LIQUOR LICENSING AUTHORITY MINUTES
Regular Meeting. – February 21, 2024

A regular meeting of the Liquor Licensing Authority was held February 21, 2024, via Zoom Link,
Chief Judge Jill Hueser presiding.
Secretary’s Note: All applications were heard via Zoom.

Minutes from January 17, 2024, Liquor Licensing Authority meeting.
Liquor Enforcement Update
Liquor Enforcement Officer Ripsam stated Fort Collins Police Services conducted random
compliance checks:
January 22, 2024, visiting 20 liquor licensed establishments 1 of which served the underage
operative: a failure rate of 5% for the evening.
February 13, 2024, visiting 21 liquor licensed establishments none of which served the
underage operative: a failure rate of 0% for the evening.
February 16, 2024, visiting 20 liquor licensed establishments none of which served the
underage operative: a failure rate of 0% for the evening.
February 19, 2024, visiting 20 liquor licensed establishments 1 of which served the underage
operative: a failure rate of 5% for the evening.
Liquor Enforcement Officer Ripsam stated that the overall failure rate is 2.04% for 2024.

Show Cause Hearing for Agave Underground, LLC, dba
Agave Underground, 321 East Foothills Parkway, Stipulation Agreement
Perla Ruiz, representative for Agave Underground, LLC, stated she has had an opportunity to review
the stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the Licensee
agreed to a 15-day suspension, 5 days served (paid $1528.48 fine in lieu of suspension), with 10 days
held in abeyance for 1 year for violating Colorado Liquor Code 44-3-301(4)(a) – Fort Collins and
Colorado valid liquor licenses were not conspicuously displayed in your establishment as required,
Fort Collins Municipal Code 3-81(b), report of disturbances – was not displayed as required, Colorado
Liquor Code 44-3-901(6)(h) – the minor warning sign regarding the sale of liquor or beer to any person
under twenty-one years of age was not displayed as required, and Colorado Revised Statute 39-26-
103(3) – Colorado Sales Tax License issued for your establishment was expired.
Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for Agave Underground, LLC, dba Agave Underground, 321 East Foothills
Parkway.
Show Cause Hearing for RJ’s Wine & Spirits, LLC, dba
RJ’s Wine & Spirits, 4321 Corbet Drive, Suite #100, Stipulation Agreement
Nancy Landi, representative for RJ’s Wine & Spirits, LLC, stated she has had an opportunity to review
the stipulation agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee
agreed to a 15-day suspension, 5 days served (paid $5000 fine in lieu of suspension), with 10 days held
in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(b)(I) – sales/service to minors
prohibited.
Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for RJ’s Wine & Spirits, LLC, dba RJ’s Wine & Spirits, 4321 Corbet Drive,
Suite #100.

William Oliver’s Publick House,
2608 South Timberline Road, Suite 108, Stipulation Agreement
Ryan Wallace, representative for The Public House Corporation, dba William Oliver’s Publick House,
2608 South Timberline Road, Suite 108, stated he has had an opportunity to review the stipulation
agreement and has agreed to the terms.
Assistant City Attorney Coulehan reviewed the terms of the stipulation agreement, noting the licensee
agreed to a 15-day suspension, 5 days served (paid $2,597.60 fine in lieu of suspension), with 10 days
held in abeyance for 1 year for violating Colorado Liquor Code 44-3-901(1)(a), sale to visibly
intoxicated person by an employee.

Chief Municipal Judge Hueser approved the findings, conclusion, and order, accepting the stipulation
agreement as presented for The Public House Corporation, dba William Oliver’s Publick House, 2608
South Timberline Road, Suite 108.
Transfer of Ownership Application from Kamala Devi, Inc., dba
Bison Liquor, 1015 West Horsetooth Road, Suite E101, Approved
Kris Hoeltgen, attorney representing Kamala Devi, Inc., stated Susmita Sitaula was available to answer
questions for the Authority. Ms. Sitaula stated she has received training from the previous owner and
has attended TIPs training. In response to questions from Ms. Hoeltgen, Ms. Sitaula described her
carding policies and that she will not accept vertical id’s.
Chief Municipal Judge Hueser approved the transfer of ownership application from Kamala Devi,
Inc., dba Bison Liquor, 1015 West Horsetooth Road, Suite E101.
New Hotel-Restaurant Application from CO Ramen 2, LLC, dba
Jinya Ramen, 3280 South College Avenue, Approved
Robert Runco, attorney representing CO Ramen 2, LLC, stated Tony Avila is available to testify and
answer questions for the Authority.
Mr. Avila was sworn. He stated they do not accept vertical or expired ID’s. In response to questions
from Mr. Runco, Mr. Avila detailed alcohol service policies.
Eva Garretson, representative for Liquor Pros, was sworn. She stated that the petitions indicate strong
support for this liquor license application.
Chief Municipal Judge Hueser adopted Resolution 2024-01 approving the hotel-restaurant application
from CO Ramen 2, LLC, dba Jinya Ramen, 3280 South College Avenue.
