Building Review Commission ITEM 1, ATTACHMENT 1 BRC MARCH 28, 2024 MINUTES - DRAFT Packet Page 4 City of Fort Collins Page 2 March 28, 2024 2.GARY PRITCHARD, DHARMA DESIGN BUILD, LLC - REQUEST FOR VARIANCE TO PROJECT VERIFICATIONS REQUIRED FOR A NEW LICENSE AND SUPERVISOR’S CERTIFICATE DESCRIPTION: Mr. Gary Pritchard of Dharma Design Build, LLC is requesting a variance to the project verification requirement to obtain a license and supervisor’s certificate. STAFF: Shar Manno, Manager, Customer Support, Community Development & Neighborhood Services Marcus Coldiron, Chief Building Official Vice Chair Richards reviewed the appeal process. Staff Presentation Shar Manno, Manager, Customer Support, Community Development and Neighborhood Services, outlined the City Code requirements for obtaining a license and supervisor’s certificate, which include providing documents to verify that the individual acted in the principal role of contractor and primary project supervisor on at least three projects; however, it is not possible to satisfy the letter of the requirement by relying on projects that were completed within the city of Fort Collins because the license and supervisor’s certificate itself is required to serve as a contractor or project supervisor. Manno stated Mr. Pritchard’s application included project verifications from within the city of Fort Collins on which Jordan Obermann was the principal contractor and supervisor’s certificate holder ; however, the application does not satisfy the letter of the Code section and was therefore denied. Manno stated Mr. Pritchard is now requesting a variance to the project verification requirements so he can use the projects to satisfy the requirement. Manno outlined considerations for the Commission. Appellant Presentation Mr. Pritchard discussed his construction project experience and stated he believes his appeal meets the applicable standards of the Code. He requested the Commissioners look at his resume to get a sense of his experience in the construction industry. He also presented a letter of recommendation. Staff Rebuttal Ms. Manno noted Mr. Pritchard did have a framing license with the City which expired in 2008 and a number of permits were pulled under that license. She stated staff would like to see experience in other jurisdictions. Appellant Rebuttal Mr. Pritchard stated he graduated from a construction team manager to general manager in other jurisdictions but cannot technically say that he has a contractor certification in those jurisdictions. He stated he does believe that experience satisfies the intent of the Code. Commission Questions/Discussion Commissioner Moscrip requested Mr. Pritchard describe his experience on site with some of the projects. Mr. Pritchard replied he started as the general manager under Jordan Obermann then assumed the role of on-site supervisor and project manager for the recent projects listed on his project verification forms. He stated he was responsible for ensuring materials arrived, subcontractors reported and had information they needed, and costs were appropriately managed. He stated he was on the job site at least half of every working day and was doing multiple projects at a time. Mr. Pritchard replied he has an upcoming basement finish in Fort Collins. Vice Chair Richards asked if the third project listed by Mr. Pritchard is completed. Mr. Pritchard replied in the affirmative and stated a letter of completion should have been a part of the package. Vice Chair Richards asked Mr. Pritchard about his role in some work in Windsor. Mr. Pritchard replied he framed around 150 homes in his 20’s in Windsor. Commissioner Dunbar stated it is clear that Mr. Pritchard’s qualifications and experience are at a high level and he noted it would be difficult to comply with the City’s request in this case. Commissioner Moscrip concurred with Commissioner Dunbar and stated the City’s requirements to provide proof of work outside the city in order to work in the city should maybe be reconsidered. Vice Chair Richards concurred and stated the regulations have proved difficult for people who want to focus and grow their career in Fort Collins. Commissioner Dunbar moved that the Building Review Commission grant the requested variance to City Code Sections 15-158(a)(2) and 15-159(a)(10) to allow the information contained in Mr. Pritchard’s January 16, 2024 application and presented at this hearing for a class D2 license and supervisor’s certificate to satisfy the Code requirement that Mr. Pritchard has constructed or acted principally in a role of supervisor for the construction of at least three completed projects. Mr. Pritchard has demonstrated to the satisfaction of the Commission that he possesses other qualifications not specifically listed in the Code, Chapter 15, Article 5, which the Commission has determined to qualify him to perform in a competent manner any construction authorized under the D2 license and supervisor’s certificate sought. Furthermore, granting of this variance will not be a substantial detriment to the public good or substantially impair the intent of the purposes of Article 5. Commissioner Zimmerman seconded the motion. Commissioner Dunbar stated there was some discussion about a potential change to these requirements at a previous meeting and asked if that is still being considered. Manno replied in the affirmative and stated the updated Building Code is currently being considered, and following that, the Contractor Licensing program will be reviewed. BACKGROUND AJAX Safety and Security Contracting, Inc. is a company that offers commercial battery-charged electric security fence installation. They have been contracted to complete a commercial, above 6’ electric fence, project in the City of Fort Collins. An initial licensing request was received on February 8, 2024 which was returned back to Ajax Safety and Security Contracting, Inc. because of the project verifications not being adequate to grant a Class C1(DR) license and supervisor’s certificate. The license and supervisor’s certificate required to complete the above project is a Class C1(DR) due to the height of the fence and other build code related aspects (footings , wind load, etc.). Below states what is authorized under said license and certificate, and what it takes to qualify. Class C1(DR): Authorized to add additions to and/or make repairs or restoration to structural damage to any building or structure in the City regulated under the building code that does not exceed 20,000 square feet in floor area and/or three (3) stories in height, including all work authorized by damage repair and restoration license types below this level. • To qualify, the applicant must have performed or acted principally in the role of supervisor for the significant structural repair construction on three (3) buildings of occupancy classifications other than Group R, up to 20,000 square feet in floor area and/or up to three stories in height. It is felt that the license classification falls far above what the company does and can qualify for and that there are no other licensing classifications that are suitable to place them. They do not build full structures, however, due to the structural aspects of this project, this licensing classification is needed, but to a limited nature. Ms. Cabrera now appeals the denial of the initial application, and she is applying for a variance from the project verification requirement. Packet Page 7 Agenda Item 2 Item 2, Page 2 RELEVANT CITY CODE SECTIONS Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect, or professional engineer directly involved in the construction of said project and said person shall have worked directly with the applicant. Sec. 15-159. - Minimum experience qualifications. (a) Minimum experience requirements for Classes A, A -DR, B, B-DR, C-1, C-1-DR, C-2, C-2-DR, D-1, D-2, D-DR, E, ER and MM general contractor licenses, specialized trade contractor licenses, and associated supervisor certificates as described in § 15-160 are as hereafter provided in this Section. In order to qualify for such minimum experience, all construction and specialized trade installation projects are subject to the Building Official's review and approval for sufficient variety and complexity. All such projects shall have been constructed or installed primarily by the applicant or under the applicant's direct control. The particular license type and respective required minimum documented experience are described as follows: (6) To qualify for a Class C-1-DR license or supervisor certificate, the applicant must have acted principally in the role of supervisor for the significant structural repair construction on three (3) buildings of Type III, IV or V construction. Sec. 15-160. - License classifications; fees; renewals. a) The particular contractor license required, and corresponding maximum scope of construction authorized under each license is described hereunder. All licenses are valid for a period of two (2) years from the date of issuance, and the fee for each license is two hundred dollars ($200.). A license ma y be renewed provided that said biennial fee is paid within sixty (60) days following the anniversary date such license was issued. When the license fee is not paid within such sixty -day period, the license shall expire and is not eligible for renewal. The holder of an expired license may be reissued such license by submitting a new application and paying all applicable fees as set forth in § 15-158. (6) A Class C-1-DR Structural Damage Repair/Restoration license holder shall be authorized to make repairs or restoration to structural damage to any building or structure in the City regulated under the building code that does not exceed three (3) stories in height and limited to construction Types III, IV and V, including all work authorized by damage repair and restoration li cense types below this level. RECOMMENDATION The written application materials leave it clear that a variance of some type (one-time permit, 30-day temp, etc.) may be the only option in this case. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; Packet Page 8 Agenda Item 2 Item 2, Page 3 (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. Here, based on her application materials, Ms. Cabrera cannot strictly comply with Section 15-158, 159, and 160. She has project verifications, however, they do not qualify for the requested and needed license classificiation under the City of Fort Collins contractor licensing code. Staff is cognizant of the difficulty the above code sections imposes on companies that are in more niche like segments of the construction industry. Though staff cannot recommend a variance here, it does recommend that the BRC carefully consider the substance of Ms. Cabrera’s provided information and testimony. ATTACHMENTS 1. Appeal Form 2. BACKGROUND Mr. Pallaoro and High Pointe Homes, Inc. has not held a license and/or supervisor’s certificate with the City of Fort Collins. This is a new license and certificiate request. Mr. Pallaoro has requested a Class C1(DR) license and supervisor’s certificate which requires a passing International Code Council (ICC) G12 General Building Contractor (B) passing testing certificate, covering the 2018 code year. Mr. Pallaoro has submitted an older exam, W11 – National Standard Building Contractor (A) which covers the 2012 code year. Staff received Mr. Pallaoro’s application packet on February 20, 2024. Mr. Pallaoro did have a conversation with both Mrs. Manno and Mr. Coldiron upon submittal, with both stating to submit what information he had to move forward. All required items, with the exception of applicable testing, have been received. The following code sections apply to new licensing requests and transitions: • Sec. 15-158. - Applications; review; issuance. (a) Prior to being issued any license or certificate specified in this Article, all applicants for such license or certificate shall complete and submit to the Building Official an application containing the following information: (1) The individual applicant's name, the contractor's business name under which license the applicant is associated or will be working, a current mailing address and telephone number, email address and one (1) form of photographic identification of the app licant; (2) Documents verifying that the applicant has acted in the principal role of contractor or primary project supervisor on no less than three (3) separate completed building construction or specialized trade projects. A person other than the applicant must sign such documents, and the same person cannot be the signatory on all three (3) documents. Said signatory shall be a project owner, contractor, architect, or professional engineer directly involved in the construction of said project and said person shal l have Packet Page 29 Agenda Item 3 Item 3, Page 2 worked directly with the applicant. Additionally, said documents shall contain the following information where applicable to the license or contractor certificate sought: a. The total floor area and number of stories (as defined in the building code) of each building in the project, b. The building construction type as defined in the building code, c. The building occupancy classification as defined in the building code, d. The date the project was completed, e. The address, contractor of record and permit number (when applicable) for the project, f. A description of the project which the applicant directly supervised or for which the applicant was the contractor of record, whichever is applicable, in sufficient detail to fully describe the extent of the construction or alteration or specialized trade work. Such description must describe all relevant work, such as that involving the foundation, the exterior structural elements, the interior bearing walls, the nonbearing walls and elements, the electrical systems, the plumbing systems, the mechanical systems, roofing, and any other specialized trade work that may be applicable to the license or certificate sought, g. A complete description of the applicant's position and responsibilities on the project, and h. The signatory's role in the project; and (3) The applicant's disclosure of any disciplinary action (whether by the City or any other jurisdiction) taken against the applicant or against any licenses currently or previously held by the applicant; and (4) A signed statement by the applicant acknowledging the obligations associated with such license or certificate. (b) All such applications shall be accompanied by a nonrefundable processing fee of seventy -five dollars ($75.) for each such application. (c) Subject to the qualification requirements of § 15-159 and subject to any applicable variances which may have been granted by the Board pursuant to § 15-156 and provided further that the applicant has not committed any acts described in § 15-162 of this Article without the Board having first conducted a hearing and having made a determination regarding the applicant's fitness to be granted a license or supervisor certificate, the Building Official shall issue to the applicant the license or super visor certificate applied for upon receipt of all of the following: (1) Evidence of a passing score on the applicable written examination or equivalent as specified in this Article; (2) Payment of the applicable fee; (3) Written proof of general liability and workers' compensation insurance as required in this Article; and (4) All documents required to be provided in Subsection (a) above. • Sec. 15-164. - Transition provisions. Packet Page 30 Agenda Item 3 Item 3, Page 3 (a) Any holder of a valid contractor license or supervisor certificate prior to the effective date of this Article shall be eligible to maintain the same such license or certificate without additional application fees or examination provided that such license or certificate remains valid throughout the current annual term of such license or certificate. Th ereafter, any such contractor license or supervisor certificate shall be subject to renewal provisions as prescribed in this Article. RECOMMENDATION Staff recommends deniel of this request based on this being a new license and supervisor’s certificate request requiring the G12 passing ICC testing certificate and adequate project verifications. City Code Section 2-173 provides the standard for a variance. Under that section, the Commission should examine whether: (a) The Code imposes peculiar or exceptional practical difficulties to the applicant; (b) The Code imposes undue hardship on the applicant; (c) The applicant demonstrates to the BRC’s satisfaction that it possesses other qualifications not specifically listed in the Code that the BRC determines qualify the applicant to perform competently. The Commission should also consider whether a variance can be granted without substantial detriment to the public good, and without substantially impairing the intent and purpose of the Code. If the Commission agrees with the recommendation, the Commission may pass a motion to require the appellant to provide required testing and project verifications to be granted a Class C1(DR) license and supervisor’s certificate. A parapet wall was added to the front of the building to breakup the roofline and add curb appeal. A new roof replaced the dated blue shingles that were prior. Existing stucco was removed in several areas and stacked stone was added to enhance the look. LED lighting was added around the entire building. New landscaping was added, steel canopies above the entryways, sliding glass doors and new stamped concrete under the porte cochere gives guests a great first impression. Since the lobby was small to begin with, the idea was to add features that would make it seem larger and more open. A contemporary see thru fireplace was added as well as a full redesign of the existing wall that separated the lobby and breakfast area.
