• Email from Dr. Ed Joseph: Complaint about neighbor who has violated a
TPO multiple times. When he attempts to contact FCPS, some officers
have spoken to him in a disrespectful manner. He has also emailed to
withdraw his complaint.

5. APPROVAL OF MINUTES
a. December 13, 2023: Corrections to the spelling of Michael Ruttenberg’s
name. Michael Ruttenberg moved to approve the December 2023 minutes,
which was seconded by Mike O’Malley. Motion passed.
6. NEW BUSINESS
a. Introduction of Sara Arfmann, who will be taking over for Jenny Lopez Filkins
in advising the Citizen’s Review Board.

b. Sub-Committee Roles and Procedures Discussion: Sgt. Kim Cochran and
Jenny Lopez Filkins
• Board members confirm that they have a copy of the script for
subcommittee meetings. The DA completed their review of the case that
will soon be reviewed by a subcommittee, and that report has been made
publicly available. The 45-day clock to review this case started on
12/29/2023. This deadline may be extended by an additional 30 days.
Sgt. Cochran expects to have the report completed by next week, and
then it goes to Chain of Command Review. The subcommittee could
potentially meet as early as March, so the chairperson of the
subcommittee should expect to schedule the first meeting to occur directly
after the regular March meeting.
• City Code includes the functions of the CiRB and how the subcommittee
review process works. The script is based on the Code language. State
law requires that the employee whose conduct is being considered give
consent to the review taking place in executive session. If the employee
does not give consent, the meetings must take place in an open meeting.
Sgt. Cochran will contact the employee to notify them and request
consent. It is unusual for an employee to withhold consent. Once the
findings have been made public, that goes back to the Chief for review
and he makes his final finding.
• The chairperson of the subcommittee should keep in mind when
coordinating schedules that that the four selected subcommittee
members, Sara Arfmann and Kim Cochran must attend each meeting.
• The subcommittee meeting will start out as an open meeting. There are
specific sections of City Code that must be cited when making motions. It
is important to ensure that these code sections are stated for the record
each time. The subcommittee review is audio recorded only during the
executive session portion. The alternate is responsible for taking minutes
of those portions of the meeting that do not take place in executive
session. Jessica emailed the template for minutes to everyone. The
alternate is allowed to participate in discussion, but not to vote.
• Jenny Lopez Filkins provided a handout to board members that outlines
the possible findings. If the subject employee is present, board members
will need to ensure that #5 from the script is addressed.
• #6 in the script is the motion to go into executive session. Once that
motion is approved, everyone who is not on the committee leaves the
room and the door is closed, with only Sergent Cochran, the attorney, and
subcommittee members remaining.
• These reviews are conducted in executive session in order to preserve
the privacy of the employee who was involved. If board members have
legal questions, the attorney will read a statement that states that the

recording will be stopped because there are legal questions. The
recording is then stopped. After questions have been answered and
subcommittee members return to executive session, the recording starts
back. It is important to remember that board members cannot take any
action in an executive session. They should not discuss how they are
going to vote, or their opinions about the case. All of that should be done
in an open meeting.
• Once subcommittee members come out of the executive session, they will
need to determine whether they as a committee can take action (pass a
motion) to agree with or disagree with each of the Internal Affairs findings
that are made about each of the policy violations. Subcommittee
members can make a motion to agree with all of the findings or can make
a motion to disagree with one of the findings, and only agree with some of
the other findings.
• For clarification, board members should keep in mind that they are either
agreeing or disagreeing with the findings of Internal Affairs only.
• If a motion doesn't pass, that is not something that must be reported in the
memo to the chief, though it should be included in the minutes.
• There are options to agree or disagree with the finding, or to make a
motion with one of the other finding options described in the handout. If a
subcommittee member disagrees with the findings, it is important to be
more detailed in explaining why they have a different finding.
• As subcommittee members are reviewing the case, they may see a need
for some type of additional training, or a change in policy. They have an
opportunity to include discussion about this in the memo to the Chief.
• It is helpful to give Sara Arfmann an opportunity to look at the memo
before submitting it to the Chief. The chairperson of the subcommittee
will write the memo. There is an existing template that Jessica will email.
• It is important to remember that board members may not have
conversations via email or outside of meetings, about anything other than
scheduling a meeting. No action should be taken, or no other topic that is
related to the business of the CiRB should be discussed. The alternate
will also draft the minutes and submit it to the subcommittee chair prior to
them writing the memo. The subcommittee chairperson will send the
memo to the Chief and Jessica.
• Minutes of a subcommittee meeting must be considered for approval at
the next regular CiRB meeting.
• Once the Chief makes his decision, he will send a memo to board
members.
• If the subcommittee wants a subject matter expert, they may request the
expert attend the subcommittee hearing. State law and the code make it
clear that who can be in an executive session should be limited as much
as possible, but there may be times when it necessary for an expert to
attend. One way to address this issue would be for the subject matter
expert to come in during the open part of the session for questions, but

not be in the executive session for the discussion.
• In the past, there have been times when the CIRT (Critical Incident
Response Team) officer attends as well. The CIRT responds to all
officer-involved shootings and consists of representatives for each agency
who come together to investigate. FCPS isn't allowed to do their own
investigations, so it must be conducted by the other agencies.
• Kelly Valdez coordinates the release of the report and will give access to
the electronic file. The subcommittee members have up to 45 days to
review the case, meet for the review and write the memo.
• The board should have the current report in a little more than 30 days.
• If subcommittee members are unable to get access through the link,
another option is to review everything else, and then Kim can project the
link’s contents in executive session.
• .
• Elizabeth Grant points out that historically, the body cam files just had
numerical titles and that what she did previously to cut down on confusion
was create sub-folders with officers’ names, or with files she’d already
reviewed, to separate them out.

7. UNFINISHED BUSINESS
a. The CiRB’s next regular meeting on February 14 will take place at the Fort
Collins Police Station, either in the Community Room or in the Training Room.
Board members should report to the front of the building to meet Jeremy
Yonce, who will be waiting to let them in.
b. Jeremy Yonce will schedule the next training for May, since the meeting in
March will be used for the subcommittee hearing and April is reserved for
training for new board members.

MAKING BOARD AND COMMISSION LIAISON AND COUNCIL
COMMITTEE ASSIGNMENTS AND MAKING APPOINTMENTSTO
VARIOUS EXTERNAL BOARDS AND AUTHORITIES
A.The City Council appoints Councilmembers to serve as liaisons to the City’s
boards and commissions and appoints Councilmembers to established Council
committees.
B.The City Council is also desirous of appointing representatives to certain
other organizations of which the City is a member.
C.City Code Section 2-570 provides that Council may appoint any number of
its own members to serve as City representatives to or members of boards of directors
of,other governmental or private agencies.
D.In addition to appointing members,Council appoints alternate members to
all Council committees to assist with effective functioning of these committees,as
described below.
E.Council has determined that the appointments set forth in this Resolution
are and will be in the best interests of the City.
In light of the foregoing Recitals,which the Council hereby makes and adopts as
determinations and findings,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1.All appointments set forth herein shall continue until such time as
Council may reconsider and modify the same,unless an individual appointee leaves
office,in which event the appointment shall immediately terminate.

Sec. 2-82. - City Council liaison responsibilities.
City Councilmembers appointed to serve as liaison to a board or commission have the following
responsibilities:
(1) Communicate with the board or commission when Council communication is needed and to
serve as the primary two-way communications channel between Council and the board or
commission.
(2) Take the lead in filling vacancies by reviewing applications, conducting interviews with
candidates for assigned board or commission.
(3) Make decisions about appointment recommendations to the City Council, keeping in mind
the need for fresh perspectives and not primarily based on liaison's personal preferences.
(4) Serve as the primary City Council contact for the board or commission.
(5) Resolve questions the board or commission may have about the role of City Council,
municipal government, or the board or commission.
(6) Establish contact with the board or commission chairperson and effectively communicate the
role of the liaison.
(7) Serve as Council contact rather than an advocate for or ex-officio member of the board or
commission.
(8) Review the annual work plan of the board or commission and make recommendations to the
City Council regarding the work plan.
(9) Identify and help resolve problems with respect to the functionality of the board or
commission with the assistance of the City Clerk's Office, City Manager's Office and the staff
liaison.
(10) Decide whether to grant a request from their assigned board or commission to hold a joint
meeting with other boards or commissions.

1. Assure appropriate review of Police Services Internal Affairs investigations through
the subcommittee process. Meet all required timelines, including those for Subcommittee
Meetings, including those for Subcommittee Meetings, Decision Memos, and
Subcommittee Minutes.
ACCOMPLISHED
• The CRB reviewed 0 cases in 2023. This was a decrease from the 5 cases
reviewed in 2022, and the 1 case reviewed in 2021.
2. Chair and/or Vice-Chair will regularly monitor the Citizen Review Board voicemail
and email and handle or forward any issues raised promptly and appropriately, as dictated
by the nature of the communication.
ACCOMPLISHED
• All voicemail and email inquiries were answered timely, where a response was
called for. There were no new cases initiated through either of these
communication channels.
3. Recognize and pursue opportunities to liaise with other appropriate Boards and
Commissions, such as the Human Relations Commission, as well as other community
agencies whose purpose encompasses similar or parallel missions, such as Crime-
Stoppers.

• The Board would like to tour Behavioral Health Services at Longview and meet with
staff to discuss new resources in our community. The facility opened in September
2023, and this will be on our 2024 Work Plan.

noted opportunities.

Duties and functions of the Citizen Review Board can be found in the City of Fort Collins

code; Chapter 2 - Administration; Article III; Division 8; Section 2.
1. At the request of the City Manager or the Chief of Police, to make recommendations to
the City Manager or the Chief of Police concerning the interpretation of police policies
and procedures.
2. To review the following categories of internal investigations conducted by Police
Services:
a. Investigations involving police officer or community service officer use of
deadly force, whether or not the use of such force actually results in death.
b. Investigations initiated by the written complaint of any person involved in an
incident occurring within one (1) year of said complaint, when such person
alleges that: (i) a police officer or community service officer used force or
discharged a firearm in violation of administrative policy or applicable law, (ii)
a police officer or community service officer committed a crime, or (iii) as a
result of a police officer's or community service officer's act or failure to act, a
person sustained severe injury or death or suffered a civil rights violation;
c. Any other investigations as requested by the City Manager or the Chief of
Police
3. To review any decision of the Chief of Police regarding the merits of any other
investigation for which a review has not been conducted by the Board pursuant to
Paragraph (2) of this Section, if review is requested in writing by a person involved
in the investigated incident and such person alleges police officer or community
service officer misconduct occurring within one (1) year of said request.
4. To reconsider any review previously conducted by the Board if the Board
determines that significant new information has become available which previously
was not reasonably available to the Board, the complainant or to Police Services.
5. Upon the request of any other public law enforcement entity operating within the
City, to review the internal investigations of such entities if the matter being
investigated occurred within the City.
6. To make annual reports to the City Council and City Manager concerning the
activities and recommendations of the Board;
7. To perform such functions as are committed to it by other ordinances or resolutions

2024 Work Plan
Goals
• Assure appropriate review of Police Services Internal Affairs inves�ga�ons through
subcommitee process. Meet all required �melines, including those for Subcommitee
Mee�ngs, Decision Memos and Subcommitee Minutes.
• Chair and/or Vice-Chair will regularly monitor the Ci�zen Review Board voicemail and
email. They will also handle or forward any issues raised promptly and appropriately as
dictated by the nature of the communica�on.
• Recognize and pursue opportuni�es to liaise with other appropriate Boards and
Commissions, such as the Human Rela�ons Commission, as well as other community
agencies whose purpose encompasses similar or parallel missions, such as Crime-
Stoppers.
• Arrange and provide appropriate training modules for new and exis�ng Board Members
throughout the year. Iden�fy, priori�ze and schedule training for any addi�onal noted
opportuni�es.
