Secretary’s Note: All applications were heard via Zoom. Staff in attendance: Holly Coulehan, Assistant City Attorney II Carrie Ripsam, Liquor Enforcement Officer Aimee Jensen, Deputy City Clerk Liquor Enforcement Update Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random compliance checks:  April 2, 2024, visiting 16 liquor licensed establishments, 1 of which served the underage operative: a failure rate of 6.25%.  April 8, 2024, visiting 20 liquor licensed establishments, 3 of which served the underage operative: a failure rate of 11.11%. Liquor Enforcement Officer Ripsam stated that the overall failure rate is 5.95% for 2024. Show Cause Hearing for Dragon Lee, LLC, dba Dragon Lee Restaurant, 1228 West Elizabeth Street, C-10, Stipulation Agreement Arunrat Sautter, representative for Dragon Lee, LLC, stated she has had an opportunity to review the stipulation agreement and has agreed to the terms. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee agreed to a 35-day suspension, 15 days with no service or consumption of alcohol on the licensee’s premises from the start of business on April 18, 2024 through the end of business on May 2, 2024, with 20 days held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) sales/service to minors prohibited and for violation of the Liquor Authority’s Order and Stipulated Agreement from May 17, 2023. Show Cause Hearing for Modmarket, LLC, dba Modern Market, 3260 South College Avenue, Stipulation Agreement Kevin Hutchinson, representative for Modmarket, LLC, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. He briefly described changes made to avoid this situation in the future. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 17-day suspension, 7 days served (paid $500 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to minors prohibited. Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Modmarket, LLC, dba Modern Market, 3260 South College Avenue. Show Cause Hearing for Trader Joe’s Company, dba Trader Joe’s #304, 3500 South College Avenue, Stipulation Agreement Stanley J. Wolowski, attorney representing Trader Joe’s Company, stated he has had an opportunity to review the stipulation agreement and has agreed to the terms. Eric Schumacher, general manager, briefly described steps taken to make sure this doesn’t happen again. Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee agreed to a 15-day suspension, 5 days served (paid $5000 fine in lieu of suspension), with 10 days held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to minors prohibited. Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation agreement as presented for Trader Joe’s Company, dba Trader Joe’s #304, 3500 South College Avenue. Show Cause Hearing for Yum Yum Restaurant, Inc., dba Yum Yum Restaurant/Ma’s Juice Bar, 1300 West Elizabeth Street, Stipulation Agreement Denise Hakim, representative for Yum Yum Restaurant, Inc., stated she has had an opportunity to review the stipulation agreement and has agreed to the terms. Temporary Modification of Premise Application from Fort Collins Barbecue, LLC, dba Smok BBQ, 327 East Foothills Parkway, Suite 110, Block I-J, Approved Matt Collier, representative for Fort Collins Barbecue, LLC, stated that they expanded their premises last summer to accommodate concerts held at the Foothills Fashion Mall and that there were no issues. Chief Municipal Judge Hueser approved the temporary modification of premise application from Fort Collins Barbecue, LLC, dba Smok BBQ, 327 East Foothills Parkway, Suite 110, Block I-J. Change in Location Application from The Taco Stop, LLC, dba The Taco Stop, from 6324 South College Avenue, to 2601 South Lemay Avenue, Suite 30, Approved Berenice Longoria, representative for The Taco Stop, LLC dba The Taco Stop, briefly described the premises at 2601 South Lemay Avenue and that there is no patio. Chief Municipal Judge Hueser approved the change in location application from The Taco Stop, LLC, dba The Taco Stop, from 6324 South College Avenue, to 2601 South Lemay Avenue, Suite 30. Transfer of Ownership Application from Dam Good Systems, dba, DGT 120 West Laurel Street, Approved Mike Falco, representative for Dam Good Systems, stated they will no longer maintain the premise at 120 ½ West Laurel Street. He stated there is a designated staff member monitoring the patio and dining room. Mr. Falco stated he understands that the days held in abeyance for the violation that occurred at their location at 120 ½ West Laurel Street. Chief Municipal Judge Hueser approved the transfer of ownership from Dam Good Systems, dba DGT 120 West Laurel Street. Transfer of Ownership Application of from Grenzie Enterprises, Ltd., dba Verboten Brewing, 1611 South College Avenue, Suite 1609, Approved Angeline Grenz, representative for Grenzie Enterprises, Ltd., stated she and her husband have another brew pub in Loveland which has been in operation for 10 years and have had no violations. In response to questions from the Authority, Ms. Grenz described the premises. Chief Municipal Judge Hueser approved the transfer of ownership from Grenzie Enterprises, Ltd., dba Verboten Brewing, 1611 South College Avenue.
