven, and Melissa Rosas b. Staff Present: Lieutenant Jeremy Yonce, Sergeant Kim Cochran, Assistant City Attorney Sara Arfmann, Jessica Jones 3. AGENDA REVIEW 4. CITIZEN PARTICIPATION a. Public Input – None 5. APPROVAL OF MINUTES a. April 10, 2024: Elizabeth Grant moved to approve, which was seconded by Melissa Rosas. Motion passed. 6. NEW BUSINESS a. Voicemail: 1 voicemail from Angel Eldridge, following up on a complaint filed with FCPS. Deputy Chief Yeager contacted her as he is the one who handled her previous complaint. b. E-mail: None CITIZEN REVIEW BOARD (CiRB) REGULAR MEETING c. Citizen Review Board Elections • Melissa Rosas nominates Shamera Loose to serve as Chairperson of the Citizen Review Board, which was seconded by Elizabeth Grant. Motion passed. • Melissa Rosas nominates Mike O’Malley to serve as Vice Chairperson of the Citizen Review Board, which was seconded by Michael Ruttenberg. Motion passed. d. Subcommittee Drawing for PSU2024-011: • Subcommittee Chairperson: Elizabeth Grant • Subcommittee Member: Mike O’Malley • Subcommittee Member: Amy Hoeven • Alternate Member: Shamera Loose 7. UNFINISHED BUSINESS a. Approval of minutes for PSU2023-038: Michael Ruttenberg signed the subcommittee minutes that were previously approved at the April CiRB meeting. 8. BOARD MEMBER REPORTS 9. OTHER BUSINESS a. PSU2024-011 will be due to the board by June 19, so the board can potentially hold the subcommittee meeting directly after the regular meeting in July. b. Shamera Loose provided information about board members signing up for ride-alongs or sit-alongs throughout the year. c. Discussion about obtaining contact information for other board members: if board members are comfortable sharing their contact information with other members, they may email Jessica Jones to confirm what information should be shared. 10. Box 580 Fort Collins, CO 80522 Case PSU2024-004 Present: Mike O’Malley, Subcommittee Chair; Shamera Loose, Subcommittee Member; Melissa Rosas, Subcommittee Member; Elizabeth Grant, Subcommittee Alternate Member Absent: None Staff: Sergeant Kim Cochran, Fort Collins Police Services; Lieutenant Jeremy Yonce, Fort Collins Police Services; Sara Arfman, City of Fort Collins Public None Call to Order: The subcommittee meeting was called to order at 6:20 p.m. by Chairperson Mike O’Malley. It was noted that there were no citizens present or other attendees and no absences. Case PSU2024-004: Mr. Mike O’Malley advised that pursuant to the provisions of Sections 2-144(f) et seq. of the Code of the City of Fort Collins, the Citizens Review Board Subcommittee will undertake a review of an internal investigation conducted by the Office of Police Services, Case No. PSU2024-004, relating to an incident involving Policy 300 and Policy 340.3(b). Executive Session: At 06:23 p.m., a combined motion [City Code sections 2-144(f)(7), 2-72(b)(2), 2-31(a)(1)(b)., and 2-31(a)(2) as well as Colorado Revised Statutes sections 24-6-402(4)(f) and 24-6-402(4)(b)] to go into Executive Session to consider evidence and receive legal advice was made, seconded and approved unanimously. Prior to adjourning into Executive Session, Mr. Mike O’Malley advised that no final policy decision will be made, nor will any resolution be passed or other formal action taken by the subcommittee while in Executive Session. Regular Session: At 6:49 p.m., a motion was made, seconded and approved unanimously to exit from Executive Session. There was no discussion. A motion was made to agree with the Internal Affairs finding of exonerated involving the subject officers concerning Policy 300. The motion was seconded and the subcommittee voted unanimously, 3-0 with no discussion to agree with the Internal Affairs findings (exonerated) and recommendations on the above-captioned case. A second motion was made to agree with the Internal Affairs finding of exonerated involving the subject officers concerning Policy 340.3(b) vis a vis the captioned case. The motion was seconded and the subcommittee voted unanimously, 3-0, with no discussion to agree fully with the Internal Affairs findings (exonerated) and recommendation on the above-captioned case.
